A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AMENDMENT NO. 1 TO THE MEMORANDUM
OF UNDERSTANDING BY AND BETWEEN THE CITY OF VERNON
AND THE VERNON POLICE MANAGEMENT ASSOCIATION AS IT
RELATES TO COMPENSABLE WAGES
WHEREAS, the Vernon Police Management Association ("VPMA") has
been .recognized as an employee organization and has met and conferred
with the Municipal Employee Relations Representative of the City of
Vernon (the "MERR"); and
WHEREAS, on September 17, 2013, the City Council of the City
of Vernon adopted Resolution No. 2013-79 approving a Memorandum of
Understanding ("MOU") executed by the VPMA and the MERR for the period
of September 1, 2013 through June 30, 2014 and
WHEREAS, the City and the VPMA agreed to re -open negotiations
upon completion of the classification and compensation study regarding
compensable wages of the Police Captains and Police Lieutenants after
the MOU was approved and signed by the parties; and
WHEREAS, the City and the VPMA have agreed to execute
Amendment No. 1 to the MOU (the "Amendment") regarding compensable
wages of certain Fire personnel; and
WHEREAS, the City Council desires to approve the Amendment.
NOW, THEREFORE, BE IT RESOLVED.BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that this action is exempt under the California Environmental Quality
Act (CEQA), in accordance with Section 15061(b)(3), the general rule
that CEQA only applies to projects that may have an effect on the
environment.
SECTION 3: The City Council of the City of Vernon hereby
approves the Amendment No. 1 to the Memorandum of Understanding (the
"Amendment") between the City of Vernon and the Vernon Police
Management Association, in substantially the same form as the copy
which is attached hereto as Exhibit A.
SECTION 4: The City Council of the City of Vernon hereby
instructs the City Administrator, or his designee, to take whatever
action is deemed necessary or desirable for the purpose of implementing
and carrying out the purposes of this Resolution and the transactions
herein approved or authorized, including but not limited to, any
nonsubstantive changes to the Amendment attached herein.
SECTION 5: The City.Council of the City of Vernon hereby
directs the City Clerk, or the City Clerk's designee, to send a fully
executed MOU to Jerry Winegar, VPMA'President.

SECTION 6: The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions of
the Council of this City.

Parties to the Memorandum of Understanding
Pursuant to Chapter 10 (section 3500 et seg) of Division 4, Title 1 of the Government Code and
Resolution No. 4027, the Resolution for the administration of Employer -Employee relations, the
matters within the scope of representation that are set forth in this Memorandum of
Understanding (MOU) have been discussed by and between representatives of the City of
Vernon and the representatives of the Vernon Police Management Association (hereinafter
"VPMA") and except as otherwise specifically provided herein shall apply only to those defined
in the aforesaid Resolution as Lieutenants and Captains.
This Amendment to the MOU constitutes a joint agreement by the Municipal Employee
Relations Representative ("MERR") and the VPMA, to be submitted to the City Council of
Vernon for its determination and approval by one or more Resolutions or Ordinances as the City
Council may deem fit and proper.
The MERR and the Representative of the VPMA have agreed that they will jointly urge. the City
Council of Vernon to adopt one or more Resolutions or Ordinances reflecting the changes in
wages, hours, and other conditions of employment agreed upon in this Amendment.
If approved, the terms agreed upon by this Amendment to the MOU shall take effect on
September 1, 2013 and shall expire at midnight on June 30, 2014.
The terms agreed upon by this Amendment to the MOU are pursuant to the joint agreement by
the City and the VPMA to re -open negotiations regarding salaries, P.O.S.T Certificate Pay,
Longevity Pay, Compensatory Time, and Court Attendance and Stand By Time set forth in

Article 3, Section 3, and Section 7, Article Four, Section 2, Article Five, Section 3 and Section 6
respectively, after the MOU was approved and signed by the parties, and upon completion of the
classification and compensation study. Pursuant to the parties' re -opener, the agreements
reached and ratified by both parties relative to these specific sections are now being incorporated
into the MOU. For any items on which there was no mutual agreement reached between the
VPMA and the City to amend the above sections set forth in the MOU, the terms of those
benefits contained in the MOU shall remain in full force and effect.
IN CONSIDERATION OF THE TERMS AND CONDITIONS HEREIN STATED, the VPMA
and the City of Vernon agree as follows:
ARTICLE THREE

Effective June 1, 2014, the following salary ranges are established for employees represented by
the Vernon Police Management Association based upon the results of the City wide
classification and compensation study at the 75`" percentile, and consistent with the proposed

Section 7: Peace Officers Standards and Training ("P.O.S.T.") Certificate Incentive
Effective June 1, 2014 VPMA employees shall be entitled to a 7.5% of the employee's base
monthly salary, excluding all other compensation, for a P.O.S.T. Management certificate.
Incentive pay shall be payable the month following the month during which the certificate is
granted.
P.O.S.T. certificate pay shall be considered as part of the base monthly salary for purposes of
computing the last highest annual salary.

Recommendation
It is recommended that the City Council:
1) Find that approval of the resolutions proposed in this staff report are exempt under the
California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3),
the general rule that CEQA only applies to projects that may have an effect on the
environment.
2) Adopt the attached resolution approving Amendment No. I to the 2013-2014
Memorandum of Understanding by and between the City of Vernon and the Vernon
Police Management Association.
3) Adopt the attached resolution amending Exhibit A — Classification and Compensation
Plan, of the Citywide Personnel and Salary Resolution effective June 1, 2014,
implementing the changes set forth in Amendment No. 1 to the 2013-2014 Memorandum
of Understanding between the City of Vernon and the Vernon Police Management
Association, and clarifying the correct hourly rates of certain Fire personnel.
Background
Amendment No. 1 to Vernon Police Management Association 2013-2014 Memorandum of
Understanding
The City and the Vernon Police Management Association ("VPMA") concluded labor
negotiations on September 17, 2013 regarding wages, benefits and working conditions for the
2013-2014 Memorandum of Understanding ("MOU"). In light of the City's then -pending
classification and compensation study, the City and the VPMA agreed to re -open negotiations
regarding compensable wages of the Police Captains and Police Lieutenants after the MOU was
approved and signed by the parties, and upon completion of the classification and compensation
study. The parties agreed to re -open negotiations regarding compensable wages no later than
December 31, 2013. Specifically, the VPMA and the City agreed to continue discussion on
salaries, P.O.S.T Certificate Pay, Longevity Pay, Compensatory Time, and Court Attendance and
Stand By Time. If any agreements were ultimately reached and ratified by both parties relative
to these specific sections, those agreements would then be incorporated into the MOU.
This report recommends City Council approval of changes to the salaries and P.O.S.T Certificate
Pay for the three (3) employees represented by the VPMA, which incorporate mutually agreed -
upon provisions. The amendment covers the remainder of the VPMA's current MOU term,
which concludes on June 30, 2014.
Members of City staff and representatives of the VPMA met and conferred, and reached
agreement on the proposed contract language, subject to the approval of the City Council.
Key provisions of the proposed Amendment are
Effective June 1, 2014, establish new salary ranges for employees represented by the
VPMA based upon the results of the City wide classification and compensation study at
the 75" percentile, and consistent with the proposed 5x5 grade and step pay plan.
Effective June 1, 2014, employees represented by the VPMA shall be placed at the new
grade and step that is closest to, but not lower than their current salaries.
Effective June I, 2014, employees represented by the VPMA shall be entitled to a 7.5%
P.O.S.T. Certification Pay of the employee's basic monthly salary, for a P.O.S.T.
Management Certificate.
Amendment to Exhibit A — Classification and Compensation Plan, of the Citywide
Personnel and Salary Resolution effective June 1, 2014
In order to implement the salary pay changes set forth above, staff recommends that City Council
approve and adopt the attached resolution amending Exhibit A — Classification and
Compensation Plan, of the Citywide Personnel and Salary Resolution effective June 1, 2014.
Additionally, the proposed Amendment to Exhibit A of the Classification and Compensation
Plan includes a minor update to the City of Vernon Compensation Schedule to correct the hourly
rate for Fire platoon personnel who work the 112 hour work schedule. Fire classifications
designated with "P" are based upon 2912 hours per year. The hourly rates are also updated to
reflect a four (4) decimal delineation to ensure accurate rounding of monthly and annual rates.
This update has no impact on the annual pay rate, monthly pay rate, or pay period for the
classification.
Fiscal Impact
The approximate cost for the remainder of this fiscal year to adopt Amendment No. 1 to the
2013-2014 Memorandum of Understanding between the City and the Vernon Police
Management Association is $3,452 and can be absorbed within the Police Department's current
budget.
