A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND ACCEPTING A UTILITY EASEMENT
DEED FOR PROPERTY LOCATED AT 4401 DOWNEY ROAD, AND
APPROVING AND AUTHORIZING THE EXECUTION OF A
CERTIFICATE OF ACCEPTANCE IN RELATION THERETO
WHEREAS, 4441 Downey Road, LLC ("Downey"), has offered to the
City a non-exclusive Utility Easement Deed ("Easement Deed"), under,
over and across a portion of the real property in the City commonly
known as 4401 Downey Road, Vernon (the "Property"), a copy of the said
Easement Deed is attached hereto as Exhibit A; and
WHEREAS, the interests in real property created by the
Easement Deed will be used by the City for the installation, operation
and maintenance of City utilities including, but not limited to,
water, sewer, gas and electric lines through the Property; and
WHEREAS, by memo dated January 8, 2013, the Director of
Community Services and Water has recommended that the City accept the
Easement Deed and approve the execution of a Certificate of Acceptance
related thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon hereby
accepts the interests in .real property conveyed to the City of Vernon
by the Utility Easement Deed (the "Easement Deed"), approves the
Easement Deed and consents to the recordation of the Easement Deed.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor or Mayor Pro-Tem to execute the Certificate of
Acceptance accepting the Easement Deed for, and on behalf of, the City
of Vernon and the Interim City Clerk, or Deputy City Clerk, is hereby
authorized to attest thereto.
SECTION 4: The City Council of the City of Vernon hereby
instructs the City Administrator, or his designee, to take whatever
actions are deemed necessary or desirable for the purpose of
implementing and carrying out the purposes of this Resolution and the
transactions herein approved.or authorized.
SECTION 5: The City Council of the City of Vernon hereby
authorizes the Interim City Clerk, or his designee, to submit the
Easement Deed to the County Recorder.
SECTION 6: The Interim City Clerk of the City of Vernon
shall certify to the passage, approval and adoption of this resolution,
and the Interim City Clerk of the City of Vernon shall cause this
resolution and the Interim City Clerk's certification to be entered in
the File of Resolutions of the Council of this City.
