A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AN AMENDMENT TO THE MITIGATED
NEGATIVE DECLARATION RESOLUTION NO. 2013-31 AND
APPROVING A LOT MERGER FOR THE PROPERTIES LOCATED
AT 4675 52ND DRIVE IN THE CITY OF VERNON
WHEREAS, property located at 4675 52°d Drive, portion of
assessor's parcel number 6314-002-900, is owned by the City of Vernon
and has been designated for the proposed housing development, Vernon
Village Park; and
WHEREAS, the property currently consists of nine ,(9) separate
contiguous lots; and
WHEREAS, the California Building Code does not allow for
construction across property lines, therefore, for development purposes
the lots should be merged into one lot as set forth in the lot merger
document, attached hereto as Exhibit "B" and by this reference
incorporated herein; and
WHEREAS, said housing development project was approved under
Mitigated Negative Declaration Resolution No. 2013-31 and said lot
merger is best accomplished with an amendment to said Resolution; and
WHEREAS, pursuant .to the subdivision ordinance of the Vernon
Municipal Code, Section 28.50(b), the Director of Public Works,
Water & Development Services has the authority to issue a Certificate
of Compliance for a Voluntary Lot Merger; and
WHEREAS, by memorandum dated June 17; 2014, the Director of
Public Works, Water & Development Services has recommended, in order to
comply with the California Building Code, that a lot merger be recorded
merging the subject parcels into one, and the Mayor and the Director of
Public Works, Water & Development Services be authorized to execute and
record all the necessary documents to merge the subject lots.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon hereby
finds that the approval of the lot merger is an essential part of the
underlying project that was analyzed and approved in Mitigated Negative
Declaration, Resolution No. 2013-31.
SECTION 3: FINDINGS
a. The City of Vernon has determined that an addendum is
warranted for said lot merger, finding that none of the conditions set
forth in CEQA Section 15162 are in.evidence and that there is no
substantial evidence, in light of the whole record before the City,
that the amendment proposal will have a significant effect on the
environment.'
b. The Addendum to the Negative Declaration, attached hereto
as Exhibit "C" and by this reference incorporated herein with its
supporting documentation, reflects the independent judgment and
analysis of the City of Vernon.
C. The City of Vernon finds that the revised project will not
cause any potentially significant effect on the environment.
SECTION 4: An Amendment to the Mitigated Negative Declaration
is hereby approved. Accordingly, the City Council hereby directs the
Director of Public Works, Water & Development Services, or the
Director's designee, to file a Notice of Exemption for the amendment to
the project's Mitigated Negative Declaration with the County Clerk of
the County of Los Angeles.

SECTION 5: The City Council of the City of Vernon hereby
approves the Application for a Request for a Voluntary Lot Merger and
Waiver of Rights of Hearing and Notice (the "Application"), in
substantially the same form as the copy which is attached hereto as
Exhibit A and by this reference incorporated herein.
SECTION 6: The City Council of the City of Vernon hereby
authorizes the Mayor or Mayor Pro-Tem to execute said Application and
all other necessary documents to merge the subject lots for, and on
behalf of the City of Vernon, and the City Clerk or Deputy City Clerk
is hereby authorized to attest thereto.
SECTION 7: The City Council of the City of Vernon hereby
authorizes the Director of Public Works, Water & Development services
to execute a Certificate of Compliance and all other necessary
documents to merge the subject lots.
SECTION 8: All portions of Resolution 2013-31 shall remain
in place, unaffected, except as set forth in this Resolution.

SECTION 9: The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions of
the Council of this City.

Subdivision Map Act (California Government Code Section 66499.20.3) for the voluntary merger
of contiguous parcels under common ownership and with Section 28.50(b) of the Vernon City
Code, and the creation of the newly configured parcel is exempt from the Parcel Map
requirements of the California Subdivision Map Act pursuant to the above -cited sections.
(c) Nothing in this Certificate: (i) abrogates or eliminates existing easements recorded against the
above listed lots by prior instrument; (ii) exempts those lots from requirements of all existing
permits and other grants of approval from the City of Vernon and other public entities; or (iii)

AMENDMENT TO PROJECT DESCRIPTION, SECTION 2.8
Section 2.8 of the Initial Study/Mitigated Negative Declaration is revised to provide:
"The proposed project consists of:
A proposed 45-unit affordable housing development at 4675 52Id Drive;
A proposed Development Agreement (DA) and Disposition and Development Agreement
(DDA) relating to the housing development; and
General Plan and Zoning Code and Map Amendments required to facilitate this development
as follows:
o Update to the Land Use Element to revise existing land use policy (which
discouraged new housing) and to include two new Overlays: Housing and Emergency
Shelter.
o Housing Element update (2014-2021) to comply. with State Housing Element law
regarding timely updates and to include information on potential housing sites for
consistency with the Land Use Element.
o The Housing Element identifies two sites where residential housing could be
permitted and one site where an emergency shelter could be permitted.
o Revisions to the Zoning Ordinance to create implementing zoning overlays for new
General Plan land use designation overlays and/ or policies: Housing and Emergency
Shelter.
o Amendment to the Zoning Map to apply the Housing and Emergency Shelter
Overlays to specific properties."
Each of these components was discussed in detail in the Initial Study/MND. For the purposes of
the Mitigated Negative Declaration, the housing project at 4675 52nd Drive, required
entitlements, and all related General Plan and Zoning amendments were collectively referred to
as "the Droiect."
AMENDMENT TO "THE PROJECT"
The property currently consists of nine (9) separate contiguous lots (see Attachment B of the lot
merger staff report dated June 17, 2014). The California Building Code does not allow for
construction across property lines; therefore, for the underlying project's development purposes,
the lots should be merged into one lot. Therefore, to comply with the California Building Code, a
lot merger is to be recorded merging the subject parcels into one. There will be no change to the
underlying project's environmental impacts or to the mitigation measures contained therein.
EVALUATION OF THE ADDENDUM
CEQA Guidelines Section 15164(b) provides, that an addendum to an adopted ,negative
declaration may be prepared if only minor technical changes or additions are necessary and none
of the conditions described in Section 15162 calling for the preparation of a subsequent EIR or
negative declaration have occurred. An addendum is appropriate because the proposed lot
merger, a discretionary action by the City, is a minor technical change which was anticipated but
not specifically called out in the MND. The proposed lot merger is an essential part of the
underlying project.because the City is responsible for creating a legal parcel for the site and the
merger will be necessary to permit construction to take place.
The environmental analysis, mitigation measures, and impacts identified in the MND remain
substantively unchanged by the lot merger. This proposed project does not result in any new
impacts and does not exceed the level of impacts identified in the MND in that there is no project
modification or physical changes on the property that would change the environmental analysis.
In preparing this addendum, all potential impacts identified in the CEQA environmental
checklist form were considered. For all impact areas, staff s review indicates that the proposed
lot merger is consistent with the original design of the project and there is no new information
put forth that would change the environmental analysis.
DETERMINATION
On February 19, 2013, the City Council approved the MND. Based upon a review of the
proposed amendment to the project, it has been determined that an addendum is appropriate
because the amendment is minor, and none of the following conditions (pursuant to CEQA
Section 15162) have occurred:
1. Substantial changes are proposed for the project that will require major revision of the
previous Negative Declaration due to new, significant environmental effects or a substantial
increase in the severity of previously identified effects.
2. Substantial. changes occur with respect to the circumstances under which the project is
undertaken that involve new, significant environmental effects or a substantial increase in the
severity of previously identified effects.
3. New information of substantial importance indicates that:
a. The project will have one or more significant effects not discussed in the previous
Negative Declaration.
b. Significant effects previously examined will be substantially more severe than shown in
the previous Negative Declaration:
C. Mitigation measures or alternative previously found not to be feasible would in fact be
feasible and would substantially reduce one or more significant effects of the project, but the
project proponents, decline to adopt the mitigation measure or alternative; or
d. Mitigation measures or alternative which are considerably different from those analyzed
in the previous Negative Declaration would substantially reduce one or more significant effects
on the environment, but the project proponents decline to adopt the mitigation measure or
alternative.

Recommendation
It is recommended that the City Council adopt a resolution that, among other things:
1. Amends the Mitigated Negative Declaration, Resolution No. 2013-31 ("MND"); and
2. As owners of the property:
a. Authorizes the Mayor to sign and notarize the enclosed "Application for a Request for a
Voluntary Lot Merger and Waiver of Right of Hearing and Notice," and all other
necessary documents to merge the subject lots.
b. Authorizes the Director of Public Works, Water & Development Services to execute a
Certificate of Compliance for a Lot Merger for property development purposes, and all
other necessary documents to merge the subject lots.
Backeround
The subject property which is located at 4675 52"d Drive, portion of assessor's parcel number 6314-002-
900, is owned by the City of Vernon and has been designated for the proposed housing development,
Vernon Village Park. The property currently consists of nine (9) separate contiguous lots (see Attachment
B of the lot merger document). The California Building Code does not allow for construction across
property lines; therefore, for development purposes the lots should be merged into one lot.
Because the merger of lots is a discretionary action on the part of the City, it is recommended that the
MND be revised. The amendment meets all of the requirements of the California Environmental Quality
Act ("CEQA") pursuant to CEQA Guidelines Section 15164(b) of the California Code of Regulations
Title 14.
As established in the recently amended subdivision ordinance of the Vernon Municipal City Code,
Section 28.50(b), the Director of Public Works, Water & Development Services has the authority to issue
a Certificate of Compliance for a Voluntary Lot Merger. Therefore, in order to comply with the
California Building Code, it is recommended that a lot merger be recorded merging the subject parcels
into one, and the Mayor or Mayor Pro -Tern and the Director of Public Works, Water & Development
Services be authorized to execute and record all the necessary documents to merge the subject lots.
Fiscal Impact
Approval of the proposed Lot Merger has no fiscal impact.

Vernon, am authorized to act on behalf of the City of Vernon in the issuance of this Certificate. I do
hereby certify as follows:
(a) The location of the boundary line(s) dividing the 9 lots described in Attachment "A" and shown on
Attachment "B" of Exhibit "A" is/are hereby deleted so as to merge the lots into one parcel as described
in Exhibit "B" and shown on Exhibit "C" attached to this Certificate and by this reference incorporated
herein.
(b) The new parcel created by this voluntary merger complies with the requirements of the Subdivision
Map Act (California Government Code Section 66499.20.3) for the voluntary merger of contiguous
parcels under common ownership and with Section 28.50(b) of the Vernon City Code, and the creation of
the newly configured parcel is exempt from the Parcel Map requirements of the California Subdivision
Map Act pursuant to the above -cited sections.
(c) Nothing in this Certificate: (i) abrogates or eliminates existing easements recorded against the above
listed lots by prior instrument; (ii) exempts those lots from requirements of all existing permits and other
grants of approval from the City of Vernon and other public entities; or (iii) eliminates the requirement to
obtain all required permits and other grants of approval from the City of Vernon and other public entities,
that have not already been issued or granted for additional development or redevelopment of the newly
reconfigured parcel.
