Resolution No. 2013-049RESOLUTION NO. 2013-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPOINTING MEMBERS TO REPRESENT THE CITY OF VERNON ON THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT, NO. 23, AND RESTATING AND CONFIRMING THE APPOINTMENT OF MEMBERS AND ALTERNATE MEMBERS TO REPRESENT THE CITY OF VERNON ON THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT, NOS. 1 AND 2 WHEREAS, the City of Vernon has been a member of Districts 1, 2 and 23, of the County Sanitation District (collectively, the "Districts"), for many years; and WHEREAS, on November 6, 2012, the City Council of the City of Vernon adopted Resolution No. 2012-206, appointing members and alternate members to represent the City on the Board of Directors of the Districts; and WHEREAS, pursuant to California Health and Safety Code Section 4730, because District No. 23, lies wholly within the City of Vernon, the Vernon City Council is the Board of Directors for said District; and WHEREAS, pursuant to California Health and Safety Code, Section 4730, the presiding officer of the City of Vernon is the designated member of the Board of Directors of Districts 1 and 2, and the Vernon City Council is required to select one of its members as an alternate in each case; and WHEREAS, due to a recent reorganization of the City Council, the City Council of the City of Vernon desires to appoint members to represent the City of Vernon on the Board of Directors of the Districts. 043013215 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon hereby confirms the following members of the City Council of the City of Vernon who shall serve on the Board of Directors of County Sanitation District, No. 23: W. Michael McCormick, Mayor William "Bill" Davis, Mayor Pro-Tem Richard J. Maisano, Councilman Michael A. Ybarra, Councilman Luz A. Martinez, Councilwoman SECTION 3: The City Council of the City of Vernon hereby confirms W. Michael McCormick, Mayor of the City of Vernon, to serve as its Member on the Board of Directors of County Sanitation District No. 1 and hereby reaffirms Michael A. Ybarra, a member of the City Council, to serve as the City's alternate member on the Board of Directors of County Sanitation District, No. 1. The alternate member of said District No. 1, Board of Directors shall act in place of the presiding officer of City Council of the City of Vernon during his absence, inability or refusal to act as such member of said District Board. Such appointments shall be effective until the death, resignation, disqualification or subsequent removal by the City Council of such representatives. SECTION 4: The City Council of the City of Vernon hereby confirms W. Michael McCormick, Mayor of the City of Vernon, to serve as its Member on the Board of Directors of County Sanitation District, No. 2 and hereby appoints William "Bill" Davis, a member of the, City Council, to serve as the City's alternate member on the Board of - 2 - 043013215 Directors of County Sanitation District No. 2. The alternate member of said District, No. 2 Board of Directors shall act in place of the presiding officer of City Council of the City of Vernon during his absence, inability or refusal to act as such member of said District Board. Such appointments shall be effective until the death, resignation, disqualification or subsequent removal by the City Council of such representatives. SECTION 5: The City Council of the City of Vernon hereby directs the Interim City Clerk, or the Interim City Clerk's designee, to send a copy of this Resolution to: Kim Compton, , Secretary of the County Sanitation District 1955 Workman Mill Road Whittier, CA 90601 SECTION 6: All resolutions, or parts of a resolution, or minute orders in conflict with this Resolution are hereby repealed. - 3 - 043013215 SECTION 7: The Interim City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the Interim City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the Interim City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator RE: Adoption of a Resolution to Appoint an Alterna he Los Angeles County Sanitation District No. 2 Recommendation It is recommended that the City Council: 1. Find that adoption of the Resolution proposed in this staff report is exempt under the California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. 2. Adopt a Resolution to reaffirm Michael A. Ybarra as the selected alternate for the Board of Directors of County Sanitation District No. 1 and appoint an alternate to District No. 2. Background On April 16, 2013, the Vernon City Council appointed Michael W. McCormick as Mayor and William J. Davis to serve as Mayor Pro Tempore. Pursuant to California Health and Safety Code, Section 4730, the presiding officer of the City is the designated member of the Boards of Directors of County Sanitation Districts No. 1 and 2, and the City Council is required to select one of its members as an alternate in each case. Furthermore, because District 23 lies wholly within the City of Vernon, the Vernon City Council is the Board of Directors for said district.
