Resolution No. 2013-030RESOLUTION NO. 2013-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON PROVIDING FOR THE APPROPRIATION OF THE CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM FUNDS RECEIVED FOR FISCAL YEAR 2012-2013 FOR FRONTLINE MUNICIPAL POLICE SERVICES WHEREAS, the State of California provides Citizens Option for. Public Safety Program ("COPS Program"), funding; and WHEREAS, the County of Los Angeles has established a Supplemental Law Enforcement Service Fund (SLESF), in accordance with Section 30061, of the Government Code to receive COPS Program funds which have been allocated for use in Los Angeles County; and WHEREAS, the City has established its own SLESF in accordance with Section 30061, of the Government Code; and WHEREAS, the City's SLESF will receive One Hundred Thousand Dollars ($100,000.00), in COPS Program funds for fiscal year 2012-2013, which must be used to supplement existing frontline municipal police services; and WHEREAS, Section 30061(h), of the. Government Code provides that funds received in any fiscal year be expended or encumbered no later than June 30, of the following fiscal year; and WHEREAS, by memo dated February 19, 2013, the Chief of Police has recommended that the Police Department be authorized to use the COPS Program funds received for fiscal year 2012-2013, and any interest in the SLESF account accumulated through June 30, 2014, (collectively, the "COPS Program - SLESF Funds"), to pay some salary costs for a Civilian Court Officer, one Dispatcher in fiscal year 2012-2013, and/or fiscal year 2013-2014, and any other unbudgeted expenses for frontline municipal police services; and WHEREAS, the City Council has conducted a public hearing to consider the funding request from the Chief of Police to use the COPS Program - SLESF Funds for frontline municipal police services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby . finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. SECTION 3: The City Council of the City of Vernon hereby directs that the City continue to maintain its own SLESF in accordance with California state law. SECTION 4: The City Council of the City of Vernon finds that all persons have had the opportunity to be heard or to file written comments on the funding request from the Chief of Police, and after due consideration of any and all evidence submitted at the public hearing, determines that there are compelling reasons to justify the expenditure of COPS Program.- SLESF Funds to pay for a Civilian Court Officer, one Dispatcher and any other unbudgeted expenses for frontline municipal police services, and further finds that use of the funds in this manner will supplement, not supplant; existing frontline municipal police services. SECTION 5: The City Council of the City of Vernon hereby approves and authorizes the appropriation of COPS Program - SLESF Funds to pay for a Civilian Court Officer, and one Dispatcher, in - 2 - fiscal year 2012-2013, and/or fiscal year 2013-2014, and to the extent there are any funds remaining, to pay for any other unbudgeted expenses for frontline municipal police services in fiscal year 2012-2013. SECTION 6: The City Council of the City of Vernon hereby directs the City Clerk, or the City Clerk's designee, to deliver a copy of this Resolution to the appropriate person at the County of Los Angeles. SECTION 7: The Interim City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the Interim City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the Interim City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City. Background The Police Department will be receiving $100,000.00 through the Citizens Option for Public Safety (COPS) Program pursuant to Section 30061 of the Government Code. The Police Department is requesting authorization to use these funds to pay some salary costs for civilian support personnel, ((Civilian Court Officer and (1) Dispatcher)) in FY 2012-2013 and/or FY 2013 2014. Due to our past reductions in force, the City would not have these civilian positions as part of its frontline municipal police services without the grant funding. Thus, the services provided by these civilian personnel supplement, and do not supplant, existing frontline municipal police services State Assembly Bill 1913 was enacted in fiscal year 2000-2001 to continue funding for the Citizens Option for Public Safety (COPS) Program ("COPS Program"), and has been modified from time to time by the legislature (e.g., State Senate Bill 823 in 2002). Annually, the state legislature has continued to provide COPS Program funds. The COPS Program allows eligible cities to receive a proportionate share of COPS Program funds. The grant funds are administered and distributed through the Chief Executive Office of Los Angeles County. The Police Department will be receiving $100,000.00 through the COPS Program for fiscal year 2012-2013 (FY13). The funds must be deposited into the City's Supplemental Law Enforcement Services Fund (SLESF) established pursuant to Section 30061 of the Government Code. The SLESF is a separate interest bearing fund to record the receipt and expenditures of the monies received. These funds must be used to supplement, and not supplant, existing "frontline municipal police services" being provided by the City. State law authorizes the City Council to use the funds provided by the COPS Program — both existing and anticipated moneys — in accordance with the written requests of the Chief of Police (per Government Code § 30061(c)(2)). The City Council must hold a public hearing before acting upon such a written request. The request must be considered separate and apart from the process applicable to proposed allocations of the City's general fund. The City has published a Notice of Public Hearing in Eastern Group Publications on January 24, 2013. The same publication was also printed on January 17, 2013. A copy is attached. The Police Department has received $76,877.93 of the allocated $100,000 in COPS Program funds for FY13. To date, none of the funds have been spent. COPS Program funds received for FY13 must be encumbered no later than June 30, 2014. A local agency that does not meet this requirement must remit unspent SLESF monies to the state. The Chief of Police makes the following request for use of the FY13 COPS Program — SLESF funds and any interest in the SLESF account accumulated through June 30, 2014: • To pay the wage and/or overtime of a Civilian Court Officer (current) • To pay the wage and/or overtime of a full or part time Dispatcher (additional) • To pay for any other unbudgeted expenses for frontline municipal police services. The Civilian Court Officers position is currently funded through the FY12 COPS Program SLESF funds. Our request is to continue to fund this position with COPS Grant funding. We are also requesting authorization to fund an additional Dispatcher position. Both our Civilian Court Officer and an additional Dispatcher are positions that the City would not have as part of its frontline municipal police services without the grant funding. Thus, the services provided by these positions supplement, and do not supplant, existing frontline municipal police services. Fiscal Impact There are no cost -share or match requirements associated with this grant.
