A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING A NEW CONDITIONAL USE PERMIT TO
THEREBY AMEND RESOLUTION NO. 8176 AND ALLOW U.S.
STORAGE CENTERS, INC. TO OPERATE A PUBLIC SELF -
STORAGE FACILITY AT 4250 ALAMEDA STREET IN CITY OF
VERNON
WHEREAS, on April 2, 2013, the City Council of the City of
Vernon adopted Resolution No. 8176 granting a conditional use permit
("CUP") to A -American Self Storage Mini -Warehouse at 4250 Alameda
Street in the City of Vernon for the operation of a public self -
storage facility (the "Project"); and
WHEREAS, the original CUP was issued to A -American Self
Storage; and
WHEREAS, U.S. Storage Centers, Inc. (the "Applicant"), is
considering purchasing the property and business; and
WHEREAS, U.S. Storage Centers, Inc. ("the Applicant") is
requesting an amendment to the conditions of approval to the existing
CUP approved by Resolution No. 8176; and
WHEREAS, the City Council of the City of Vernon held a
properly noticed public hearing on this requested amendment to the
conditions of approval to the CUP on August 20, 2013; and
WHEREAS, the Applicant is requesting that Resolution No.
8176, granting a CUP for a public storage be amended, to conform to
existing law and allow the Applicant to continue to use the property
after the change of ownership and/or the issuance of a new occupancy
permit; and
WHEREAS, the Applicant has stated that the pattern of
operation will be consistent with all enforceable terms of the

existing CUP, and largely the same as that of the previous occupant;
and
WHEREAS, the proposed use does not qualify as a "change of
use" for purposes of the zoning code; and
WHEREAS, the Applicant is not proposing any structural
alterations or modifications to the existing building; and
WHEREAS, the proposed site is located in the I -Zone,
Industrial; and
WHEREAS, legal non -conforming uses may lawfully continue
where, as here, the use complies with Municipal Code § 26.4.1-6(a); and
WHEREAS, the proposed use would not violate Section
26.4.1-6(b) because it will not allow an increase in floor area, change
the use, or decrease the parking, loading, or maneuvering capacities;
and
WHEREAS, the issuance of a new CUP for a public storage
facility is permissible and is consistent with the objectives of the
Comprehensive Zoning Ordinance and the General Plan; and
WHEREAS, City staff has determined that the proposed
modification will not result in any significant environmental changes
to Applicant's operation, therefore, the original notice of exemption
is in accordance with the California Environmental Quality Act
("CEQA") as provided in Section 15301, Class 1, existing facilities,
and is adequate for this modification; and
WHEREAS, the City Council has received a Staff Report, dated
August 20, 2013, upon which it has relied in making the foregoing
recitals; and
WHEREAS, the proposed site is surrounded by commercial,
industrial and warehousing uses compatible with the proposed use and

adverse effects from traffic, parking, noise, odors, dust, smoke,
light or glare, or risk of fire, infection or explosion is not
anticipated from the proposed operation; and
WHEREAS, the conditions imposed on the CUP will adequately
protect the public health, safety and general welfare and the
operation is consistent with all applicable rules and laws of the City
of Vernon.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the above recitals are true and
correct.
SECTION 2: The City Council of the City of Vernon further
finds that all persons have had the opportunity to be heard or to file
written comments to the proposed Project and after due consideration
of all the evidence submitted at the public hearing determines that
there are compelling reasons to justify granting a modification to the
CUP.
SECTION 3: The City Council of the City of Vernon hereby
finds that the Project is categorically exempt from the California
Environmental Quality Act ("CEQA") as provided in Section 15301,
Class 1, Existing Facilities, as the proposed modification will not
result in any significant environmental change to the Applicant's
existing structure or operation. The City Council of the City of
Vernon directs the Interim City Clerk, or the Interim City Clerk's
designee, to file a Notice of Exemption in compliance with the CEQA.
SECTION 4: The custodian of records for the Project and all
other material that constitute the record of proceedings upon which

the City Council's decision is based is the Interim City Clerk of the
City of Vernon. Those documents are available for public review in
the Office of the City Clerk located at 4305 Santa Fe Avenue, Vernon,
California 90058.
SECTION 5: A new CUP is hereby issued. Issuance of the CUP
is proper, as the City Council hereby makes the following findings, as
required by Section 26.6.3-4 of the Vernon Municipal Code:
a. The lot for the proposed use is adequate in size, shape
and topography, including any required drainage and
landscaping.
The lot has been utilized as a public storage facility
for over thirty years and will continue to be used for
the same purpose by the new owner. The lot for the
proposed use is adequate in size, shape, and topography
for a public storage facility because the owner has not
proposed any changes to the size, shape or topography
of the existing site.
b. The use permitted under the conditional use permit will
not adversely affect the interests of the public or the
interests of other residents and property owners within
the vicinity of the lot in question.
The lot has been utilized as a public storage facility
for over thirty years, and the issuance of the
conditional use input will not cause or allow any
material changes to the use or structure. Given that
the proposed use is a pre-existing public storage
facility, it will not adversely affect the interests of
the public or the interests of other residents and

property owners within the vicinity of the lot in
question.
C. The proposed use will be compatible with the permitted
uses of surrounding and adjacent properties.
The proposed project is a request to continue the
operation of an existing public storage operation. No
material changes to the use or structure is proposed.
The pre-existing public storage facility will in no way
negatively impact neighboring properties, because the
proposed site has been surrounded by commercial,
industrial and warehousing uses that are compatible
with the proposed use and will continue to be used for
the same purpose.
d. The lot has adequate off-street parking and loading
facilities for the proposed use.
The existing building at 4250 Alameda Street was
constructed prior to the city establishing any zoning
regulations or mandatory parking and loading
requirements. The lot contains adequate off-street
parking and loading facilities for the proposed use. No
structural alterations are proposed.
e. The use, as to location, operation and design, is
consistent with the general plan, any applicable
specific plan and the zoning regulations of the City of
Vernon, including the city's policy considerations as
to acceptable uses in the city.
The use, as to location, operation and design, is
consistent with the objectives of the Vernon Zoning

Code and General Plan. The proposed site is surrounded
by commercial, industrial and warehousing uses that are
compatible with the proposed operation. The existing
building was constructed prior to the city establishing
any zoning regulations. The legal non -conforming use
may be continued provided that it does not expand its
building footprint, the use changes to another non-
conforming use or the property is vacant in excess of
two years. Since the proposed use would not change with
the change of ownership, there would not be any
structural alterations to the property, and the revised
conditions would merely confirm existing law, the
ongoing use of the existing public storage facility
will in no way negatively impact neighboring
properties. As long as the applicant complies with
these terms, the conditional use permit will be
consistent with the objectives of the Comprehensive
Zoning Ordinance and the General Plan.
The use is consistent with all applicable county,
state, and federal laws, rules and regulations.
The proposed use is consistent with all applicable
local, County, State and Federal laws, rules and
regulations as conditioned below.
The proposed use will not adversely affect the general
welfare as a result of noise, increased traffic,
interference with the flow of traffic, dust, or other
undesirable characteristics.

The use is not changing with the change of ownership
and is not undertaking any structural alterations, the
level of service of the existing road system will not
be impacted. Additionally, various conditions are
imposed to ensure the project does not cause excess
noise or impede traffic flow. Therefore, the general
welfare of the community will not be adversely
impacted.
h. The conditions stated in the decision are deemed
necessary to protect the public health, safety and
general welfare.
The conditions imposed on the Project are necessary to
protect the public health, safety and general welfare.
SECTION 6: To adequately protect the public health and
general welfare, the new CUP shall be the same as Resolution No. 8176,
except as stated in this Section 6, Section 7 and 8. Section 2 of
Resolution 8176 is revised to provide:
"Subject to the conditions set forth below, the conditional use
permit is hereby granted for the operation of an existing Public
Self Storage mini -warehouse located at 4250 Alameda Street."
SECTION 7: To adequately protect the public health and
general welfare, conditions h and s of Section 3 of Resolution No.
8176 are revised to provide as follows:
"h. Any extension, expansion, or change in use shall
require a new conditional use permit."
NNs. Upon any expansion or structural alteration of the
building, the entire site shall be made to conform to

all applicable truck and automobile parking
requirements and all truck loading requirements."
SECTION 8: To adequately protect the public health and
general welfare, conditions t, u and v are hereby added to Section 3
of Resolution No. 8176 to provide as follows:
NNt. The Applicant and any successors in interest shall
indemnify, hold harmless and defend the City of Vernon,
its officers, agents and employees from and against any
and all claims, complaints or petitions for: (1)
damages, losses, expenses resulting from bodily injury,
sickness, disease, disability or death arising from the
operation of the facility excluding therefrom any such
claim resulting from the sole negligence or intentional
wrongdoing of the City, of Vernon, its officers, agents
or employees; (2) a peremptory writ or other relief by
way of injunction, mandamus, or administrative
mandamus; and/or (3) legal expenses and attorney's fees
incurred by the City of Vernon on behalf of any party
in such actions or proceedings. The City of Vernon
does not waive its right to participate in the defense
of any such action.
U. Not later than twenty (20) days from the date of
approval of this conditional use permit, the Applicant
shall indicate, in writing, its acceptance of and
agreement with the conditions herein. The conditional;
use permit shall be void and of no force or effect
unless such written acceptance and agreement is
submitted to the City within the twenty -day period.

V. Noncompliance with any of the conditions herein shall
constitute sufficient grounds for the City of Vernon to
void this conditional use permit, or take appropriate
enforcement action, including citation and or fines for
a violation."
SECTION 9: The provisions in Resolution No. 8176 not
consistent with or in conflict with this Resolution are hereby
repealed; in all other respects, Resolution No. 8176 shall remain in
full force and effect.
SECTION 10: The Interim City Clerk of the City of Vernon
shall certify to the passage, approval and adoption of this
resolution, and the City Clerk of the City of Vernon shall cause this
resolution and the City Clerk's certification to be entered in the
File of Resolutions of the Council of this City.

RECOMMENDATION
It is recommended that the City Council:
1) Find that approval of the Conditional Use Permit proposed in this staff report is categorically
exempt under the California Environmental Quality Act (CEQA) in accordance with Title 14,
Chapter 3, Class 1, Section 15301 because no physical changes will occur as a result of this
approval.
2) Adopt a resolution amending Resolution No. 8176 to thereby issue a new conditional use
permit to allow U.S. Storage Centers, Inc., to operate the existing self -storage facility, subject to
the conditions of approval for the property located at 4250 Alameda Street.
BACKGROUND
On April 2, 2003, via Resolution No. 8176, the City Council granted A -American Self Storage a
Conditional Use Permit ("CUP") to operate an existing public self -storage facility located at 4250
Alameda Street. U.S. Storage Centers, Inc. (hereinafter referred to as "the Applicant") has been
operating the facility for A -American Self Storage for well over a year. A -American Self Storage
has granted the Applicant the right to request the issuance of a new CUP for the property.
The Applicant is considering purchasing the property and business. The Applicant owns and
operates over sixty storage facilities nationwide. The Applicant is requesting that the CUP be
revised to make it clear that it can continue to operate a self -storage on the facility should it
acquire the property.
CONDITIONS
The Applicant is requesting that the following provisions of Resolution No. 8176 be amended to
confirm to existing law:
• Revise section 2 of Resolution No. 8176 as follows: "Section 2. Subject to the
conditions set forth below, the conditional use permit is hereby granted to ^ Afflefiean
Self Stefage for the operation of an existing Public Self Storage mini -warehouse
located at 4250 Alameda Street." The deletion of the words "to A -American Self
Storage" would simply reaffirm existing law that grants the right to use the property in
the specified manner, regardless of who uses the property in that manner. Stated
differently, the CUP would confirm that CUP rights run with the land.
• Revise Section 3, Condition "h", of Resolution No. 8176 as follows: "h. Any
extension, expansion, or change in use -;—change in awnefship—interest, and/of-tom
issuance of a new oeeu shall require a new conditional use permit." As a
result, a new CUP would not be required should the property be sold, or should the
occupant change. Consistent with existing law, if the existing use is intensified or
changed, a CUP will still be required.
• Revise Section 3, Condition "s", as follows: "s. Upon any expansion or structural
alteration of the building, or the advent of Augusft119,, 2009, rhiehever-oceurs f4st, the
entire site shall be made to conform to all applicable truck and automobile parking
requirements and all truck loading requirements, pur-suant to section 26.4.6 4(b) of the
Comprehensive Zoning Ofdinanee, unless a variance is granted by the Vernon City
Council." This change is appropriate because Section 26.4.6-4(b) is no longer part of
the code, and was not a part of the code on August 19, 2009, and therefore, the deleted
provisions would have been unenforceable in any event.
In sum, the only changes the Applicant is requesting are to "clean up" inconsistencies between the
existing permit, and existing law. As a result, no physical changes to the environment are
expected as a consequence of this approval.
Staff proposes to add three standard conditions that relate to the administrative process of issuing
the CUP itself. The additional conditions would be added as conditions t, u, and v:

V. Noncompliance with any of the conditions herein shall constitute sufficient
grounds for the City of Vernon to void this conditional use permit, or take appropriate
enforcement action, including citation and or fines for a violation.
VEHICLE MOVEMENTS
The property is currently used as a self -storage facility. The applicant proposes to continue to
operate the property as a self -storage facility in compliance with all other existing conditions of
the CUP.
Merchandise stored at this facility is delivered via lightweight trucks or passenger vehicles.
Vehicles entering the site from Alameda Street will continue to park either in the parking lot area
or at the loading dock area. Alameda Street is 40 feet wide and is of adequate size to handle the
traffic generated from the existing and proposed operation. Materials are to be loaded into the
vehicles or unloaded and taken to their assigned storage area. Once loading or unloading is
complete, the vehicles exit the site via Alameda Street. Approximately 20 tenant vehicles per day
access the site. Two employees will continue to operate the facility and their cars are also on site.
Thus, a total of 22 daily trips are projected for this site. The expected daily traffic can vary
significantly. However, a daily average of twenty (20) tenants accessing the respective units is
typical. Maintaining the existing minimal traffic volume will not cause a significant traffic impact
to neighboring properties or businesses, operations, or adjacent intersections.
ZONING AND GENERAL PLAN CONSISTENCY
The General Plan land use designation for the site is Industrial. It is also zoned industrial. The
facility is considered a public storage facility for zoning code purposes' and was originally issued a
conditional use permit on April 2, 2003. The zoning code since then been revised, and storage
facilities are no longer legally permitted uses, and the existing parking does not comply with
existing legal requirements. Under the city's zoning code, legal non -conforming uses may continue
only if the use conforms with Municipal Code Section 26.5.3 and table 26.5.3-3. The question
therefore arises whether the city may now issue a CUP for this property. It may.
Section 26.6.3-1 1 of the Zoning Ordinance confirms that: existing uses may continue:
"any conditional use permit granted pursuant to any zoning ordinance enacted prior to the
effective date of this ordinance shall be construed to be a conditional use permit under this
ordinance subject to all the conditions imposed in such conditional use permit, subject to the
terms of Section 26.5.3."

In this instance, the applicant has requested that the conditions of the existing CUP be revised in a
manner consistent with existing law. Absent the CUP, the conditions would already be legally
unenforceable. Stated differently, the issuance of the CUP will not change anything.
If, following a "change of use", there is a continued violation of any standard described in Section
26.4.1-6(b), then the use is not permitted. But because this is not a "change of use", and the
property complies, with the safety type requirements of 26.4.1-b(b), the use conforms to 26.5.3 and
26.5.3-3. Therel-ore, issuing a CUP in these circumstances is permissible.
Similarly, Section 26.5.3-1 prohibits (a) an increase in floor area of a legal non -conforming use,
(b) the conversion of a building containing a conforming use to a non -conforming use, (c) a non-
conforming use to a non -conforming use, (d) a decrease in the parking, loading or maneuvering
capacities. All of these requirements are met. No structures are being constructed nor is any
building square footage being added. The use is not changing. Admittedly, in this instance the
property does not fully conform with the City's automobile parking, truck parking and loading
requirements, but issuance of the CUP will not violate 26.5.3-1(d) because it does not decrease the
parking, loading or maneuvering capacities it merely keeps them the same, and the use may
therefore continue.
In short, the legal non -conforming use and building may continue and the issuance of a new
conditional use permit for a public storage facility is permissible and is consistent with the
objectives of the Comprehensive Zoning Ordinance and the General Plan.
CEQA ANALYSIS
The issuance of the CUP is categorically exempt from the California Environmental Quality Act
pursuant to CEQA Guidelines section 15301, because it's an existing structure involving
negligible or no expansion of use beyond that existing at the time of the lead agency's
determination. Furthermore, the proposed site is surrounded by commercial, industrial and
warehousing uses that are compatible with the proposed use. No potentially significant impacts
are expected to result from noise, odor, dust, smoke, light or glare from the project. Last, and
most importantly, the use is already authorized, and the issuance of the new CUP will not have
any change from the status quo, and therefore will not have any effect on the environment.
A Notice of Exemption will be prepared and filed with the County Clerk.
STATE OR FEDERAL CONDITIONS
All Federal, State, and local regulatory permits shall be obtained as required for the operation.
STAFF FINDINGS
A conditional use permit shall only be granted if the following findings as required by Section 26.6.3-
4 of the Vernon Zoning Code can be made. Staff concludes that the following findings can be made,
and recommends that they be made in the following mariner:
a. The lot for the proposed use is adequate in size, shape and topography, including any
required drainage and landscaping;
The lot has been utilized as a public storage facility for over thirty years and will continue to be
used for the same purpose by the new owner. The lot for the proposed use is adequate in size,
shape, and topography for a public storage facility because the owner has not proposed any
changes to the size, shape or topography of the existing site.
b. The use permitted under the conditional use permit will not adversely affect the interests
of the public or the interests of other residents and property owners within the vicinity of the lot
in question, -
The lot has been utilized as a public storage facility for over thirty years, and the issuance of the
conditional use input will not cause or allow any material changes to the use or structure. Given
that the proposed use is a pre-existing public storage facility, it will not adversely affect the
interests of the public or the interests of other residents and property owners within the vicinity
of the lot in question.
C. The proposed use will be compatible with the permitted uses of surrounding and adjacent
properties, -
The proposed project is a request to continue the operation of an existing public storage
operation. No material changes to the use or structure is proposed. The pre-existing public
storage facility will in no way negatively impact neighboring properties, because the proposed
site has been surrounded by commercial, industrial and warehousing uses that are compatible
with the proposed use and will continue to be used for the same purpose.

WHEREAS, A -American Self Storage has applied for a
conditional use permit to operate an existing self storage
facility located at 4250 Alameda Street: in the City of Vernon;
and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a conditional use permit on
April 2, 2003; and
WHEREAS, A -American Self Storage's pattern of
operation will remain predominantly the same as that of the
previous occupant and is not proposing any structural
alterations or modifications to the existing building; and
WHEREAS, the proposed site size is approximately 0.81
of an acre and is adequate in size, shape, topography, including
drainage and landscaping; and
WHEREAS, the proposed site is surrounded by industrial
distribution type uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, smoke, light
or glare, or risk of fire, infection, explosion or effects on
wildlife resources are anticipated from the proposed operation;
and
WHEREAS, the proposed site is a conforming use in the
General Industrial (M) Zone, which requires a conditional use
permit under the Comprehensive Zoning Ordinance; and

WHEREAS, the site presently does not comply with the
current parking and loading requirements, but is not required to
bring it into conformity at this time, because no structural
alteration is occurring; and
WHEREAS, the proposed use as to location, operation,
and design is consistent with the General Plan and the Zoning
Ordinance of the City of Vernon; and
WHEREAS, the conditions imposed on the conditional use
permit will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the site has access to Alameda Street and
Vernon Avenue, and the streets have adequate capacity and
pavement type for the proposed operation; and
WHEREAS, Pursuant to Section 15301 of the California
Environmental Quality Act ("CEQA"), this project is exempt from
CEQA, because it is an existing structure.
WHEREAS, the City Council has received a Staff Report
dated March 26, 2003 upon which it has relied on making the
foregoing recitals; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein
above are true and correct.

SECTION 2: Subject to the conditions set forth below,
the conditional use permit is hereby granted to A -American Self
Storage for the operation of an existing Public Self Storage
mini -warehouse located at 4250 Alameda Street.
SECTION 3: In order to adequately protect public
health and general welfare the following conditions are
required:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, and regulations
and subject to permit fees and taxes as adopted by the City of
Vernon not otherwise addressed by this grant of a conditional
use permit.
b. All parking and loading facilities shall be paved with
a hard durable surface material and shall be adequately
drained, and kept free of dust, mud, trash weeds. Where
parking or maneuvering areas adjoin the public street, a
barrier wall or landscaping shall be installed and maintained
to meet City standards. Adequate on -site parking shall be
maintained so that off-street parking will not occur.
C. All required federal, state, local and regulatory
agency permits shall be obtained prior to operation. Prior to
occupancy, a business license and occupancy permit shall be
obtained.
d. The facility shall be operated in a manner that will
not impede traffic on Alameda Street.

e. All required frontage improvements shall be
constructed and all existing cracked sidewalk, curb and gutter
adjacent to the site on Alameda Street shall be repaired and
maintained to meet City Standards.
f. The project site shall be maintained substantially in
compliance with the site plans submitted as part of this
conditional use permit application.
g. Adequate trash receptacles shall be provided on site
to keep litter to a minimum. A collection service shall be by
a City of Vernon Franchised Solid Waste Hauler. Trash area
shall be maintained in effort to divert rainfall around
enclosure. All litter blown or dropped on adjacent properties
shall be retrieved and disposed of on a daily basis by A -
American Self Storage or an employee of the building located
at 4250 Alameda Street.
h. Any extension, expansion, change in use, change in
ownership interest, and/or the issuance of a new occupancy
permit shall require a new conditional use permit.
i. The parking, driveway access and landscaping shall be
maintained in accordance with the site plan, which was
submitted with this application. No changes shall be made in
the site development except with the prior approval of the
Director of Community Services & Water.
j. The building shall be maintained so as to prevent the
entrance of rodents.
k. No hazardous materials, including without limitation,
explosives, corrosives, ammunition, flammable liquids,
solvents, gasoline, chemicals or combustibles, or compressed

gasses may be stored in the storage units, nor may any tenant
engage in any spray painting or sanding in the storage
facility.
1. A -American Self Storage shall post signs on each floor
that read "No Hazardous Materials Permitted" and "No Food
Storage is Permitted".
M. All storage units shall be equipped with landlord's
lock.
n. The landlord shall keep at all times a master list of
tenants and access to the units shall be granted only to the
tenant or his agent when a signature of one so authorized is
on file.
o. All leases submitted by the public storage facility to
the tenants shall include the requirement for periodic safety
inspections by the City of Vernon.
p. A landlord's representative shall be on the premises
at all times during normal business hours and a list of all
persons entering the building shall be maintained and made
available to the City of Vernon inspectors.
q. Whenever a public storage facility is discontinued for
a period of two hundred seventy (270) days or not maintained
in a suitable condition, the permit may be voided.
r. All other police, fire, health and community services
department requirements not listed herein shall be complied
with.
S. Upon any expansion or structural alteration of the
building, or the advent of August 19, 2009, whichever occurs
first, the entire site shall be made to conform to all truck

and automobile parking requirements and all truck loading
requirements, pursuant to section 26.4.E-4(b) of the
Comprehensive Zoning Ordinance, unless a variance is granted
by the Vernon City Council.
SECTION 4: Noncompliance with the conditions set forth
in the conditional use permit shall be grounds for voiding the
permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning
Ordinance.
SECTION 5: A -American Self Storage and any successors
in interest shall indemnify, hold harmless, and defend the City
of Vernon, its officers, agents, and employees from and against
any and all claims, complaints, or petitions for: (1) damages,
losses, expanses resulting from bodily :injury, sickness,
disease, disability or death arising from the operation of the
facility excluding therefrom any such claim resulting from the
gross negligence or intentional wrongdoing of the City of
Vernon, its officers, agents or employees; (2) a peremptory writ
or other relief by way of injunction, mandamus, or
administrative mandamus; or (3) legal expenses and attorney's
fees incurred by the City of Vernon on behalf of any party in
such actions or proceedings. The City of Vernon does not waive
its right to Participate in the defense of any such action

The City of Vernon is in receipt of your letter regarding the A -American Self Storage Company located at
4250 Alameda Street in the City of Vernon. In this letter you have requested that I administratively correct the
following sections of City Resolution No. 8176:
Remove the reference to A -American Self Storage as the, CUP should run with the property and use.
Section 3, h.: mnovC the i-egUirenient that states a ": hange in ownership interest, and/or the issuance of a
new occupancy permit shall require a new conditional use permit."
Section 3, s.: remove the requirement for the use to conform to section 26.4.6-4(b), truck loading ordinance
as this ordinance has been rescinded by the City.
Unfortunately I do not have the authority to administratively amend a City resolution. The only body that
has the authority to amend a resolution is the City Council. I lowever, I can hereby advise you that the City will
not enforce either provision h or s of section 3 of the resolution. As you have mentioned section 26.4.E-4(b) of
the 1. liy �Uu:� oCCll uuta
use permit, this section is contrary to State law and therefore is not enforceable by the City.
If U.S. Storage must have these sections of the resolution amended, then the only recourse is to
rile for a modification of the Conditional Use Permit by submitting a new application with the City. The City
will be required to proceed though its normal cotu-se of action in approving the modification to the Conditional
Use Permit includin' a public hearing on the matter.

This facility is an existing self -storage facility that has been in operation for over thirty years.
The structure was converted from an existing five story industrial building of an obsolete type,
which is no longer efficient for use as a regular warehouse or manufacturing space.
This facility stores only personal property. The standard rental agreement specifically prohibits
storage of hazardous materials, foodstuffs, animals (living or dead), or items of total value
exceeding $5,000.00. It further prohibits use of space: for residential or manufacturing purposes
as well as any illegal activity.
The employees on site, control access to the facility, "lease the units, take care of regular building
maintenance, and ensure compliance with the lease agreements. Owner, owner's agents or
representatives of governmental authority have the right to enter and inspect at any time if he
believes any nuisance or hazardous condition is occurring.
TRAFFIC REPORT

This facility is an existing self storage facility that has been in operation for over thirty years.
The structure was converted from an obsolete five story industrial building.
Goods stored at this facility are predominately delivered by light truck or passenger vehicle.
Occasionally, larger moving -van vehicles may be used. Vehicles enter the site from Alameda
Street and park either in the parking lot or at the loading dock. Materials are then taken into the
structure or removed from the structure and hand loaded into the vehicles. Once loading or
unloading is complete the vehicles exit the site via Alameda Street.
Approximately twenty tenant vehicles per day access the facility. One to three employees may
operate the facility and their cars are also on site. Generally, the employees park in the rear of
the building. This gives a total generation of 26 daily trips.
Arrival and departure times for the tenants vary considerably over the daily operating hours, with
the busiest day being Saturday.
Due to the nature of the facility, the daily traffic can vary significantly; however, a daily average
of 20 tenants accessing their unit would be typical. Self storage is considered one of the lowest
traffic generating commercial uses.
