RESOLUTION NO. 2014-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING A MODIFICATION OF CONDITIONAL USE PERMITS FORMERLY APPROVED BY RESOLUTION NO. 9195 AND 9614 FOR GEOGREEN BIOFUELS, INC., FORMERLY KNOWN AS GREEN STAR BIOFUELS, LLC, DBA GEOGREEN BIOFUELS, LOCATED AT 6011 AND 6017 MALBURG WAY WHEREAS, on January 3, 2007, via Resolution No. 9195, the City Council issued a Conditional Use Permit ("CUP") to GeoGreen Biofuels, Inc., formerly known as Green Star Biofuels, LLC dba GeoGreen Biofuels ("GeoGreerf"), to operate a`recycling facility at 6017 Malburg Way ("6017 Building"); and WHEREAS, on May 19, 2008, via Resolution No. 9614, the City Council approved an amendment to the CUP to allow GeoGreen to expand its operations into an adjoining portion of the 6017 Building which is identified as 6011 Malburg Way ("6011 Building"); and WHEREAS, in the original CUP and its amendment, GeoGreen proposed to have waste vegetable oil delivered to the 6017 Building for recycling and refinement into biodiesel, GeoGreen has since determined that further purification of said waste vegetable oil is necessary prior to introducing it into GeoGreen's equipment for refinement; and WHEREAS, GeoGreen seeks an amendment to the CUP to allow the installation of additional processing equipment and storage tanks in the 6011 Building to accommodate such further purification as part of the biodiesel process; and WHEREAS, Applicant's business operation is classified as a recycling facility pursuant to the Vernon Comprehensive Zoning Ordinance Section 26.2.11; and WHEREAS, the 6011 and 6017 Malburg Way site ("Site") is located in the I -Zone, Industrial. Pursuant to Section 26.4.1-3(f) of the Vernon Comprehensive Zoning Ordinance, where a recycling facility is allowed in the I -Zone with approval of conditional use permit; and WHEREAS, the Site is surrounded by industrial, commercial, and warehousing uses compatible with the proposed use; no adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare are anticipated; and the Site has adequate parking, loading facilities for its use; and WHEREAS, the issuance of an amendment to the CUP for a recycling facility is permissible and is consistent with the objectives of the Vernon Comprehensive Zoning Ordinance and the General Plan; and WHEREAS, the City Council has received a Staff Report, dated June 17, 2014, upon which it has relied in making the foregoing, recitals; and WHEREAS, the conditions imposed on the CUP approved under Resolution No. 9195 and 9614, as amended, modified or added to by this resolution, are adequate to protect the public health, safety and general warfare and all other conditions shall remain in full force. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon further finds that all persons have had the opportunity to be heard or to file written comments to the proposed Project and after due consideration of all the evidence submitted at the public hearing determines that there are compelling reasons to justify granting a CUP amendment.: SECTION 3: The City Council of the City of Vernon hereby - 2 - finds that the Project is categorically exempt from the California Environmental Quality Act ("CEQA") as provided in California Code of Regulations, Title 14, Chapter 3, Section 15301, Class 1, Existing Facilities, because no physical changes other than interior improvements will occur as a result of the approval, and no significant impact to the environment will occur as a result of the issuance of the amendment to the CUP. The City Council of the City of Vernon directs the City Clerk, or the City Clerk's designee, to file a Notice of Exemption in compliance with CEQA. SECTION 4: The custodian of records for the project and all other material that constitute the record of proceedings upon which the City Council's decision is, based is the City Clerk, or Deputy City Clerk, of the City of Vernon. Those documents are available for public review in the Office of the City Clerk located at 4305 Santa Fe Avenue, Vernon, California 90058. SECTION 5: A CUP amendment is hereby issued consistent with the conditions set forth herein and the site plan drawing and process flow diagram, attached hereto as Exhibit A, and by this reference incorporated herein. Issuance of the CUP amendment is proper, as the City Council hereby makes the following findings, as required by Section 26.6.3-4 of the Vernon Comprehensive Zoning Ordinance: 1. The lot for the proposed use is adequate in size, shape and topography, including any required drainage and landscaping; No changes in the physical nature of the lot or building footprint are being made. The lot for the proposed use is adequate in size, shape, and topography for a recycling facility because the owner has not proposed any changes to the size, shape or topography of the existing Site. - 3 - 2. The use permitted under the conditional use permit will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the lot in question; The project proposes a recycling facility within an existing structure. The project Site is surrounded by industrial and warehousing uses compatible with the proposed use. Similar to other surrounding uses, an initial study and negative declaration were conducted and approved for the project when GeoGreen was first granted a conditional use permit in 2007. At that time, it was determined that the project would not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the lot in question. As proposed, this CUP amendment would result in a lower adverse impact on the environment than the permitted use under the current CUP insofar as the proposed use would have less odor and reduced traffic. 3. The proposed use will be compatible with the permitted uses of surrounding and adjacent properties; The proposed use is similar to other industrial uses in the area and will be compatible with the permitted uses of surrounding and adjacent properties because (i) recycling uses may be permitted in the I -Zone of the City with a conditional use permit; and (ii) the proposed use will meet the City's noise, odor and vibration standards to ensure that there will not be negative impacts on adjacent properties. 4. The lot has adequate off-street parking and loading facilities for the proposed use; The existing building was constructed with a fifty-five stall surface parking lot, five truck loading, and three truck parking stalls which - 4 - meet the requirements of the Vernon Comprehensive Zoning Ordinance. There will be no change in off-street parking and loading facilities. No changes in the physical nature of the lot or exterior of the building are being made. With the conditions imposed, all parking activities will be maintained within GeoGreen's premises, the loading facilities will be adequate and will not interfere with customer parking, and the proposed use will not create an adverse impact on neighboring properties. The Site's parking areas will be paved with an impermeable surface that will meet the City's applicable development standards. 5. The use, as to location, operation and design, is consistent with the general plan, any applicable specific plan and the zoning regulations of the City of Vernon; including the city's policy considerations as to acceptable uses in the city; The Site is within the "I' zone which allows such recycling facilities as a conditional use. The proposed use would be self-contained within the confines of the building with sufficient parking and loading on - site. As such the proposed use would not conflict with the surrounding existing industrial and warehousing uses that are compatible with the proposed operation. The use may be continued provided that it does not expand its building footprint, and is not vacant in excess of two years. No structural alterations to the lot or building are proposed. As long as the applicant complies with these terms, the conditional use permit will be consistent with the objectives of the Comprehensive Zoning Ordinance and the General Plan. 6. The use is consistent with all applicable county, state, and federal laws, rules and regulations; The proposed use is compliant with all applicable local, county, state and federal laws, rules and regulations. No operations will be - 5 - permitted until GeoGreen obtains all -necessary -and appropriate permits and approvals from applicable government agencies. 7. The proposed use will not adversely affect the general welfare as a result of noise, increased traffic, interference with the flow of traffic, dust, or other undesirable characteristics; The proposed use will not undertake any structural alterations. The level of service of the existing road system will not be impacted by the proposed use. Therefore, the general welfare of the community will not be adversely impacted. All new equipment will be housed within the interior of a concrete tilt-up.building.wh;ich is designed to sufficiently buffer any noise from the equipment. Traffic flow will be staged such that only one truck will be present at the existing loading/offloading station at any given time. GeoGreen will be able to accept truck deliveries and offload to trucks during off-peak hours including nights and weekends when feasible in order to minimize truck traffic. During normal business hours, truck traffic will not interfere with other nearby business neighbors as approved pursuant to the existing CUP. Only CalTrans approved fuel/tanker trucks will be used. All materials will be pumped to or from the facility to tanker trucks parked 25 feet away from the facility in the existing truck loading space. Such operations will not adversely interfere with the flow of traffic in the area. .It is anticipated that there will be an average of. 8 - 10 employees total per shift at the facility which will use parking on -site. No off-street parking will be needed.. 8. The conditions stated in the decision are deemed necessary to protect the public health, safety and general welfare. All of the conditions imposed on the project are necessary to protect the public health, safety and general welfare because the conditions are - 6 - limited in nature, and ensure that the property is used in the manner promised by the applicant. SECTION 6: To adequately protect the public health and general welfare, the conditions contained in Resolution No. 9195 remain and shall be required except condition "c" is hereby modified and conditions "r," "s," "t," and "u" are hereby added to provide as follows: c. Any hazardous substances used, handled and/or stored at 6011 and/or 6017 Malburg Way shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained if there are any reportable quantities of hazardous materials at any time. All hazardous materials shall be confined to the 6011 and 6017 Malburg Way site. r. GeoGreen and any successors in interest shall indemnify, hold harmless and defend the City of Vernon, its officers, agents and employees from and against any and all claims, complaints or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the active negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. S. Not later than twenty (20) days from the date of approval of this conditional use permit amendment, GeoGreen'shall - 7 - indicate, in writing, its acceptance of and agreement with the conditions herein. The conditional use permit amendment shall be void and of no force or effect unless such written acceptance and agreement is submitted to the City within said twenty -day period. t. GeoGreen shall submit a Technical Report outlining the operations' code compliance with 2013 California Fire Code, as amended, and the 2013 California Building Code, as amended, prior to commencement of construction. U. No grease trucks shall deliver product to the Site, only refined oils shall be permitted, specifically, incoming cleaned (free of odor, particulate and water) vegetable oil from an aggregator with approximately 5% free fatty acid (FFA). - 8 - SECTION 7: The City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City. (GeoGreen) to operate an existing recycling facility, subject to the conditions of approval for the property located at 6011 & 6017 Malburg Way. BACKGROUND On January 3, 2007, via Resolution No. 9195, the City Council issued a CUP to GeoGreen Biofuels, Inc., formerly known as Green Star Biofuels, LLC dba GeoGreen Biofuels ("GeoGreen"), to operate a recycling facility at 6017 Malburg Way ("6017 Building"). On May 19, 2008 by Resolution No. 9614, the City Council amended the CUP to allow GeoGreen to expand its operations into an adjoining portion of the same building, which is identified as 6011 Malburg Way ("6011 Building"). GeoGreen has submitted another CUP application for an amendment to allow the installation of additional processing equipment and storage tanks in the 6011 Building. Condition "k" of Resolution No. 9195 approving GeoGreen's CUP states, "The project site shall be constructed and maintained substantially in compliance with the site plans submitted as part of this conditional use permit application." Because the site plan submitted as part of the original conditional use permit application does not show any of the proposed new equipment other than a compressor in the 6011 Building, the project is no longer substantially the same as originally approved. Therefore, a modification to the existing conditional use permit is required to add the new equipment. PROJECT OVERVIEW The purpose of the CUP amendment is to allow GeoGreen to install additional processing equipment in the 6011 Building. Currently, storage tanks and process equipment are located at the 6017 Building and an air compressor is located at the 6011 Building. GeoGreen needs to install additional equipment in the 6011 Building to be able to produce biodiesel and fulfill the company's original objectives. GeoGreen has indicated that it is not possible to produce biodiesel without installing additional processing equipment in the 6011 Building. This amendment would permit GeoGreen to process vegetable oil for use as a feedstock for its biodiesel process. GeoGreen leases office space at both the 6017 Building and 6011 Building and the majority of GeoGreen's current biodiesel equipment is in the 6017 Building. The CUP amendment would pertain only to the 6011 Building. In the original CUP, GeoGreen proposed to have grease from restaurants delivered to the 6017 Building for refinement into biodiesel. It has now been determined that further purification of the grease is necessary before the product is introduced into the GeoGreen equipment. GeoGreen has installed a centrifuge at a separate company located in the City of Anaheim, to process up to 200,000 gallons per month of waste vegetable oil for GeoGreen. This company will remove particulate, odor and water from the waste vegetable oil through centrifugation, filtration and settling. The purpose of this long term contractual agreement is to ensure that GeoGreen only handles clean (free of particulate, water and odor) vegetable oil. The clean vegetable oil to be delivered to GeoGreen's facility will be free of particulate, water and odor, but will contain approximately 5% free fatty acid (FFA). FFA is simply the non -hazardous byproduct of vegetable oil (triglyceride). GeoGreen's biodiesel process requires feedstock that is low in FFA (< 0.5%). The purpose of the new equipment installation at the 6011 Building is to remove FFA from incoming cleaned vegetable oil (from 5% to < 0.5%). FFA which is removed from the cleaned vegetable oil (via GeoGreen's proposed FFA Stripping System to be installed at the 6011 Building) will be stored in a 7,000 gallon storage tank (new storage tanks at the 6011 Building). The excess FFA will then be removed from the GeoGreen storage tank approximately once every 2.5 weeks via one 6,000 gallon truck at the existing 6017 Building offload station. 2 The FFA Stripping System is a unique way for a biodiesel operation to process or remove FFA. The majority of biodiesel companies use large volumes of methanol and methylate in a chemical pretreatment process to convert FFA in vegetable oil to biodiesel. However, GeoGreen designed a unique FFA stripping system which uses small amounts of sodium hydroxide to remove the excess FFA. The FFA stripping system proposed at GeoGreen uses steam and vacuum in order to remove FFA from vegetable oil. A small boiler is required to provide steam to the new FFA stripping system. Since the boiler requires less than 2M BTU/hour, it is exempt from the AQMD permit approval process and only AQMD notification is required. Process and Equipment Description The following utility upgrades and additional process equipment are required at the 6011 Building: Utility Upgrades Electrical switchgear upgrade Currently, a 400 Amp panel is installed inside the 6011 Building. The 400 Amp panel will need to be replaced with an 800 Amp panel in the same location. Natural gas service There is currently no natural gas provided to the 6011 Building. However, there is a main natural gas line on Malburg Way which can easily and safely be brought into the 6011 Building by the City of Vernon. City representatives have visited the GeoGreen site and have determined that it will be relatively easy to install the required small natural gas line. The amount of natural gas required is fairly small at <2M BTU/hr. since it will feed a relatively low horsepower (48 HP) boiler. All applicable codes and regulations will be complied with provided the natural gas lines and boiler are operated safely and efficiently. Process Equipment See attached Process Flow Diagram: Vegetable Oil Free Fatty Acid (FFA) Removal System Free Fatty Acid Stripping System The FFA Stripping System will use cleaned vegetable oil as a feed stream at a maximum of 650 gallons per hour and steam at 450 pounds per hour. Output is FFA stripped vegetable oil which is pumped to one of two new 7,000 gallon holding tanks, then transferred to the existing GeoGreen biodiesel process (6017 Building side). Another output stream consists of water at 50 gallons per hour. The water will be transferred to a new 7,000 gallon effluent holding tank and then, after monitoring, will be discharged to the city sewer. A waste water discharge permit will be required by the Los Angeles County Department of Sanitation. GeoGreen submitted an FFA stripping skid structural permit application (Service & Vessel Support Platform) for plan check to the City of Vernon (Plan Check No. 89769). 48 Horsepower (HP,) Boiler A small 330 sq. ft. room with one hour fire rated walls will be constructed to allow for installation of a new 48 HP boiler (currently being fabricated by Parker Boiler). This boiler is an AQMD pre - approved system that does not require an AQMD permit because the system is a safe, new low NOx unit and uses less than 2M BTU/hour of natural gas. Structural engineering plans were submitted to the City of Vernon on March 24, 2014 for plan check review. Storage Tanks Six 7,000 gallon above -ground storage tanks will be installed on the north side of the 6011 Building as shown on the attached Site Plan Drawing. The tanks will be anchored to the new concrete pad per approved structural drawings pending plan check by the City of Vernon. The 6017 Building currently has fourteen 7,500 gallon storage tanks approved per the existing CUP; the storage requirement at the 6011 Building is much lower than storage volume already approved at the 6017 Building. Storage tank structural engineering plans were submitted to the City of Vernon on March 24, 2014 for plan check review. Storage tank components: Tanks 1 and 2: Cleaned vegetable oil hold prior to sending to the FFA skid Tanks 3 and 4: Cleaned and FFA stripped vegetable oil prior to sending to the existing biodiesel system at the 6017 Building. Tank 5: FFA from the FFA skid prior sending out to truck offload through the existing offloading station located at the 6017 Building. Only one truck will be offloaded approximately every 2.5 weeks. Tank 6: Water from the steam condenser will be pumped to this tank. Water will be discharged to drain per a yet to be approved City of Vernon and Los Angeles County Department of Sanitation monitoring plan and protocol. Filtration Skid The filtration system will be used to filter biodiesel after reaction (existing process at the 6017 Building) and prior to ion exchange (existing process at the 6017 Building). Filter media will likely be cellulose which is a safe and inert filter media. Future Storage Tanks The attached Site Plan Drawing shows two additional future storage tanks which are part of this CUP amendment. These additional storage tanks will be used for storage of biodiesel pre - filtration and post -filtration. The proposed CUP amendment will permit the future installation of these two additional storage tanks as needed. 0 PROJECT SITE The existing lot is approximately 1.98 acres in size with a building that is subdivided into three sections totaling 50,000 square feet. GeoGreen is currently occupying 9,350 square feet at the 6017 Building and the adjoining section of the building at the 6011 Building, which is approximately 9,300 square feet. GeoGreen has indicated that it does not plan to structurally alter the existing building, although indoor renovations are expected. Trucks and Loading The current GeoGreen CUP was approved based on the previously submitted CUP application which indicated that GeoGreen would "import used restaurant oil in dedicated tank trucks (similar to F800, 16' length, 2,000 gal. capacity)." This would no longer be the case with this new CUP amendment application. GeoGreen will not use small dedicated tanker trucks to bring in used restaurant oil. GeoGreen sold its waste vegetable oil collections business and sold all three of its smaller (2,000 gal) tanker trucks. GeoGreen will no longer collect waste vegetable oil from restaurants or food operations. Instead, GeoGreen will only purchase large volumes (6,000 gal per delivery) of cleaned vegetable oil from an aggregator of used, but clean (free of odor, particulate and water) vegetable oil. This new strategy is advantageous to GeoGreen, the City of Vernon, and nearby tenants because traffic flow will be reduced and there will not be any odor problems associated with incoming material processed at GeoGreen's facility. Traffic flow will be staged so that only one truck will be present at the existing loading/offloading station at any given time. The vegetable oil processed at the 6011 Building will operate an estimated 4 days per week, 24 hours per day. The existing biodiesel operation at the 6017 Building is expected to operate up to 7 days per week, 24 hours per day. Operations at both the 6011 Building and the 6017 Building share the same (existing) loading and off-loading stations. GeoGreen will be able to accept truck deliveries and off load trucks during off peak hours including nights and weekends when feasible in order to minimize truck traffic. However, during normal business hours, truck traffic will not interfere with other nearby business neighbors as approved per the existing CUP. The following truck traffic will be associated with operations related to the 6011 Building: • Incoming clean vegetable oil — average of 2-3 truckloads per day for 45 minutes per delivery • Outgoing biodiesel from the existing 6017 Building process — 1 truckload per day for 1 hour • Free fatty acid (FFA)— average of 1 truckload every 2.5 weeks for 1 hour • Supplies or equipment to the loading dock — occasional; 1 truck every 3 weeks for 15 to 30 minutes Only CalTrans-approved fuel/tanker trucks will be used. All materials will be pumped to or from the facility to tanker trucks parked 25' away from the facility in the existing truck loading space. Automobile Parking It is anticipated that there will be 8-10 employees total per shift at the facility (both the 6011 Building and the 6017 Building). The project site is supported by fifty-five automobile parking stalls, three truck parking spaces and five truck loading spaces. Because the use of the 6011 Building and 6017 Building is not changing, the number of required parking and loading spaces will remain the same. Therefore, it is anticipated all parking and loading activities will be maintained on -site within the premises and that an adequate supply of parking and loading on -site will be provided creating no impact to neighboring properties. Access The subject site is served by Malburg Way, a local roadway with a right-of-way of 60 feet. The proposed site has one driveway on Malburg Way located on the east side of the building, which provides ingress and egress from Malburg Way. Trucks and automobiles accessing the site will continue to share the existing driveway along Malburg Way. The streets and highways surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed operation. ZONING AND GENERAL PLAN CONSISTENCY The proposed use is consistent with the Zoning Ordinance and General Plan. The site is located in the I -Zone, Industrial (formerly "M" zone). GeoGreen is considered a recycling facility. A "recycling facility" is defined in Section 26.2.11 of the Comprehensive Zoning Ordinance as a facility that recycles used or waste materials in order to convert and redistribute them as raw materials, or in order to convert them and manufacture a product made wholly or partly from recycled materials, including a biodiesel facility. For these purposes, "recycling" means "a process involving reconstituting materials that would otherwise become waste and returning them to the economic mainstream in the form of raw materials for new reuses or reconstituted products which meet the quality standards necessary to be used in the marketplace." The term "recycling facility" does not include recycling activities undertaken as an Ancillary Use to a Permitted Use. Therefore, a recycling facility is an allowed use in the I -Zone with approval of a conditional use permit. CUP TERM LIMITATION It is proposed that the CUP be amended to limit its term to 5 years. At least 6 months before the expiration date of this CUP amendment, GeoGreen may re -apply for a new CUP provided it has met all of the conditions of the existing CUP. 0 CEOA ANALYSIS The issuance of this CUP amendment is categorically exempt from the California Environmental Quality Act pursuant to CEQA Guidelines California Code of Regulations, title 14, section 15301, because it involves minor alterations of an existing facility involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination; the only expected construction would be interior alterations to install additional equipment in the 6011 Building in order to be able to produce biodiesel and fulfill the original objectives of the company. Furthermore, the existing use has been determined not to have a significant effect on the environment because it is surrounded by similar commercial, industrial and warehousing uses. The proposed CUP amendment would result in a lower impact on the environment than the permitted use under the current CUP insofar as the proposed use would have less odor and reduced traffic. A Notice of Exemption will be prepared and filed with the County Clerk. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the proposed operations. No operations will begin until all permits have been issued and maintained in good standing. STAFF FINDINGS A conditional use permit and amendments thereto shall only be granted if the following findings as required by Section 26.6.3-4 of the Vernon Zoning Code can be made. Staff concludes that the following findings can be made, and recommends that they be made in the following manner: a. The lot for the proposed use is adequate in size, shape and topography, including any required drainage and landscaping; No changes in the physical nature of the lot or building footprint are being made. The lot for the proposed use is adequate in size, shape, and topography for a recycling facility because the owner has not proposed any changes to the size, shape or topography of the existing site. b. The use permitted under the conditional use permit will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the lot in question; The project proposes a recycling facility within an existing structure. The project site is surrounded by industrial and warehousing uses compatible with the proposed use. Similar to other surrounding uses, an initial study and negative declaration were conducted and approved for the project when GeoGreen was first granted a conditional use permit in 2007. At that time, it was determined that the project would not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the lot in question. As proposed, this CUP amendment would result in a lower adverse impact on the environment than the permitted use under the current CUP insofar as the proposed use would have less odor and reduced traffic. 7 C. The proposed use will be compatible with the permitted uses of surrounding and adjacent properties; The proposed use is similar to other industrial uses in the area and will be compatible with the permitted uses of surrounding and adjacent properties because (i) recycling uses may be permitted in the I -Zone of the City with a conditional use permit; and (ii) the proposed use will meet the City's noise, odor and vibration standards to ensure that there will not be negative impacts on adjacent properties. d. The lot has adequate off-street parking and loading facilities for the proposed use; The existing building was constructed with fifty-five stall surface parking lot, five truck loading, and three truck parking stalls which meet the requirements of the code. There will be no change in off-street parking and loading facilities. No changes in the physical nature of the lot or exterior of the building are being made. With the conditions imposed, all parking activities will be maintained within GeoGreen's premises, the loading facilities will be adequate and will not interfere with customer parking, and the proposed use will not create an adverse impact on neighboring properties. The site's parking areas will be paved with an impermeable surface that will meet the City's applicable development standards. e. The use, as to location, operation and design, is consistent with the general plan, any applicable specific plan and the zoning regulations of the City of Vernon, including the city's policy considerations as to acceptable uses in the city; The proposed site is within the "I" zone which allows such recycling facilities as a conditional use. The proposed use would be self-contained within the confines of the building with sufficient parking and loading on -site. As such the proposed use would not conflict with the surrounding existing industrial and warehousing uses that are compatible with the proposed operation. The use may be continued provided that it does not expand its building footprint, and is not vacant in excess of two years. No structural alterations to the lot or building are proposed. As long as the applicant complies with these terms, the conditional use permit will be consistent with the objectives of the Comprehensive Zoning Ordinance and the General Plan. f. The use is consistent with all applicable county, state, and federal laws, rules and regulations; The proposed use is compliant with all applicable local, county, state and federal laws, rules and regulations. No operations will be permitted until GeoGreen obtains all necessary and appropriate permits and approvals from applicable government agencies. g. The proposed use will not adversely affect the general welfare as a result of noise, increased traffic, interference with the flow of traffic, dust, or other undesirable characteristics; The proposed use will not undertake any structural alterations. The level of service of the existing road system will not be impacted by the proposed use. Therefore, the general welfare of the community will not be adversely impacted. All new equipment will be housed within the interior of a concrete tilt -up building which is designed to sufficiently buffer any noise from the equipment. Traffic flow will be staged such that only one truck will be present at the existing loading/offloading station at any given time. GeoGreen will be able to accept truck deliveries and offload to trucks during off-peak hours including nights and weekends when feasible in order to minimize truck traffic. During normal business hours, truck traffic will not interfere with other nearby business neighbors as approved pursuant to the existing CUP. Only CalTrans approved fuel/tanker trucks will be used. All materials will be pumped to or from the facility to tanker trucks parked 25 feet away from the facility in the existing truck loading space. Such operations will not adversely interfere with the flow of traffic in the area. It is anticipated that there will be an average of 8 — 10 employees total per shift at the facility which will use parking on -site. No off-street parking will be needed. h. The conditions stated in the decision are deemed necessary to protect the public health, safety and general welfare. All of the conditions imposed on the project are necessary to protect the public health, safety and general welfare because the conditions are limited in nature, and ensure that the property is used in the manner promised by the applicant. It is recommended that the current conditions of approval as approved in Resolution No. 9195 and 9614 remain except condition c. Condition c will be amended to read as follows: c. Any hazardous substances used, handled and/or stored at 6011 and/or 6017 Malburg Way shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained if there are any reportable quantities of hazardous materials at any time. All hazardous materials shall be confined to the 6011 and 6017 Malburg Way site. The following additional conditions will be added as conditions r, s, t, u and v: r. GeoGreen and any successors in interest shall indemnify, hold harmless and defend the City of Vernon, its officers, agents and employees from and against any and all claims, complaints or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the active negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. S. Not later than twenty (20) days from the date of approval of this conditional use permit amendment, GeoGreen shall indicate, in writing, its acceptance of and agreement with the conditions herein. The site is developed with a 50,000 square foot, dock -high, concrete tilt -up, industrial building. The remainder of the lot is paved. The proposed project will occupy approximately 9,351 square feet of the existing building. There is a very small amount of landscaping along Malburg Way. The structures and site have no cultural, historic, or scenic significance. The property is in the middle of a large industrial park. Trucks & Loading Current GeoGreen CUP (City of Vernon Resolution 9195) was approved based on the previously submitted CUP application which indicated that GeoGreen would "import used restaurant oil in dedicated tank trucks (similar to F800, 16' length, 2,000 gal capacity)." This is no longer the case with this new CUP addendum application. GeoGreen will not use small dedicated tanker trucks to bring in used restaurant oil. GeoGreen sold its waste vegetable oil collections business and sold all three of its smaller (2,000 gal) tanker trucks. GeoGreen does not collect waste vegetable oil from restaurants or food operations. Instead, GeoGreen will only purchase large volumes (6,000 gal per delivery) of cleaned vegetable oil from an aggregator of used, but clean (free of odor, particulate and water) vegetable oil. This new strategy is advantageous to GeoGreen, the City of Vernon, LBA Realty and nearby tenants because traffic flow will be reduced and there will not be any odor problems associated with incoming material processed at GeoGreen. Traffic flow will be staged such that only 1 truck will be present at the existing loading/offloading station at any given time. Vegetable oil processing at 6011 Malburg Way will operate an estimated 4 days per week, 24 hours per day. The existing biodiesel operation at 6017 Malburg Way is expected to operate up to 7 days per week, 24 hours per day. Both 6011 and 6017 operations share the same (existing) loading and off-loading stations. The Company will be able to accept truck deliveries and off load to trucks during off peak hours including nights and weekends when feasible in order to minimize truck traffic. However, even during normal business hours, truck traffic will not interfere with other nearby business neighbors as approved per the existing CUP. The following truck traffic is associated with operations related to 6011 Malburg Way: • Incoming clean vegetable oil — average of 2-3 truckloads per day for 45 minutes per delivery • Outgoing biodiesel from existing 6017 process — 1 truckload per day for 1 hour • Free fatty acid — average of 1 truckload every 2.5 weeks for 1 hour • Supplies or equipment to the loading dock — occasional; one truck every 3 weeks for 15 — 30 minutes Only CALTRANS approved fuel/tanker trucks will be used. All materials will be pumped to or from the facility to tanker trucks parked 25' away from the facility in the existing truck loading space. 2. Automobile Parking It is anticipated that there will be an average of 8 — 10 employees total per shift at the facility (both 6011 and 6017 Malburg Way). Overview GeoGreen's existing Conditional Use Permit (CUP) (City of Vernon Resolution 9195) for two adjacent and connected buildings (6017 and 6011 Malburg Way) allow for storage, processing and production of biodiesel. Currently, storage tanks and process equipment are located at 6017 and a chiller and air compressor are located at 6011. However, the Company needs to install additional equipment in the 6011 building in order to be able to produce biodiesel and fulfil the original objectives of the Company. It is not possible for GeoGreen to produce biodiesel without installing additional process equipment in the 6011 building. The purpose of this existing CUP addendum application is to allow GeoGreen to install additional processing equipment and above ground storage tanks in the 6011 building. This current application addendum to our existing CUP is a request for GeoGreen to process vegetable oil for use as a feedstock for its existing biodiesel process. Whereas GeoGreen leases office space at both 6017 and 6011 Malburg Way, the majority of GeoGreen's current biodiesel equipment is in the 9,351 ft. space located at 6017. This CUP application addendum pertains only to the 9,351 sq. ft. space located at 6011 Malburg Way. 1.1. Clean waste vegetable oil as a feedstock delivered to GeoGreen GeoGreen has installed a centrifuge at a separate company located in Anaheim, CA and has an agreement to process up to 200,000 gallons of waste vegetable oil for GeoGreen. The company will remove particulate, odor and water from the waste vegetable oil through centrifugation, filtration and settling. The purpose of this long term contractual agreement is to ensure that GeoGreen only handles clean (free of particulate, water and odor) vegetable oil. 1.2. New process equipment for the removal of free fatty acid from cleaned vegetable oil Cleaned vegetable oil delivered to GeoGreen will be free of particulate, water and odor, but will contain approximately 5% free fatty acid (FFA). FFA is simply the non -hazardous byproduct of vegetable oil (triglyceride). The following simplified expression is an example of a relationship between triglyceride oil and FFA where "R" is typically a 12-18 carbon atom chain. FFA is expected to be approximately 5% of the incoming cleaned vegetable oil. The purpose of the new equipment installation at 6011 is for removal of FFA from incoming cleaned vegetable oil (from 5% to < 0.5%). The FFA will be removed from the GeoGreen storage tank approximately once every 2.5 weeks via one 6,000 gallon truck offload at the existing 6017 offload station. 1.3. New main process equipment does not use large volumes of hazardous chemicals The FFA Stripping System is a unique way for a biodiesel operation to process or remove FFA. The majority of biodiesel companies use large volumes of methanol and methylate in a chemical pretreatment process to convert FFA in vegetable oil to biodiesel. However, GeoGreen designed a unique FFA stripping system in order to avoid using large volumes of hazardous chemicals at the 6011 location. The only chemical required at 6011 is very low volumes of sodium hydroxide to clean the associated water condenser located within the FFA stripping system. Instead of large volumes of chemicals, the FFA stripping system proposed at GeoGreen uses steam and vacuum in order to remove FFA from vegetable oil. A small boiler is required to provide steam to the new FFA stripping system. The boiler size requirement is small enough to be considered exempt from the Air Quality Management District (AQMD) permit approval process. Since the boiler requires less than 2M BTU/hour, only AQMD notification is required. 1.4. GeoGreen will safely operate and maintain its equipment GeoGreen's primary objective is safety. The Company will comply with all City of Vernon permitting and operating requirements. GeoGreen's internal safety program and training will meet or exceed OSHA safety guidelines. The Company will also comply with Los Angeles Comity Department of Sanitation procedures regarding water discharge. 2. Process and Equipment Description Utility upgrades and additional process equipment are required at the 6011 Malburg Way location. 2.1. Utility Upgrades Electrical switch eg ar upgrade Currently, a 400 Amp panel is installed inside the 6011 building. The 400 Amp panel will need to be replaced with an 800 Amp panel in the same location. GeoGreen has already submitted a permit application (Switchboard Replaccement for GeoGreen Biofuels) to the City of Vernon for plan check (Plan Check No. 89629). Natural gas service There is currently no natural gas provided to the 6011 building. However, there is a main natural gas line on Malburg Way which can easily and safely be brought into the 6011 building by the City of Vernon. City representatives have visited GeoGreen and stated that it will be relatively easy to install the required small natural gas line. The amount of natural gas required is fairly small at <2M BTU/hr since it will feed a relatively low horsepower (48 HP) boiler. Process Equipment See attached Process Flow Diagram: Vegetable Oil Free Fatty Acid (FFA) Removal System Free Fatty Acid Stripping System The FFA Stripping system will use cleaned vegetable oil as a feed stream at a maximum of 650 gallons per hour (GPH) and steam at 450 pounds per hour (PPH). Output is FFA stripped vegetable oil which is pumped to one of two new 7,000 gallon holding tanks, then transferred to the existing Greenline biodiesel process (6017 side). Another output stream is water at 50 gallons per hour. The water will be transferred to a new 7,000 gallon effluent holding tank and then metered to drain after monitoring approval prior to discharge. A water discharge permit will be required by the Los Angeles County Department of Sanitation. GeoGreen submitted an FFA stripping skid structural permit application (Service & Vessel Support Platform) or plan check to the City of Vernon (Plan Check No. 89769). 48 Horsepower (HP) Boiler A small 330 sq. ft. room with one hour fire rated walls will be constructed to allow for installation of a new 48 HP boiler (currently being fabricated by Parker Boiler). This boiler is an AQMD pre -approved system that does not require an AQMD permit because the system is a safe, new low NOx unit and uses less than 2M BTU/hour of natural gas. Structural engineering plans were submitted to the City of Vernon on 3/24/14 for plan check review. Storms Tanks Six (6) 7,000 gallon above ground storage tanks will be installed on the North side of the 6011 building as shown on the attached Site Plan drawing. The tanks will be anchored to the new concrete pad per approved structural drawings pending plan check by the City of Vernon. The 6017 building currently has Fourteen (14) 7,500 gallon storage tanks approved per the existing CUP; the storage requirement at 6011 is much lower than storage volume already approved at 6017. Storage tank structural engineering plans were submitted to the City of Vernon on 3/24/14 for plan check review. Storage tank components: Tanks 1 and 2: Cleaned vegetable oil hold prior to sending to the FFA skid Tanks 3 and 4: Cleaned and FFA stripped vegetable oil prior to sending to the existing Greenline biodiesel system at 6017. Tank 5: FFA from the FFA skid prior sending an to truck offload through the existing offloading station located at 6017. Only one truck will be offloaded approximately every 2.5 weeks. Filter media will likely be cellulose which is a safe and inert filter media. Future Storage Tanks The attached site plan shows two additional future storage tanks. These additional storage tanks will be used for storage of biodiesel pre -filtration and post -filtration. Hazardous Materials Used The Free Fatty Acid Stripping system proposed for location at 6011 Malburg Way does not require the use of any flammable or hazardous materials for the main process. The main process uses a strong vacuum (26 in Hg gauge) created by motive steam and a vacuum pump to strip FFA from vegetable oil. In order to clean the associated condenser tubes, an optional 0,1 gallons per hour of 50% sodium hydroxide (NaOH) solution may be pumped into the condenser tubes to prevent scale buildup. The FFA stripping system will operate 24 hours per day for 4 days per week. In an entire month, a maximum of only 38 gallons (0.1 gal/hr x 24 hrs/day x 16 days per month) of 50% NaOH will be used. Sodium hydroxide is the most commonly used chemical base material in industry and is often used as a household drain cleaner. Sodium hydroxide is safe when the proper handling procedures are used. Material handling and spill prevention procedures will be described in a revised and approved Spill Prevention Control and Countermeasures (SPCC) plan prior to operation. The attached Site Plan drawing shows the addition of two future storage tanks which will each be a maximum of 7,000 gallons. These tanks will be used simply to filter biodiesel with an associated filtration system. The biodiesel will be pumped from the 6017 building, filtered at 6011 and then returned to the 6017 building. Biodiesel is non -toxic, biodegradable and is non-flammable (has a flash point of over 260 degrees F). Material handling and spill prevention procedures will be described in a revised and approved Spill Prevention Control and Countermeasures (SPCC) plan prior to operation. 2. Storage A maximum of only two (2) 55 gallon drums of 50% sodium hydroxide will be stored on site. The drums will be properly labeled and be stored in appropriate locations as required by the City of Vernon Environmental Health Department. 3. Transportation and Handling Individual 55 gallon drums of sodium hydroxide will be delivered to the GeoGreen loading dock and then moved by pallet jack to a safe storage location. When a drum is to be used, it will be moved safely with a pallet jack to the staging location. Operators will wear appropriate Personal Protective Equipment (PPE) when staging the drums for use. A spill resistant tube system will be inserted into the drum to transfer it to the process equipment via a safe and compatible peristaltic pump. After use, the empty 55 gallon drums will be picked up or safely returned to the chemical supplier per safe handling procedures. 4. Emergency Plan and Accidental Spill Procedure An emergency plan including an accidental spill procedure will be described in a revised SPCC.
