A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING THE CITY'S PARTICIPATION IN THE
COUNTY -SPONSORED BRIDGE PREVENTATIVE MAINTENANCE
PROGRAM, APPROPRIATING $137,000 FROM GENERAL FUND
RESERVES TO COVER THE CITY'S LOCAL SHARE OF PROJECT
COSTS AND AUTHORIZING THE EXECUTION OF A FINANCIAL
AGREEMENT BY AND BETWEEN THE CITY OF VERNON AND THE
LOS ANGELES COUNTY PUBLIC WORKS DEPARTMENT
WHEREAS, the City of Vernon ("City") owns several roadway
overpasses and roadway bridges spanning the Los Angeles River; and
WHEREAS, the bridges are inspected biannually by the Los
Angeles County Public Works Department ("County"); and
WHEREAS, the County identified three bridges have been found
to require minor non-structural repairs in order to extend the life of
the bridge structures; and
WHEREAS, the overall project design, construction and repair
costs are estimated to be approximately $1,140,000.00; and
WHEREAS, the City's share of said costs is estimated to be
approximately 11.47%, which includes, but is not limited to, the cost
of preliminary engineering, preparation of plans, specifications,
utility engineering, and all other necessary work prior to the award
of the construction contract; and
WHEREAS, the County has applied for and received grant
funding for bridge repairs through the Federal Highway Administration
("FHWA") under the Federal Bridge Preventative Maintenance Program;
and
WHEREAS, from this grant funding, the County has developed a
countywide Preventative Bridge Maintenance Program (the "Program") and
has offered participation in the program to local agencies; and
WHEREAS, the County seeks a commitment from the City that
the City will participate in the Program; and
, WHEREAS, the Preventative Maintenance is a cost effective
means of implementing repairs; and
WHEREAS, the City's local share of the engineering design
and construction cost for bridge repairs under the County program is
an amount not to exceed $137,000.00; and
WHEREAS, the City was notified of the Program after the
FY 2012-2013 budget was adopted resulting in the Program not being
included in the Budget but has been included in the amended
FY 2012-2013 budget; and
WHEREAS, the County is also seeking the City's approval of a
Financial Agreement between the City and the County, to be provided by
the County once developed, for the preparation of plans,
specifications, environmental documents, as well as the construction
of repairs to the bridges; and
WHEREAS, by memorandum dated August 30, 2012, the Director
of Community Services has recommended the approval of the City's
participation in the Program, appropriating an amount not to exceed
$137,000.00 to cover the City's local share of the project and the
authorization to execute a Financial Agreement with the County.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the City's participation in the Preventative Bridge

Maintenance Program.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the appropriation of $137,000.00 from general fund reserves
in order to fund the City's local share of the engineering design and
construction costs for the proposed project.
SECTION 4: The City Council of the City of Vernon hereby
authorizes the City Administrator to execute a Financial Agreement
with the Los Angeles County Department of Public Works, for and on
behalf of, the City of Vernon, subject to the approval by the City
Attorney, and the Acting City Clerk, or Deputy City Clerk, is hereby
authorized to attest thereto.
SECTION 5: The City Council of the City of Vernon hereby
instructs the City Administrator, or his designee, to take whatever
actions are deemed necessary or desirable for the purpose of
implementing and carrying out the purposes of this Resolution and the
transactions herein approved or authorized, including but not limited
to, any nonsubstantive changes to the Financial Agreement.

SECTION 6: The Acting City Clerk of the City of Vernon
shall certify to the passage, approval and adoption of this
resolution, and the Acting City Clerk of the City of Vernon shall
cause this resolution and the Acting City Clerk's certification to be
entered in the File of Resolutions of the Council of this City.

SUMMARY
Los Angeles County Public Works Department has contacted City staff to advise that the County is
beginning its State and Federally -funded countywide Bridge Preventative Maintenance Program. County
staff has requested a commitment from Vernon in the amount of $137,000 to cover the City's local share
of the project. City staff recommends that the City Council adopt a resolution, Exhibit A, approving the
City's participation in the bridge repair program and approving the expenditure of $137,000 in General
Fund Reserves to cover the City's local cost share of the project.
ANALYSIS
- in July of 2012, Los Angeles County. Public Works Department (the County) advised staff that the County
had applied for and received funding from the Federal Highway Administration (FHWA) under the
Federal Bridge Preventative Maintenance Program, and inquired of staff as to the City's interest in making
use of the funding. Staff answered affirmatively, pending receipt of additional information regarding the
program.
Staff was notified that the County is commencing the Bridge Preventative Maintenance Program project,
which -would involve repairs to three of the bridges. The program. provides Federal funding for-
- ---preventive maintenance activities for eligible bridges, The County developed project cost estimate - -
spreadsheets, are attached as Exhibit B, identify the preventive maintenance needs for the bridges in
Vernon. The proposed preventative maintenance activities for the bridge structures are derived based on
biannual bridge inspection reports performed by the County. The: purpose of the project is to extend the life
of the bridge structures. The three bridges included in the program

The overall project design and construction costs for repairs to the three bridges are estimated by the
County to be $1,140,000.Of that total, the City's 11.47% cost share is estimated at $130,000. Included in
the requested amount is the cost for preliminary engineering, to include environmental findings and
approvals/permits, design survey, soils report, traffic index and geometric investigation, preparation of
plans, specifications, and cost estimates, right-of-way engineering, utility engineering, and all other
necessary work prior to. award of construction contract. The County will also perform construction - ----
engineering management services, which include administering the bidding, construction contract award,
and the construction itself. The County is requesting a liability surcharge of 4% for the preliminary
engineering and construction engineering management services. The liability surcharge cost is estimated at
$7,000, which combined with the design and construction costs brings the City's total share to $137,000.
At this time LA County Public Works is seeking a commitment that the City will participate in the
program, will execute a financial cooperative agreement, and will front $137,000 for the City's cost share
of the preliminary engineering and construction of the projects. The.City will be billed monthly for its.. _...-
share of the project costs, with Caltrans (fund administrator) being billed for the federal share.
As noted above, the County is also seeking the City's approval of what the County is calling a Financial
Agreement between the City and the County. However, since the County has yet to develop the form
Agreement, staff would recommend that the Council authorize the City Administrator to execute the
Financial Agreement once it is forwarded to the City, provided the document is first reviewed by the City
Attorney and provided that the City's estimated share under the Agreement does not exceed $137,000.
There is no indication from LA County as to a timeline for the preparation of a form Agreement. The
document is currently being drafted by engineers in the County Public Works Department and has yet to
be reviewed by County Counsel.
FINANCIAL REVIEW
The City was notified of the Bridge Preventative Maintenance Program after the FY 2012-2013 budget
was adopted. Thus, the requested $137,000 is not included in the original budget but has been included in
the amended FY 2012-13 budget: Staff is requesting an appropriation of the general fund from accounts -
that have been set aside for street and road improvements.
STAFF RECOMMENDATION -
Staff recommends that the City Council adopt the attached resolution approving the City's participation in
the bridge repair program and allowing staff to proceed with the project, appropriating an amount not to
exceed $137,000 to cover the City's local share of the project, and authorizing the City Administrator to
execute a. Financial Agreement with the County, subject to the approval of the document by the City
Attorney.

RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1.
A. The City of Vernon shall participate in the Los Angeles County Department of Public
Works Preventative Bridge Maintenance Program; and,
B. The City will have repairs to the following bridges designed and constructed by County
staff and County contractors at an estimated cost of $1,140,000; and
