A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON DETERMINING THE SPECIAL PARCEL TAX LEVIED
PURSUANT TO SECTION 5.45 OF THE MUNICIPAL CODE FOR
FISCAL YEAR 2013-2014
WHEREAS, Section 5.45 of the Municipal Code authorizes a
special parcel tax (the "Tax") on warehouses, truck terminals, freight
terminals and other distribution facilities to fund (i) construction,
improvement and maintenance of streets, bridges and other public
rights -of -way, including acquisition of land and (ii) police and fire
protection services; and
WHEREAS, Section 5.45(e) of the Municipal Code authorizes the
City Council to determine, for each fiscal year, by ordinance or
resolution, the Tax to be imposed on each parcel subject to the Tax;
and
WHEREAS, pursuant to Section 5.45(e) of the Municipal Code
the rate of the Tax for any fiscal year may not exceed the maximum rate
calculated as set forth in Sections 5.45(c)and 5.45(d) of the Municipal
Code, but the tax may be imposed at a lower rate; and
WHEREAS, for fiscal year 2013-2014, the maximum rate for the
Pax, adjusted for inflation in the manner set forth in Section 5.45(d)
of the Municipal Code, is $29.09 per 100 square feet of gross area of
land; and
WHEREAS, the City Council desires to cause the Tax to be
levied and collected for fiscal year 2013-2014 at this maximum rate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.

SECTION 2: The City Council of the City of Vernon finds
that this action is exempt under the California Environmental Quality
Act (CEQA), in accordance with Section 15061(b)(3), the general rule
that CEQA only applies to projects that may have an effect on the
environment.
SECTION 3: The City Council of the City of Vernon hereby
determines the special tax for fiscal year 2013-14 shall be $29.09 per
100 square feet of gross area of land (or .2909C per square foot). A
list of parcels subject to the Tax, as well as the amount of the Tax to
be levied upon each for fiscal year 2013-14, is attached hereto as
Exhibit A and is hereby approved.
SECTION 4: The special tax imposed by this section shall be
collected in the same manner as ad valorem property taxes are collected
and shall be subject to the same procedure, sale and lien priority in
case of delinquency as is provided by ad valorem taxes.
SECTION 5: The City Clerk, or the City Clerk's designee, is
hereby directed to transmit a copy of this resolution, together with
such other information as may be required for placement of the special
tax on the County property tax bills, to the Department of Auditor -
Controller of the County of Los Angeles.
SECTION 6: The City Administrator, or the City
Administrator's designee, is hereby authorized to amend the aforesaid
list to add any parcel subject to the tax omitted therefrom, with said
tax calculated at the rate of $29.09 per 100 square feet of gross area
of land (or .2909C per square foot), and to delete any parcel
erroneously included.

the City of Vernon shall certify to the passage, approval and adoption
of this resolution, and the Interim City Clerk, or Deputy City Clerk,

RE: Approval of 2013-2014 Warehouse Parcel ax Rates
Recommendation
It is recommended that the City Council:
1. Find that adoption of the resolution proposed in this staff report is exempt from the
California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3),
the general rule that CEQA only applies to projects that may have an effect on the
environment.
2. Adopt a resolution setting the Warehouse Parcel Tax rate at $29.09 per 100 square feet
for fiscal year 2013-2014 and submitting the special parcel tax list to the Los Angeles
County Auditor Controller's Office.
Background
On April 14, 1998, the voters approved Ordinance No. 1057, authorizing a special parcel tax on
warehouses, buck terminals, freight terminals and other distribution facilities at $1.00 per 100
square feet of parcel area.
On November 16, 1999, the voters approved Ordinance No. 1076, establishing a new maximum
tax rate for the warehouse parcel tax at $20.00 per 100 square feet, adjusted annually based upon
increases in the Consumer Price Index. Proceeds of the warehouse parcel tax may be expended
only on (i) construction, improvement and maintenance of streets, bridges and other public
rights -of -way, including acquisition of land and (ii) police and fire protection services.
The warehouse parcel tax is collected annually on the Los Angeles County property tax bill. The
City Council sets the rate of the tax. The Council must choose a rate that is no greater than the
maximum tax rate for the fiscal year.
For fiscal year 2008-2009 City Council adopted Resolution No. 9626 setting the warehouse
parcel tax at $22.00 per 100 square feet. For fiscal year 2009-2010 Resolution No. 10,033 set
the rate at $24.00 per 100 square feet. For fiscal year 2010-2011 Resolution No. 2010-88 set the

at $28.72 per 100 square feet.
Applying the Consumer Price Index in the manner required by Ordinance No. 1076, the
Community Service Department has calculated the maximum warehouse parcel tax rate for fiscal
year 2013-14 to be $29.09 per 100 square feet of gross area of land. Staff recommends that the
Council set the tax at this maximum rate. Based on this rate, the warehouse parcel tax would
generate approximately $9.9 million dollars.

SUBJECT: M43UMUM SPECIAL (WAREHOUSE) PARCEL TAX
1999. Section 5A5(c) sets the special parcel tax rate at $20.00 per 100 square feet commencing in fiscal year
Section 5.45(d)(2) states that the maximum rate established by this article shall be revised annually
based upon the consumer price index for the consumer (CPI-U), all items index, Los Angeles -Anaheim
Riverside area (1982-84=100) published by the United States Department of Labor Bureau of Labor Statistics
with the period endirig March 31 of each year being utilized as the adjustment date.
Per this section the formula to calculate the maximum rate is as follows:
Multiply the tax rate by a fraction, the numerator of which is the CPI on the
adjustment date and the denominator of which is the CPI for the period
ending March 31, 1999
CPI March 31, 1999 = 165.00
CPI March 31, 2013 = 239.995
Maximum Special Parcel Tax Rate for Tax Year 2013/2014
20.00(239.995/165.0) = $29.09 per 100 square feet of gross area of land or
$0.2909 per square foot of gross area of land which is a 45.45% increase over
the 1999 rate
Therefore the maximum Special Parcel Tax rate that may be established for tax year 2013/2014 is
$29.09 per 100 square feet of gross area of land. The current Special Parcel Tax rate is $28.72 per 100 square
feet of gross area of land. The City Council must determine a Special Parcel Tax rate for tax year 2013/2014
prior to June 30, 2013.
