A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 9542 BY AMENDING
SECTION 10 OF SAID RESOLUTION RESPECTING VACATION
POLICIES FOR EMPLOYEES OF THE CITY OF VERNON AND
REPEALING ALL RESOLUTIONS IN CONFLICT THEREWITH
WHEREAS, on February 4, 2008, the City Council of the City of
Vernon adopted Resolution No. 9542 amending and restating Resolution
No. 8764 adopted on June 29, 2005, which established the vacation
policies, holidays and "in lieu" holidays for employees of the City of
Vernon (the "Vacation Resolution"); and
WHEREAS, on March 3, 2008, the City Council of the City of
Vernon adopted Resolution No. 9563 amending certain sections and
schedules of the Vacation Resolution; and
WHEREAS, the City desires to amend Section 10 of the Vacation
Resolution to provide for vacation and administrative leave for
Executive Management Staff.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: Section 10 of the Vacation Resolution is hereby
amended as indicated on Exhibit A which is attached hereto and
incorporated herein by reference.
SECTION 3: The provisions of Resolution No. 9542 not
consistent with or in conflict with this Resolution, are hereby
repealed; in all other respects Resolution Nos. 9542 and 9563 shall
remain in full force and effect.
SECTION 4: The Interim City Clerk of the City of Vernon
shall certify to the passage., approval and adoption of this resolution,
and the Interim City Clerk of the City of Vernon shall cause this
resolution and the Interim City Clerk's certification to be entered in
the File of Resolutions of the Council of this City.

SECTION 10: Executive Management Staff
Executive Management Staff shall include the City
Administrator, City Attorney, City Clerk, City Treasurer and the heads
of all Departments as listed in the City Code or City Charter and their
respective Deputies and Assistant Directors.

Background
The City of Vernon is currently recruiting for several executive level positions. However
during a preceding employment negotiation for an executive staff position, City staff were
informed that the vacation and sick leave benefits offered to City of Vernon Executives was
extremely below the average of what is offered in comparable and surrounding cities for these
level positions. To ensure the City of Vernon is up-to-date and well-informed about the
competitive labor market and is able to offer attractive benefits ensuring high quality candidates,
staff conducted a survey to determine the average vacation, sick and administrative leave offered
to other executive level employees.
The attached survey is comprised of two sets of data that have been used as a standard for
the City of Vernon's survey comparisons. The first is a small sample that includes Anaheim,
Burbank, Los Angeles, Pasadena and Riverside. These cities are selected based upon having
their own electric and water departments and are full -service cities.
The second is a larger sample that includes the foregoing cities as well as Alhambra, Bell
Gardens, Commerce, Compton, Cudahy, Downey, Huntington Park, Inglewood, Maywood,
Montebello, Monterey Park, Pico Rivera, and South Gate, which were selected because they are
all within a 5-mile radius of Vernon.
Survey Findings
Vacation Leave Resolution No. 9542 sets forth the vacation accrual schedule for
Executive employees. In comparison to the large and small sample group, the City of Vernon is
extremely below the average vacation leave offered to its' executive level staff. In many of the
comparable cities, executive level vacation leave benefits are higher than their subordinates.

Sick Leave: In accordance with Resolution No. 2012-111 Sick leave Policy, Executive
staff receive 80 hours a year capped to a maximum of 480 hours of sick leave. The City of
Vernon provides below average hours of sick leave to employees in comparison to other full -
service cities.

Administrative Leave: The City of Vernon does not provide Administrative leave to
their executive staff or exempt employees. Administrative leave is provided to employees who
are exempt from the Fair Labor Standards Act (FLSA) and are not eligible for overtime or
compensatory time off. Typically, administrative leave is offered as time off to exempt
employees to relieve stress and give breaks needed so that employees are better able to carry out
decision making processes involved in their complex responsibilities as professionals and
executives.

All employees need time away from the workplace on an annual basis. The City of Vernon
encourages executive staff and all employees to take time away from work to rest, relax and
recharge. In doing so, the employee returns to work refreshed and creative thereby keeping
stress levels lower for a healthier lifestyle. Organizations who offer work -life balances seek to
raise employee satisfaction, loyalty, and worker retention by providing valuable benefits that go
beyond a base salary figure.
Considering the totality of the above circumstances, and the below market average of vacation
and administrative leave offered to executive level staff in comparison to other jurisdictions, the
following Vacation and Administrative Leave for Executive staff is recommended effective
January 1, 2013:

Fiscal Impact
There is no immediate fiscal impact to increase the level of vacation and administrative leave
benefits offered to executive employees. Current executives who have reached their 480 hour
maximum accrual rate shall be provided reasonable time to bring their vacation hours at or below
the maximum threshold.
Recommendation
It is recommended the attached resolution be approved, authorizing the revision of Executive
staff vacation and administrative leave accruals effective January 1, 2013 for the positions of
City Administrator, City Attorney, City Clerk, City Treasurer and the heads of all Departments
as listed in the City Code or City Charter and their respective Deputies and Assistant Directors.
