Resolution No. 2012-206RESOLUTION NO. 2012-206 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPOINTING MEMBERS TO REPRESENT THE CITY OF VERNON ON THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 23 AND RESTATING AND CONFIRMING THE APPOINTMENT OF MEMBERS AND ALTERNATE MEMBERS TO REPRESENT THE CITY OF VERNON ON THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NOS. 1 AND 2 WHEREAS, the City of Vernon has been a member of Districts 1, 2 and 23 of the County Sanitation District (collectively, the "Districts") for many years; and WHEREAS, on May 1, 2012, the City Council of the City of Vernon adopted Resolution No. 2012-58 appointing members and alternate members to represent the City on the Board of Directors of the Districts; and WHEREAS, pursuant to California Health and Safety Code Section 4730, because District No. 23 lies wholly within the City of Vernon, the Vernon City Council is the Board of Directors for said District; and WHEREAS, pursuant to California Health and Safety Code Section 4730, the presiding officer of the City of Vernon is the designated member of the Board of Directors of Districts 1 and 2, and the Vernon City Council is required to select one of its members as an alternate in each case; and WHEREAS, due to a recent reorganization of the City Council, the City Council of the City of Vernon desires to appoint members to represent the City of Vernon on the Board of Directors of the Districts. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon hereby confirms the following members of the City Council of the City of Vernon who shall serve on the Board of Directors of County Sanitation District No. 23: William "Bill" Davis, Mayor W. Michael McCormick, Mayor Pro-Tem Richard J. Maisano, Councilman Michael A. Ybarra, Councilman Luz A. Martinez, Councilwoman SECTION 3: The City Council of the City of Vernon hereby confirms William "Bill" Davis, Mayor of the City of Vernon, to serve as its Member on the Board of Directors of County Sanitation District No. 1 and hereby appoints Michael A. Ybarra, a member of the City Council to serve as the City's alternate member on the Board of Directors of County Sanitation District No. 1. The alternate member of said District No. 1 Board of Directors shall act in place of the presiding officer of City Council of the City of Vernon during his absence, inability or refusal to act as such member of said District Board. Such appointments shall be effective until the death, resignation, disqualification or subsequent removal by the City Council of such representatives. SECTION 4: The City Council of the City of Vernon hereby confirms William "Bill" Davis, Mayor of the City of Vernon, to serve as its Member on the Board of Directors of County Sanitation District No. 2 and hereby reaffirms the appointment of W. Michael McCormick, Mayor Pro-Tem and a member of the City Council, to serve as the City's - 2 - r alternate member on the Board of Directors of County Sanitation District No. 2. The alternate member of said District No. 2 Board of Directors shall act in place of the presiding officer of City Council of the City of Vernon during his absence, inability or refusal to act as such member of said District Board. Such appointments shall be effective until the death, resignation, disqualification or subsequent removal by the City Council of such representatives. SECTION 5: The City Council of. the City of Vernon hereby directs the Interim City Clerk, or the Interim City Clerk's designee, to send a copy of this Resolution to: Kim Compton, Secretary of the County Sanitation District 1955 Workman Mill Road Whittier, CA 90601 SECTION 6: All resolutions, or parts of a resolution, or minute orders in conflict with this Resolution are hereby repealed. SECTION 7: The Interim City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the Interim City Clerk of the City of Vernon shall cause this resolution and the Interim City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator RE: County Sanitation Districts 1, 2 and 23 Background On October 23, 2012, the Vernon City Council appointed William J. Davis as Mayor of the City and Luz A. Martinez was appointed to serve as part of the City Council. Pursuant to California Health and Safety Code Section 4730, the presiding officer of the City is the designated member of the Boards of Directors of County Sanitation Districts No. 1 and 2, and the City Council is required to select one of its members as an alternate in each case. Furthermore, because District 23 lies wholly within the City of Vernon, the Vernon City Council is the Board of Directors for said district. Recommendation It is recommended to adopt a resolution, to reaffirm Michael McCormick as the selected alternate for County Sanitation District No. 2 and appoint an alternate to District No. 1.
