Resolution No. 2014-003RESOLUTION NO. 2014-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A GRANT APPLICATION UNDER THE CALIFORNIA USED OIL COMPETITIVE GRANT PROGRAM TO THE CALIFORNIA DEPARTMENT OF RECYCLING RESOURCES AND RECOVERY (CALRECYCLE) WHEREAS, Public Resources Code sections 40000 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle), to administer various Grant Programs in furtherance of the State of California's efforts to reduce, recycle and reuse solid waste generated in the state thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, the State of California has enacted the California Used Oil Competitive Grant Program that provides funds to cities and counties for public education and outreach to inform the public of local used oil and filter recycling opportunities and ways to prevent stormwater pollution caused by used oil; and WHEREAS, CalRecycle has been delegated the responsibility for the administration of the program within the State and setting up necessary procedures for cities and coup�ies or their designee under the program; and WHEREAS, CalRecycle has announced that funding in grant funds for fiscal year 2013-2014 are available in a competitive application; and WHEREAS, eligible participants must submit an Application Certification by a certain due date in order to request funds from CalRecycle; and WHEREAS, on or about January 28, 2014, Director of Health & Environmental Control submitted an application for ninety thousand, seven hundred, eighty dollars and no cents ($90,780.00) in grant funds for fiscal year 2013-2014 to fund activities that would expand the City's Used Oil/Filter Collection Program; and WHEREAS, by memo dated February 18, 2014, the Director of Health & Environmental Control recommends that the application for the Used Oil Competitive Grant funds be approved and executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. SECTION 3: The City Council of the City of Vernon hereby approves and authorizes the submittal of the "Application Certification" ("Application"), in substantially the same form as the copy which is attached hereto as Exhibit A, to the California Department of Recycling Resources and Recovery for all grant funds available under the California Used Oil Competitive Grant Program for the period governing the grant program. The Director of Health & Environmental Control, or his designee, may electronically execute said Application for, and on behalf of, the City of Vernon. SECTION 4: The Director of Health & Environmental Control, or his designee, is hereby authorized and empowered to execute in the name of the City of Vernon all grant documents, including but not - 2 - limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project. BACKGROUND: Recently, the Department of Resources Recycling and Recovery announced, pursuant to Section 40000 of the Public Resources Code, that it was offering funding for the Used Oil Competitive Grant Program (OUC) for Fiscal Year 2013-2014. Grant guidelines allow funds to be spent through the end of Fiscal Year 2013-2014. Staff submitted an application to the California Department of Resources Recycling and Recovery (CalRecycle) for a grant to fund activities that would expand the City's Used Oil/Filter Collection Program. If awarded, grant funds would be used to educate and provide outreach to local independent owner/operator truckers that work in the community. The goal would be to identify and provide the "do-it-yourself' owner/operator truckers operating in the City with used motor oil and filter recycling information, and to provide them with short term (temporary collection events) and long term (existing local collection sites) resources for the safe disposal of the used motor oil and filters removed from their commercial semi -tractors. Because abandoned used oil and filters are an ongoing problem in Vernon and neighboring communities, staff further proposes to use the funds to develop and distribute public information items and purchase products promoting used oil/filter recycling. The public information efforts would be similar to those successfully used in the Used Oil Recycling Program over the past several years with the students at the Vernon Elementary School. Attached is the completed application and a narrative proposal, which was submitted electronically by the deadline of January 28, 2014. CalRecycle requires the City Council to authorize the grant application by February 20, 2014. Upon CalRecycle approving and funding the grant, staff would use KJ Services for implementing the grant activities. KJ Services has been our consultant on this grant for the past 13 years and continues to provide an excellent service. FISCAL IMPACT: No negative fiscal impact is expected by approving this request. The grant funds will benefit the City by reducing the amount of City funds needed to conduct recycling and litter/cleanup education programs. To identify small, independent Owner/Operator truckers that work in the Vernon community, develop targeted outreach to these truckers, hold a series of 6 oil/filter collection events that give them an opportunity to dispose of any used motor oil & filters they may have stored, and connect these specialized DIY'ers with the existing collection resources they can use in the future. To identify the local independent truckers, the City will survey the truck traffic entering & exiting selected locations in the City. Trucker's CA reg numbers will also be researched. Educational outreach will be to the 0/0 truckers working in the City of Vernon or that are based in the adjoining communities which were identified in the survey. Educational outreach efforts will be bilingual and will include a program brochure, the distribution of program materials (oil and filter collection event flyers, used oil promotional items, and brochures), DIYer trucker ads placed in selected LA market trucker magazines (Caltrux, California. Transportation News, Transporte Latino, Truck Trader, and PennySaver magazines), and participation at trucker events ("Trucking for Kids" charitable fundrasing truck show, American Truck Historical Society events, Land"Fiesta de Camioneros Truck Show Latino"). Used Oil Competive Grant Program, UOC1 (FY 2013/14) The City will host six (6) used oil & filter collection events targeted to DIYer O/O truckers. Each event will be held for four (4) hours at various locations around the City (truck stop or other business). III. NEED AND EXPERIENCE(2'-points) Explain rationale for this proposed project as compared to other approaches for meeting the identified need and barriers. If there is an existing effort/system, describe how the project will improve what is currently in place. Commercial trucks move cargo in and out of the City of Vernon 24-hours a day, 7 days a week. There has been a substantial increase in independent Owner/Operator (O/O) truckers as well as small 2-3 truck firms operating in Los Angeles Co. and particularly in the City of Vernon because of the concentration of industry in the City. As the cost to operate their vehicles goes up, truckers try to reduce their expenses by performing some of their own vehicle maintenance. This includes performing their own oil changes. However, unlike the typical automotive oil change, which involves 4 to 8 quarts of oil, a commercial diesel semi truck tractor uses 10 to 14 gallons of engine oil. The impact of an improperly disposed of oil change from a commercial semi is much greater than that from a typical car. In the same manner, semi trucks that use replaceable oil filters use a filter that is about 10 times larger than a typical car oil filter. An owner/operator trucker who is also a "shade -tree mechanic" working on one or two semi tractors is generating the same amount of waste oil as a dozen or more automotive oil changes. In addition many of the small independent truckers that work in the Vernon area are recent immigrants, primarily though not exclusively Hispanic, many of whom are unaware of the impacts of the improper disposal of motor oil nor are they aware of the existing collection resources for used motor oil and filters. Poorly maintained trucks also drip large amounts of oil. Used Oil Competive Grant Program, UOC1 (FY 2013/14) Project Personnel: Briefly identify all people who will be involved in the project and their roles. For key personnel, describe their technical expertise and related project management experiences. The City of Vernon is experienced with implementing the type of project outlined in the proposal. The City's contact for this project is Leonard Grossberg, the City Health Director. The City of Vernon Health & Environmental Control Department's mission is to preserve and enhance the quality of life in the City of Vernon by implementing comprehensive and efficient environmental and public health program services that protect the health and safety of Vernon's residents, workers, and visitors; the neighboring communities; and the environment. The City's project consultant, Kevin Sales of KJServices Environmental Consulting is experienced with managing CalReycle projects with a focus on the used oil program. KJServices Environmental Consulting -Founded in 1997, KJServices is a full service consulting firm, specializing in recycling program design and implementation, community education and outreach, and State compliance and reporting issues, meeting the needs of city and private industry clients. KJServices provides comprehensive, real world solutions to recycling and environmental challenges faced by both public and private organizations. Kevin J. Sales is a recycling and waste reduction professional specializing in planning and development of effective reycling and waste reduction and educational programs. Mr. Sales works on many used oil programs including OPP programs and competitive grants. Used Oil Competive Grant Program, UOC1 (FY 2013/14) Project Sustainability: Describe how the proposed project will remain financially viable after grant funds have been expended. Describe available funding sources, if any. The City of Vernon will be able to maintain its DIY trucker program through use of its on -going Used Oil Payment Program funds. While the amount of the OPP is small, only $5000 per year, some of these funds can be used to continue a basic level of outreach to independent 0/0 truckers in the City and continue to distribute trucker related educational materials at appropriate venues in the City. Depending upon the number of DIYer truckers identified during the initial program proposed here, the City can allocate greater amounts of its OPP funds, as well as potential general fund monies, to the support of its trucker outreach program. If in the future the Block Grant funds were suspended, the City would have sufficient funds available from its general budget to continue the majority of the program's tasks, though the collection event component maybe reduced depending upon the number of participants and the amount of used oil and filters collected. The City would also continue to make the educational component of the program available to 0/0 truckers by providing materials to the owners when they register their vehicles with the City during their annual business license renewal . Lastly the City would continue to make educational program materials available at truck stops and truck supply businesses in the community. Used Oil Competive Grant Program, UOC1 (FY 2013/14) IV GOALS AND OBJECTIVES (sp01n6) Identify long term goals and objectives for your used oil project for the next five years The goal of the City of Vernon's trucker outreach program is to identify the DIYer owner/operator (0/0) truckers operating in the City and to provide them with used motor oil and filter recycling information, and to provide them with short term (temporary collection events) and longterm (existing local collection sites) resources for the safe disposal of the used motor oil and filters removed from their commercial semi tractors. In order to identify how many independent 0/0 truckers are also DlYers, the City will survey truck traffic at several high volume truck locations in the community. The measurable goal of this objective is to identify 500 local 0/0 semi trucks that are potential DlYers. This database of local 0/0 truckers will then form the core of the program's educational outreach and the target audience for the planned collection events. After identifying a pool of local independent 0/0 truckers, the City will implement a specific, targeted used oil outreach program to these drivers. The awareness and educational outreach plan will focus on providing these potential DlYers with information about the hazards of the improper disposal of used motor oil and filters and the local resources available for its proper collection (both temporary events funded under this project as well as local permanent collection resources). The goal of these outreach activities is to decrease the amount of used motor oil and filters being illegally disposed of in the City of Vernon. Used Oil Competive Grant Program, UOC1 (FY 2013/14) �LWork Plan document is completed and uploaded in the Documents Tab. Provide additional details of the tasks and activities in the Work Plan document, if further explanation is needed. The City of Vernon, located just south of downtown Los Angeles is, as its City motto proclaims, "Exclusively Industrial." There has been a substantial increase in both independent Owner/Operator truckers as well as small two or three truck firms operating in the City of Vernon. In addition many of the small independent truckers that work in the Vernon area are recent immigrants, primarily though not exclusively Hispanic, many of whom are unaware of the impacts of the improper disposal of motor oil nor are they aware of the existing collection resources that exist for used motor oil & filters. Therefore, eductional outreach will be bilingual because of the large number of Spanish speaking O/O truckers working in the area. The selected locations for the City truck traffic surveys include the 2 intermodal rail yards, major warehouse facilities, and 2 truck stops in the City. Trucking "CA" numbers will enable the City to identify the vehicle owner, find out where the truck is based (i.e., where the owner lives) and will enable the City to later contact the owner with program information and flyers for upcoming DIYer trucker used oil filter collection events. In addition to measuring the amount of used oil and filters collected, City staff will coordinate with the City of Los Angeles' Washington Blvd. SAFE center, to track any increase in the amount of oil and filters brought in as a result of the City of Vernon's trucker outreach. Project Evaluation: Describe how you would measure the project results or success. Include the evaluation steps_you plan to take and when they will occur. Used Oil Competive Grant Program, UOCi (FY 2013/14) In the past CalRecycle has funded oil grants that focused on California truckers (ex, Ross -Campbell, 2005). The City of Vernon proposal is different in that it includes targeted outreach in a community that is a nexus of commercial truck traffic and has a higher ratio of commercial truck traffic on its streets than most other cities. This concentration of activity gives the project a high chance of success and places it in a position to become a model for other similar outreaches for industrial communities with high commercial truck traffic. The project will be evaluated in two ways. 1) Through the number of independent truckers identified and reached and 2) the amount of used oil and filters collected at the City's six (6) trucker collection events. Secondarily the program will be assessed based on the increase in oil and filters collected at the LA SAFE center tracked back as coming from DIYer truckers. Assessment Goal 1) The project's goal is to identify and educate 500 DIYer O/O truckers. Truckers will be asked for their CA Number which will be used to track their participation and attendance at collection events. Assessment Goal 2) Track the amount of used oil and filters collected at the six events. The goals are 100 participants at the 1st event, growing to 200 by the final event. Lastly, long term success will be defined by an increase in used oil from truckers being taken to existing collection locations (SAFE Centers). Describe source and amount of local funds, in -kind services, other grants, or other additional project funding (if any) to complete the proposed project. If needed, provide any additional budget detail justification that could not be included in the Budget Tab form. Used Oil Competive Grant Program, UOC1 (FY 2013/14) The City of Vernon believes in providing the most effective programs at a responsible and reasonable cost. The budget proposed for the Used Oil and Filter Recycling Outreach to Independent Commercial Truckers and Owner / Operator Truckers meets both of those criteria. 1. Temporary or Mobile Collection —The bulk of the proposed budget is for the collection of used oil and filters from the local DIYer trucker community. The six (6) collection events proposed for this project will account for 38.3% of the total budget. 2. Publicity and Education — The City's proposal is targeted at increasing the amount of used oil and filters collected in the Vernon community through an effective educational outreach to local DIYer truckers. Educational materials and outreach event staffing account for 35.7% of the proposal's budget. 3. Personnel (Program Planning, Management, and Administration) —A percentage of the requested grant funds are slated for personnel expenses. These costs will cover Evaluation as well as project oversight, management and reporting, followed by staffing hours to survey local DIY truckers and build a database of 500 small owner / operator and independent truckers who change their own motor oil. Personnel funds and the survey component account for approximately 24.3% of the requested grant funds. 4. Other —The portion of the budget included under the Other category is for equipment. Accounting for 1.7% of the total proposed budget.
