RESOLUTION NO. 2014-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING THE CONFLICT OF INTEREST CODE FOR THE CITY OF VERNON THAT INCORPORATES BY REFERENCE THE STANDARD MODEL CONFLICT OF INTEREST CODE OF THE FAIR POLITICAL PRACTICES COMMISSION WHEREAS, the Political Reform Act (Government Code Sections 81000, et seq.), requires state and local government agencies to adopt and promulgate conflict of interest codes for each department of the City; and WHEREAS, the Fair Political Practices Commission (the "FPPC"), has adopted a regulation (2 Cal. Code of Regulations Section 18730), that contains the terms of a standard conflict of interest code and may be incorporated by reference as the City's code; and WHEREAS, the standard conflict of interest code may be amended by the FPPC after public notice and hearing to conform to amendments in the Political Reform Act; and WHEREAS, Section 4.5 of the Charter of the City of Vernon provides that regulations pertaining to any subject or model codes may be adopted by reference, in their original form or with amendments; and WHEREAS, on November 20, 2012, the City Council of the City of Vernon adopted Resolution No. 2012-225, adopting by reference the terms of 2 Cal. Code of Regulations Section 18730; and WHEREAS, in accordance with Government Code Sections 87306 and 87306.5, the Conflict of Interest Code has been reviewed; and WHEREAS, the City Council of the City of Vernon desires to add the positions of "Senior Human Resources Analyst", "Resource Planner", and "Electrical Engineer" to the City's Conflict of Interest - 1 - Code to require such employees to report financial interests under designated disclosure categories, and to update the disclosure requirements for the position of "Resource Scheduler"; and WHEREAS, the City wishes to clarify that, consistent with the requirements of Government Code 87302, and the recommendations of the Fair Political Practices Commission, individuals holding designated positions are required to disclose their economic interests solely to the extent that their economic interests "may foreseeably be affected materially by any decision made or participated in by the designated employee by virtue of his or her position." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council.of.the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon hereby adopts, by reference, the terms of 2 Cal. Code of Regulations Section 18730, and any amendments to it duly adopted by the FPPC. That Regulation, along with Appendix No. 1, designating positions and establishing disclosure requirements, which is attached hereto and incorporated by reference, shall constitute the Conflict of Interest Code of the City of Vernon. SECTION 3: The following positions are not covered by this Conflict of Interest Code because individuals holding these positions must file under Government Code Section 87200, and, therefore, are listed for informational purposes only: mayor, city administrator, city attorney, city treasurer, chief administrative officer, city council members, and other public officials who manage public investments. Individuals holding the above -listed positions may - 2 - contact the FPPC for assistance or written advice regarding their filing obligations if they believe that .their position has been categorized incorrectly. The FPPC makes the final determination whether a position is covered by Government Code Section 87200. SECTION 4: The City Council of the City of Vernon hereby delegates the authority to carry out the duties of filing officer to the City Clerk, or Deputy City Clerk,.and.individuals holding designated positions shall file their statements with the City Clerk's Office, who will retain the statements and make the statements available for public inspection and reproduction pursuant to Government Code Section 81008. SECTION 5: The City Council of the City of Vernon hereby repeals all resolutions or parts of resolutions in conflict herewith. 3 - SECTION 6: The City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City. RE: Approve Resolution Amending the City of Vernon Conflict of Interest Code to Include Three Newly Identified Filers and to Update Disclosure Requirements Recommendation It is recommended that the City Council: Find that the approval of the resolution amending the Conflict of Interest Code is exempt under the California Environmental Quality Act ("CEQA") in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and 2. Approve the resolution amending the Conflict of Interest Code to require three newly identified staff positions to file "Statement of Economic Interest" Forms (known as the "Form 700"), and update certain disclosure requirements. 3. Authorize staff to file all necessary and reasonable related documentation, including the "Agency Report of New Positions" (known as "Form 804"). Backeround The Political Reform Act requires the City to adopt and update its Conflict of Interest Code ("Code"). The Code must enumerate the positions within the City "which involve the making or participation in the making of decisions which may foreseeably have a material effect on any financial interest of that position." The Code must also specify the categories of financial disclosure that are required for each designated position. Each individual holding a position listed within the Code must file a "Statement of Economic Interest" (the "Form 700") and disclose their financial interests in the specified categories. As part of the City's Good Governance Reform efforts and in compliance with the required biennial review, on November 20, 2012 the City Council adopted Resolution No. 2012-225 to update its Code. Since then, the City filled three positions that are not listed within the Code. The City hired a Sr. Human Resources Analyst on September 30, 2013, a Resource Planner on December 3, 2013 and an Electrical Engineer on January 14, 2014. Staff recommends that the Code be updated to require individuals holding such positions to meet specified disclosure requirements. Staff also recommends a slight increase to the disclosure requirements for the position of Resource Scheduler to better align with the duties of that position. The proposed Resolution to amend the Code also adds language to clarify that the city does not require more disclosure than is authorized by law. The attached Form 804's capture the new positions being requested, the disclosure categories and the job descriptions. DEFINITION: Under general supervision, to perform professional electrical engineering work in the design investigation and construction of public utility system and capital improvement projects; including SCADA, RTU and related substation power -supply and support facilities; to plan and participate in the operation, maintenance and repair of the system; the work will be related to the various activities associated with substations, protective relay system, fiber optics, communication systems, and other related systems. SUPERVISION RECEIVED AND EXERCISED: The Electrical Engineer will report directly to the Engineering Manager. May receive guidance from Senior Electrical Engineer. EXAMPLES OF DUTIES: Duties may include, but are not limited to the following: Perform semi -complex professional engineering work with limited supervision; Provide electrical background information and documentation for management consideration on various projects; Perform administrative and field supervisory work necessary to wordinate the development, installation and maintenance of electric department's substation, generation, communications, relay and control equipment; Perform studies of technical and economic feasibility and related studies pertaining to proposed and existing system facilities; Participate in the conduct of multiple complex electric utility Capital Improvement Projects including preparation of detailed plans, construction drawings, cost estimates, construction schedules, material lists, specifications and bid contract documents; Participate in development and implementation of all data -base modifications in computer directed control, systems for station equipment additions, modifications and/or deletions for current system operation; Assist in analysis and remedy of major equipment failures, station service interruptions, and safety problems; Interface on a regular basis with Engineering, Transmission & Distribution and Substation divisions of the Light & Power Department to assist in the development and implementation of goals, objectives, policies and priorities; Perform short circuit studies; drafting work and prepare records and reports; Perform other related duties as requited. OUALIFICATIONS: Knowledge ofi General principles and practices of electrical engineering, and data processing, including electrical circuits, AC/DC electrical power supplies and supervisory controls. Single phase and balanced three phase circuits, motors, transformers, generators, per -unit calculations, system capacitance, series impedance, voltage and current relations in a electrical system, system stability, fault conditions using symmetrical components, load Row studies and system protection. Modem methods and techniques used in maintaining and operating a wide variety of substation and central control systems, protective relay systems, SCADA systems and communication equipment. Application, analysis, maintenance and documentation of modern microprocessor based protective relay systems, including SEL products.. Ability to: Communicate effectively with a variety of personnel and establish/maintain effective working relationships; Understand technical graphs, charts, engineering records and maps; Draft and prepare maps and graphs; Read wiring diagrams and prepare accurate reports; Operate the SCADA system, know AutoCAD, Power System analysis programs such as power system load Flow, ETAP, WINDMILL and working knowledge of ESRI Are GIS; Administer construction contracts and write technical reports. Experience snit Education: A Bachelor's degree from an accredited college or university with a major course work in Electrical Engineering and a minimum of five years of Electrical Engineering experience involving substation planning, design and concoction; power system protection and substation automation. Engineering experience must include a minimum of three years in a public or private electric utility. License or Certificate: Must obtain Engineer -in -Training (EM Certificate within one (1) year from date of hire into this position. Registration in California as a Professional Engineer is highly desirable. Must possess a valid CA Driver's License.
