A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON DESIGNATING DECEMBER 23, 24, 26, AND 31,
2013, AS ADDITIONAL CITY HOLIDAYS FOR 2013 ONLY,
AND DIRECTING CLOSURE OF THE PUBLIC OFFICES OF THE
CITY OF VERNON ON THESE DAYS
WHEREAS, the City Council of the City of Vernon ("City
Council"), adopted Resolution No. 9542, on February 4, 2008, which,
in pertinent part, established holidays for the City of Vernon
("City"), and directed closure of the public offices of the City on
those days ("City Holidays"); and
WHEREAS, pursuant to Resolution No. 9542, the City Council
may designate additional days as City Holidays; and
WHEREAS, the City Council desires to designate Monday,
December 23, 2013, Tuesday, December 24, 2013, Thursday, December 26,
2013, and Tuesday, December 31, 2013, as additional City Holidays for
2013 only; and
WHEREAS, the City Council desires to provide 40 hours of
in -lieu holiday time to representative employees in accordance with
their respective memoranda of understanding and Schedule F of
Resolution No. 9542; and
WHEREAS, designating additional City Holidays will foster
employee morale and appreciation; and
WHEREAS, the potential indirect costs of additional time off
will be partially offset by reduced consultant and utilities costs;

WHEREAS, the addition of holidays will have only a minor
impact on public and business assistance due to the historically low
amount of phone and customer service traffic during this time period;

WHEREAS, for all of the above reasons, this action serves a
municipal and public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon hereby
finds that the California Environmental Quality Act (CEQA) does not
apply to approval of the proposed resolution authorizing the
designation of additional City Holidays for 2013 because CEQA does not
apply to personnel -related actions and administrative activities, as
described by CEQA Guidelines Section 15378(b)(2) and (5). Further,
even if CEQA did apply, approval of the proposed resolution is exempt
from CEQA in accordance with Section 15061(b)(3), the general rule
that CEQA only applies to projects that may have an effect on the
environment.
SECTION 3: The. City Council hereby designates Monday,
December 23, 2013, Tuesday, December 24, 2013, Thursday, December 26,
2013, and Tuesday, December 31, 2013, as additional holidays for the
City for 2013 only and directs that the public offices of the City
shall be closed on these days. Certain employees shall receive an
additional 40 hours of in lieu holiday time in accordance with their
respective memoranda of understanding and Schedule F of Resolution
No. 9542.
SECTION 4: The City Council of the City of Vernon hereby
instructs the City Administrator, or his designee, to take whatever
actions are deemed necessary or desirable for the purpose of

implementing and carrying out the purposes of this Resolution.
SECTION 5: The Interim City Clerk, or Deputy City Clerk, of
the City of Vernon shall certify to the passage, approval and adoption
of this resolution, and the Interim City Clerk, or Deputy City Clerk,
of the City of Vernon shall cause this resolution and the Interim City
Clerk's, or Deputy City Clerk's, certification to be entered in the
File of Resolutions of the Council of this City.

Recommendations
It is recommended that the City Council:
1) Find that the California Environmental Quality Act (CEQA) does not apply to approval
of the proposed resolution authorizing the closure of public offices of the City of Vernon
on December 23, 24, 26, 31, 2013 because CEQA does not apply to personnel -related
actions and administrative activities, as described by CEQA Guidelines Section
15378(b)(2) and (5). Further, even if CEQA did apply, approval of the proposed
resolution is exempt in accordance with Section 15061(b)(3), the general rule that CEQA
only applies to projects that may have an effect on the environment.
2) Adopt the attached resolution designating December 23, 24, 26, and 31, 2013 as
additional City Holidays for 2013 only, and approving the closure of the public offices of
the City of Vernon on said days.
3) Authorize the addition of 40 hours of in -lieu holiday time for representative employees in
accordance with the 2012-2014 Police Officers Association Memorandum of
Understanding, 2013-2014 Police Management Association Memorandum of
Understanding and Department In Lieu Holiday Schedule ' F" of Resolution No. 9542.
Background
With the holiday season fast upon us, staff has had discussions regarding the holiday schedule
for the Christmas and New Year's Holidays. This year's holiday season falls within the middle
of the work week thereby contributing to decreased productivity over the holidays in comparison
to previous years when the holiday fell at the beginning or end of the work week. Employees
would have to work only one day before the Christmas holiday and return for one day after the
Christmas holiday. Consequently there will be a decrease in the amount of staff working these
days, as several employees have already requested the time off. There is very little non -
emergency business brought to Vernon traditionally during the holiday season, so closing non -
emergency services (City Hall) should not have a significant impact on the business and
residential communities. However, emergency services and Light & Power staff, whose services
are critical year-round, will remain properly staffed to ensure availability for any issue that may
require immediate attention. Department heads would be available through the City
Administrator as needed.
During the past five years, there have been no salary increases for the majority of Vernon
miscellaneous employees, and these additional holidays can be viewed as an act of employee
appreciation, and an opportunity to increase morale of employees who have continued to provide
dedication and hard work through difficult times, at no out-of-pocket cost to the City. While
there is a potential indirect cost associated with in -lieu holiday time that certain employees will
receive as a result of the proposed closure, any such costs will be offset, at least in part, by
decreased consultant and utilities costs during the closure. Staff is therefore respectfully
requesting closure of City Hall the week of December 23, 2013 through December 26, 2013 in
order to enable employees to spend time enjoying the holiday season with family. If the closure
is approved, there would be sufficient time to post notice of the closure on the City's website, as
well as on City Hall facilities.
The City has fulfilled its obligations to the extent required under the Myers-Milias Brown Act
(MMBA) and/or any respective MOUs as it relates to the proposed action(s) in this staff report.
Fiscal Impact
There is a potential indirect cost at a maximum of approximately $96,000 to provide 40 hours of
in -lieu holiday time to representative employees in accordance with their respective memoranda
of understanding and Department In Lieu Holiday Schedule "F" of Resolution No. 9542. The
potential indirect cost will be offset, at least in part, by decreased consultant and utilities costs
during the closure.
