Resolution No. 2014-027RESOLUTION NO. 2014-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING EXHIBIT A OF RESOLUTION NO. 2013-57 REGARDING THE COMPENSATION, COSTS AND BENEFITS OF ITS EMPLOYEES ("CITYWIDE PERSONNEL AND SALARY RESOLUTION") (AMENDMENT NO. 7) WHEREAS, on June 18, 2013, the City Council of the City of Vernon adopted Resolution No. 2013-57, regarding the compensation, costs and benefits of its employees, which has subsequently been amended by Resolution Nos. 2013-66, 2013-90, 2014-07, 2014-12, 2014-14, and 2014-25 (the "Citywide Personnel and Salary Resolution"); and WHEREAS, Exhibit A of the Citywide Personnel and Salary Resolution provides for positions and salary scales of positions within the City Departments; and WHEREAS, by memorandum dated June 3, 2014, the City Administrator has recommended that Exhibit A be amended to implement a new grade and step pay plan as a result of the Citywide classification and compensation study based upon the`75th percentile of the comparable survey labor market for the classifications designated as "Confidential and Mid -Management"; and WHEREAS, the City Council of the City of Vernon desires to. amend Exhibit A of the Citywide Personnel and Salary Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE v; CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. SECTION 3: Effective June 29, 2014, Exhibit A of the Citywide Personnel and Salary Resolution is hereby amended to revise the Citywide personnel classifications and compensation, a copy of which is attached hereto as Exhibit A. SECTION 4: The provisions of Resolution No. 2013-57, as amended by Resolution Nos. 2013-66, 2013-90, 2014-07, 2014-12, 2014-14, and 2014-25 not consistent with or in conflict with this resolution are hereby repealed; in all other respects, Resolution Nos. 2013-57, 2013-66, 2013-90, 2014-07, 2014-12, 2014-14, and 2014-25 shall remain in full force and effect. - 2 - SECTION 5: The City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator RE: 1) A RESOLUTION OF THE CITY CO CIL OF THE CITY OF VERNON AMENDING EXHIBIT A OF RESOLUTION NO. 2013-57 REGARDING THE COMPENSATION, COSTS AND BENEFITS OF ITS EMPLOYEES ("CITYWIDE PERSONNEL AND SALARY RESOLUTION") (AMENDMENT NO.7) Recommendation It is recommended that the City Council: 1) Find that approval of the proposed resolution in this staff report is exempt under the California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. 2) Contingent upon City Council adoption of the Fiscal Year 2014-2015 budget, adopt the attached resolution amending Exhibit A — Classification and Compensation Plan, of the Citywide Personnel and Salary resolution, to be effective June 29, 2014, implementing a new grade and step pay plan as a result of the Citywide classification and compensation study based upon the 75`" percentile of the comparable survey labor market for the classifications designated as "Confidential and Mid -Management". Each employee shall be placed within his/her classification's new salary grade at the step that is closest to, but not lower than his/her current base salary. Background Effective April 20, 2014, City Council adopted the updated City wide classification plan (excluding classifications represented by the City of Vernon Firemen's Association) as a result of the City wide classification study. At that time, no changes were recommended to the compensation portion of the study because the City is obligated to negotiate over salaries with all bargaining units pursuant to the Meyers-Milias-Brown Act. In addition, mid -management classifications designated as exempt from overtime in accordance with the Fair Labor Standards Act ("FLSA") were placed on hold pending the implementation of any new salary grade tables. Employees in the classifications designated as "confidential and mid -management" are not designated for purposes of recognition and representation in collective bargaining, and are therefore not subject to the provisions of the Meyers-Milias-Brown Act. City staff has concluded its review of the proposed compensation plan as a result of the City wide compensation study conducted by Public Sector Personnel Consultants for classifications identified as "confidential and mid -management". In addition, department directors, in conjunction with the Finance Director, have included in their budget presentations to City Council the proposed salaries at the 75`h percentile range for City Council consideration in the adoption of the Fiscal Year 2014-2015 Citywide budget. Contingent upon City Council adoption of the proposed FY 2014-2015 budget, which includes the confidential and mid -management salaries set at the 75`h percentile range, this report recommends City Council approval to amend the Classification and Compensation Plan to add the new salary grade plan with a five -step pay scale for the classifications designated as "confidential and mid -management", effective June 29, 2014. The proposed salary grades are based upon the City wide classification and compensation study at the 75`11 percentile range of the surveyed labor market. It is recommended that each confidential and mid -management employee be placed at the step within his/her classification's new salary grade that is closest to, but not lower than his/her current base salary. Analysis: The City of Vernon City Council adopted Salary Plan Administration Policy II-3 on September 17, 2013. The policy of the City wide salary plan is intended to attract, retain, and motivate highly qualified staff that are necessary to enable the City of Vernon to discharge its obligations to the community with regard to the quality and timeliness of services provided. Based on the desire of the City Council to provide high quality services and leadership to the community and management to the organization, the compensation policy should be postured to pay market average salary levels at a minimum, with an ideal of paying employees at the 75`h percentile of the applicable labor market. To this end, the Human Resources staff shall make available to the City Administrator for consideration in determining pay, the salary grade at the 75`h percentile of the competitive surveyed rates. The 75`' percentile will be one of several internal and external factors that the City will use to consider appropriate compensation. Other factors considered by staff in the recommendation of the appropriate salary level for City of Vernon employees are as follows: • The City's financial ability to pay and sustain the recommended salary grade ranges at the 75`h percentile. • Ability to attract and retain highly qualified, knowledgeable employees and increase applicant pool for competitive recruitment processes. • Reduction in turnover of employees and loss of hard to fill positions to other cities. • Retention of institutional knowledge. • City of Vernon is a full service city that provides an array of services that many cities do not offer: Gas Services, Health Department, three -minute Police Department response times for Priority 1 calls, Class 1 Fire Department • The uniqueness and complexity of job content and duties of City of Vernon employees in comparison to local full service City comparators. • City of Vernon employees pay 100% of the employee PERS contribution rate; other agencies in the comparable labor market pay a portion of the employee PERS contribution rate, • City of Vernon benefits and vacation accruals are low in comparison to the comparable labor market. • City of Vernon employees, even if otherwise eligible, have not received annual merit increases since June 2009 due to a City wide freeze implemented as a result of the economic downturn. One time merit increases were issued in January 2012. • City of Vernon non -safety employees have not received any COLA increases since 2008. In line with the proposed salary changes and the fact that mid -management level employees will be exempt from overtime, City Staff intends to present a recommendation regarding Administrative Leave for mid -management level employees at a future meeting. Said recommendation will consider comparable labor market data. Fiscal Impact The cost for fiscal year 2014-2015 to implement the new salary grades and place employees at the appropriate steps is approximately $322,062. These costs have been or will be included and presented to City Council during the respective departmental budget presentations for the proposed fiscal year 2014-2015 City wide budget adoption. There is no financial impact to provide Administrative Leave to the mid -management exempt staff.
