Resolution No. 2013-018RESOLUTION NO. 2013-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPOINTING DAVID KIMES TO SERVE AS THE INTERIM FIRE CHIEF OF THE CITY OF VERNON WHEREAS, on December 29, 2012, Mark Whitworth resigned as Fire Chief of the City of Vernon to eliminate the concurrent executive positions being filled by one individual, in accordance with the good governance reforms recommended by Senator Kevin de Leon and the City's Reform Monitor John Van de Kamp; and WHEREAS, the City of Vernon (the "City"), has retained the services of Roberts Consulting Group, Inc., to recruit a Fire Chief for the City; and WHEREAS, the City Council of the City of Vernon desires to appoint David Kimes to serve as Interim Fire Chief while the City conducts an executive recruitment to fill the position of Fire Chief on a permanent basis. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. SECTION 3: The City Council of the City of Vernon hereby appoints David Kimes to serve as the Interim Fire Chief of the City of Vernon, effective January 22, 2013, until such time as the City Council approves his removal or appoints another person to the position of Fire Chief. SECTION 4: The Interim City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the Interim City Clerk of the City of Vernon shall cause this resolution and the Interim City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator RE: Appointment of Interim Fire Chief Recommendation It is recommended that the City Council find that adoption of the resolution proposed in this staff report is exempt under the California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. It is recommended that the City Council adopt a resolution appointing David Kimes as Interim Fire Chief, effective January 22, 2013, until a permanent Fire Chief is selected through the recruitment currently being conducted by Roberts Consulting Group. Background In line with the good governance reforms recommending the elimination of concurrent executive positions being filled by one individual, I resigned as the City's Fire Chief effective December 29, 2012, and am now exclusively serving as the City Administrator. Under the Fire Department's two-year rotational schedule for the position of Assistant Fire Chief, David Kimes is filling that role as of January 1, 2013. All of the four existing Battalion Chief s has filled the Assistant Fire Chief position at least once, and this is Mr. Kimes' second stint as Assistant Fire Chief. In an effort to maintain efficient operations within the Fire Department and in accordance with the new Human Resources Policies and Procedures, it is recommended that David Kimes be appointed as the Interim Fire Chief, effective January 22, 2013, until a permanent Fire Chief is selected through the recruitment currently being conducted by Roberts Consulting Group.
