A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON PROVIDING FOR THE APPROPRIATION OF THE
CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM
FUNDS RECEIVED FOR FISCAL YEAR 2014-2015 FOR
FRONTLINE MUNICIPAL POLICE SERVICES
WHEREAS, the State of California provides Citizens Option
for Public Safety Program ("COPS Program"), funding; and
WHEREAS, the County of Los Angeles has established a
Supplemental Law Enforcement Service Fund ("SLESF"), in accordance
with Government Code Section 30061 , to receive COPS Program funds
which have been allocated for use in Los Angeles County; and
WHEREAS, the City has established its own SLESF in
accordance with Government Code Section 30061; and
WHEREAS, the City's SLESF will receive One Hundred Thousand
Dollars ($100,000.00), in COPS Program funds for fiscal year
2014-2015, which must be used to supplement existing frontline
municipal police services; and
WHEREAS, Government Code Section 30061(h) requires that
funds received in any fiscal year be expended or encumbered no later
than June 30, of the following fiscal year; and
WHEREAS, by memo dated June 3, 2014, the Chief of Police has
recommended that the Police Department be authorized to use the COPS
Program funds received for fiscal year 2014-2015, and any interest in
the SLESF account accumulated through June 30, 2015, (collectively,
the "COPS Program - SLESF Funds"), to pay some salary costs for a
Civilian Court Officer, one part-time Police Dispatcher, one temporary
Police Records Technician, in fiscal year 2014-2015, and/or fiscal
year 2015-2016, and any other unbudgeted expenses for frontline
municipal police services, subject to the expenditure limitations
under Government Code Section 30062; and
WHEREAS, the City Council has conducted a public hearing to
consider the funding request from the Chief of Police to use the COPS
Program - SLESF Funds for frontline municipal police services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that this action is exempt under the California Environmental Quality
Act (CEQA), in accordance with Section 150.61(b)(3), the general rule
that CEQA only applies to projects that may have an effect on the
environment.
SECTION 3: The City Council of the City of Vernon hereby
directs that the City continue to maintain its own SLESF in accordance
with California state law.
SECTION 4: The City Council of the City of Vernon finds
that all persons have had the opportunity to be heard or to file
written comments on the funding request from the Chief of Police, and
after due consideration of any and all evidence submitted at the
public hearing, determines that there are compelling reasons to
justify the expenditure of COPS Program - SLESF Funds to pay for a
Civilian Court Officer, one part-time Police Dispatcher, one temporary
Police Records Technician and any other unbudgeted expenses for
frontline municipal police services, and further finds that'use of the
funds in this manner will supplement, not supplant, existing frontline
municipal police services.

SECTION 5: The City Council of the City of Vernon hereby
approves and authorizes the appropriation of COPS Program - SLESF
Funds to pay for a Civilian Court Officer, one part-time Police
Dispatcher, and one temporary Police Records Technician, in
fiscal year 2014-2015, and/or fiscal year 2015-2016, and to the extent
there are any funds remaining, to pay for any other unbudgeted
expenses for frontline municipal police services in fiscal year
2014-2015.
SECTION 6: The City. Council of the City of Vernon hereby
directs the Deputy City Clerk, or the Deputy City Clerk's designee, to
deliver a copy of this Resolution to the appropriate person at the
County of Los Angeles.

SECTION 7: The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions
of the Council of this City.

Recommendation
It is recommended that City Council:
1. Find that the proposed actions in this staff report are exempt from the California
Environmental Quality Act ("CEQA") in accordance with Section 15061(b)(3), the
general rule that CEQA only applies to projects that may have an effect on the
environment.
2. Hold a public hearing to consider expenditure of COPS Program funds for fiscal year
2014-2015.
3. Approve the Resolution authorizing the expenditure of the finds to pay salary costs for
civilian support personnel in fiscal year 2014-2015.
Background
The Vernon Police Department received $100,000,00 through the annual Citizens Option for
Public Safety (COPS) Program for fiscal year 2014-2015, pursuant to the Supplemental Law
Enforcement Services Account provisions outlined in Section 30061 of the Government Code.
In accordance with Government Code Section 30061(c)(2), the Police Department is requesting
authorization to use these funds to continue to pay salary costs for civilian support personnel in
fiscal year 2014-2015. Due to the past reductions in force, the City would not have these civilian
positions as part of its frontline municipal police services without the available grant funding.
Thus, the services provided by these civilian personnel supplement, and do not supplant, existing
frontline municipal police services.
State Assembly Bill 1913 was enacted in fiscal year 2000-2001 to continue funding for the
Citizens Option for Public Safety (COPS) Program and has been modified from time to time by
the legislature (e.g., State Senate Bill 823 in 2002). Annually, the state legislature has continued
to provide COPS Program funds. The COPS Program allows eligible cities to receive a
proportionate share of COPS Program funds. The grant funds are administered and distributed
through the Chief Executive Office of Los Angeles County.
The Chief of Police makes the following request for use of the fiscal year 2014-2015 COPS
Program funds and any interest account accumulated:
• To pay the wage and/or overtime of a Civilian Court Officer (current)
• To pay the wage of a part-time Police Dispatcher (current)
• To pay the wage of a temporary Police Records Technician employee (additional)
• To pay for any other unbudgeted expenses for frontline municipal police services
(subject to the expenditure limitations set forth in Government Code Section 30062)
The Civilian Court Officer position and the part- time Police Dispatcher position are currently
funded through the fiscal year 2013-14 COPS Program. This request is to continue to fund these
positions with COPS Grant funding and include funds for the temporary Police Records
Technician position.
State law authorizes the City Council to use the funds provided by the COPS Program — both
existing and anticipated moneys — in accordance with the written requests of the Chief of Police
(per Government Code § 30061(c)(2)). Previous legislation mandated that a public hearing be
held before acting upon such a written request. More recently, we learned that the public hearing
requirement was eliminated. However, since the hearing notice had already been posted, we
elected to continue with the previous established process. The request must be considered
separate and apart from the process applicable to proposed allocations of the City's general fund.
On May 22, 2014, the City published a Notice of Public Hearing in Eastern Group Publications
as well as the City website.
The COPS funds received must be used to supplement, and not supplant, existing "frontline
municipal police services" being provided by the City. These funds must be encumbered no later
than June 30, 2014.
Fiscal Impact
There are no cost -share or match requirements associated with this grant. The proposed
positions will be fully funded with the available grant funds.

allocated, or any provision thereof in court, you may be limited
to raising only those issues you or someone else raised at the
hearing described in this notice or in written correspondence
delivered to the City of Vernon at, or prior to, the meeting.

The hearing may be continued or adjourned to a stated time
and place without further notice of a public hearing.
