Resolution No. 2013-016RESOLUTION NO. 2013-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING THE GUIDELINES FOR FILMING IN VERNON TO PROVIDE FOR PARKING FEES WHEREAS, on December 17, 1991, the City Council of the City of Vernon adopted Resolution No. 6028, adopting Guidelines for Filming in Vernon (the "Guidelines"), and establishing fees therefor; and WHEREAS, on September 8, 1998, the City Council of the City of Vernon adopted Resolution No. 7141, amending the Guidelines to provide for the use of Vernon off -duty police officers for security at filming locations; and WHEREAS, by memorandum dated January 22, 2013, the City Administrator recommended that, (i) the Guidelines be amended to include parking fees and said fees be incorporated into the "Schedule of Fees for Filming Activity", and (i.i) that parking fees be negotiable within the fees ranging from $800.00 to $1,200.00 per day. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council finds the above recitals are correct. SECTION 2: The City Council finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with Section 15061(b)(3), because this action will not have a significant effect on the environment. SECTION 3: The City Council hereby amends the "Guidelines for Filming in the City of Vernon", as follows: (a) Attachment #1, entitled, "Schedule of Fees for Filming Activity" is revised to read as set forth in Exhibit A to this Resolution; (b) a new section, to be entitled "City of Vernon Community Services & Water" is hereby added after the section entitled "City of Vernon Police Department", and before "Final Approval" to read as set forth in Exhibit B to this Resolution. SECTION 4: The City Council hereby authorizes the Director of Community Services & Water, the City Administrator,. and any designee of either party, to determine the daily rate for the use of city controlled non -street property, provided the rates are between $800.00 and $1,200.00 per lot per day. SECTION 5: The Interim City Clerk shall certify to the passage, approval and adoption of this resolution, and the Interim City Clerk shall cause this resolution and the Interim City Clerk's certification to be entered in the File of Resolutions of the Council of this City. If paid film permit fees exceed actual fees incurred, or if any portion of any refundable security deposit is unused, then at the expiration of the permit, the City will promptly refund any excess fees or unused security deposit to the film permit holder. If the estimated fees paid to the city was insufficient, or if any security deposit was insufficient to offset city's costs, then the film permit holder shall promptly pay the city the amounts underpaid. Director of Community Services and Water to determine exact daily rate.within this range, depending on the value of the property used. $ 75/hour $ 75/hour (2 hour minimum) $ 90/hour (2 hour minimum) $ 500/hour $ 75/hour $ 110/location EXHIBIT B BIT B TO RESOLUTION City of Vernon Community Services & Water In addition to its streets and rights -of -way, Vernon owns or controls real property throughout Vernon and will endeavor to make such realty available for use for filming purposes. Vernon particularly encourages the use of its vacant lots for the parking of film -related vehicles. Vernon's daily rate for use of its lots is communicated through the department of Community Services & Water and based on the fair market value of the requested lots. Such daily rates per lot must be within the parameters set forth in Attachment #1. Whitworth, City AdministratorlJ�K RE: Approval to amend film permit schedule to include parking fees Recommendation It is recommended that the City Council find that approval of amending film permit fees to include film parking fees in this staff report are exempt under the California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. It is recommended that the City Council approve the new parking fee and incorporate it into the "Schedule of Fees for Filming Activity." Background Staff recently received a request to lease City property on a short term basis for film crew parking. Currently Film LA Inc. arranges and coordinates filming in the City of Vernon. After reviewing the City's filming guidelines and fee schedule it was determined parking fees were not included. Staff has reviewed various local agencies' parking fee schedules and recommends that parking fees ranging from $800 - $1,200 a day. Staff also recommends that the fees be negotiable within the range provided. Fiscal Impact Revenues from film parking fees will generate approximately $800 - $7,200 a year depending on demand.
