Resolution No. 2013-081RESOLUTION NO. 2013-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN GREENING PLANNING GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY; FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) WHEREAS, the City of Vernon (the "City"), is a municipal corporation and a chartered city of the State of California organized and existing under its Charter and the Constitution of the State of California; and WHEREAS, the Legislature and Governor of the State of California have provided funds for the Urban Greening Planning Grant Program under the Safe Drinking Water, Water Quality and Supply, Flood Control,: River and Coastal Protection Bond Act of 2006 (Proposition 84) ; and WHEREAS, the Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the City Council of the City before submission of said application(s) to the State; and WHEREAS, the City of Vernon, if selected, will enter into an agreement with the State of California to carry out development of the Urban Greening Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1 The City Council of the City of Vernon hereby 0925131049 finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is not a "project" within the meaning of the California Environmental Quality Act (CEQA) because the submission of an application to the state to request funding is an administrative activity that will not result in direct or indirect physical changes in the environment, and even if it were a "project", it would be exempt under section 15061(b)(3) the general rule that CEQA only applies to projects that may have an effect on the environment because it remains speculative what the urban greening plan may or may not contain and therefore cannot have an effect on the environment. SECTION 3: The City Council of the City of Vernon hereby approves the filing of an application for the development of the City of Vernon Urban Greening Plan pursuant to the Grant Program under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) SECTION 4: The City Council of the City of Vernon hereby certifies that the City of Vernon understands the assurances and certification in the application. SECTION 5: The City Council of the City of Vernon hereby certifies that the City of Vernon will have sufficient funds to develop the plan; or will secure the resources to do so. SECTION 6: The City Council of the City of Vernon hereby certifies that the.City of Vernon will work towards the Governor's State.Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1. - 2 - 0925131049 SECTION 7: The City Council of the City. of Vernon hereby appoints the City Administrator, or the City Administrator's designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the development of the aforementioned plan. SECTION 6: The Interim City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the Interim City Clerk, or Deputy.City Clerk, of the City of Vernon shall cause this resolution and the Interim City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator RE: A Resolution approving the application for Grant Funds for the Urban Greening Planning Grant Program under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) Recommendation It is recommended that the City Council: 1) Find that the approval and submittal of a 2013 urban greening sustainable communities planning grant application is not a "project" within the meaning of the California Environmental Quality Act (CEQA) because the submission of an application to the state to request funding is an administrative activity that will not result in direct or indirect physical changes in the environment, and even if it were a "project", it would be exempt under section 15061(b)(3) the general rule that CEQA only applies to projects that may have an effect on the environment because it remains speculative what the urban greening plan may or may not contain and therefore cannot have an effect on the environment. 2) Approve a resolution to authorize staff to submit a 2013 Urban Greening Sustainable Communities planning grant application to the State of California Strategic Growth Council. Back round On November 7, 2006, California voters passed the "Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006" (Proposition 84) which authorized the Legislature to appropriate up to $17.5 million to create urban greening plans to create healthy communities. In an ongoing effort to promote the sustainability and livability of the community, City staff has identified the need to develop a Master Urban Greening Plan (the "Greening Plan"). The Greening Plan would: 1) Serve as the master document guiding and coordinating greening projects in the City. 2) Comply with all applicable laws and regulations, including the California Environmental Quality Act (CEQA). 3) Include projects that reduce greenhouse gas emissions consistent with California Global Warming Solutions Act of 2006. 4) Comply with the state's planning priorities identified in Government Code Section 65041.1 including: a. Investing in the community. b. Protecting, preserving and natural resources. c. Encouraging location and resource efficient new developments. With the assistance of California Consulting, staff believes the Urban Greening Planning Grant Program would fund the development of a Master Urban Greening Plan. To qualify for grant funding the application must: 1) Demonstrate the need for the development of an urban greening plan specify objectives to meet the need. 2) Demonstrate how the community will be involved and participate in the development and coordination of urban greening plans. 3) Demonstrate how entities with jurisdiction over the plan service area and existing resources will be integrated in the development of the urban greening plan. 4) Demonstrate how the greening plan will promote public health and development of a healthy community. Fiscal Impact Maximum amount that could be awarded is $250,000.
