A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON ACCEPTING THE WORK OF ALL AMERICAN ASPHALT
IN ACCORDANCE WITH CONTRACT NO. CS-0052 OF THE CITY
OF VERNON
WHEREAS, All American Asphalt was awarded Contract
No. CS-0052 for Citywide Rubberized Emulsion -Aggregate Slurry (REAS)
Seal Phase I pursuant to Resolution No. 2012-82 of the City of Vernon;
and
WHEREAS, the Director.of Community Services and Water has
reported to the City Council of the City of Vernon that said work has
been completed and recommends that the work be accepted and payment be
made to the Contractor in accordance with the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2 The work of All American Asphalt pursuant to
Contract No. CS-0052 is hereby approved and accepted by the City
Council of the City of Vernon.
SECTION 3: The original contract amount was Six Hundred
Eleven Thousand Dollars and No Cents ($611,000.00). The total final
contract amount is Five Hundred Ninety Thousand One Hundred Sixty -
Seven Dollars and Fifteen Cents ($590,167.15). The five percent (50)
retention or the sum of Twenty -Nine Thousand'Five Hundred Eight
Dollars and Thirty -Six Cents ($29,508.36) is payable thirty-five (35)
days after the recordation of the Notice of Completion, except such
amounts as are required by law to be withheld by properly executed and
filed notices to stop payment, or as may be authorized by the contract
to be further retained.
SECTION 4: The City Council of the City of Vernon hereby
directs payment of said sums as set forth to All American Asphalt and
instructs.the Interim City Clerk to file a Notice of Completion with
the County Recorder.
SECTION 5: The Interim City Clerk of the City of Vernon
shall certify to the passage, approval and adoption of this
resolution, and the Interim City Clerk of the City of Vernon shall
cause this resolution and the Interim City Clerk's certification to be
entered in the File of Resolutions of the Council of this City.

The City of Vernon's contractor All American Asphalt has completed construction of the
Citywide Rubberized Emulsion -Aggregate Slurry (REAS) Seal Phase I project, City Contract No.
CS-0052 and all work has been found to be acceptable.
Four bids were received and opened on April 11, 2012 and the contract was awarded to All
American Asphalt in the total bid amount of $611,000.00 (Six Hundred Eleven Thousand Dollar) on
June 5, 2012.
Fruitland Avenue from Santa Fe Avenue to Pacific Boulevard has been deleted from the
project due to the proposed reconstruction of a Gas Company's gas pipe line which was suspected of
leaking.
The final construction cost for this project is $590,167.15. Funds for the project will come
from East West Bank "EWB Street Improvements Account No. 011.100150.
It is recommended that the project be accepted and the final progress payment of $560,658.79
(Five Hundred Sixty Thousand Six Hundred Fifty Eight Dollar and seventy nine cent) be paid. It is
also recommended that five percent (5%) retention of $29,508.36 (Twenty Nine Thousand Five
Hundred Eight Dollar and thirty six cent) be deposited into All American Asphalt's escrow account
number 1983 at the Community Bank and to be released thirty-five (35) days after the recordation of
the Notice of Completion, except such amounts as are required by law to be withheld by properly
executed and filed notices to stop payment, or as maybe authorized by the contract to be further
retained.
