Resolution No. 2014-043RESOLUTION NO. 2014-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING EXHIBIT A OF RESOLUTION NO. 2013-57 REGARDING THE COMPENSATION, COSTS AND BENEFITS OF ITS EMPLOYEES ("CITYWIDE PERSONNEL AND SALARY RESOLUTION") (AMENDMENT NO. 9) WHEREAS, on June 18, 2013, the City Council of the City of Vernon adopted Resolution No. 2013-57, regarding the compensation, costs and benefits of its employees, which has subsequently' been amended by Resolution Nos. 2013-66, 2013-90, 2014-07, 2014-12, 2014-14, 2014-25, 2014-27 and 2014-33 (the "Citywide Personnel and Salary Resolution"); and WHEREAS, Section 5 (Auto Insurance Program) of the Citywide Personnel and Salary Resolution provides that employees who participate in said program shall receive $35.00 per month; and WHEREAS, by memorandum dated July 1, 2014, the City Administrator has recommended that Section 5 of the Citywide Personnel and Salary Resolution be amended to discontinue the $35.00 per month Auto Insurance Program for employees in classifications designated as Executive, Management, Confidential, Mid -Management, and Vernon Police Management Association employees; and WHEREAS, the City Council of the City of Vernon desires to amend Section 5 (Auto Insurance Program) of the Citywide Personnel and Salary Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. SECTION 3: Effective July 1, 2014, Section 5 of the Citywide Personnel and Salary Resolution is hereby amended in its entirety to read as follows: SECTION 5: AUTO INSURANCE PROGRAM. The City has established an auto insurance program pursuant to Resolution No. 5294. All employees, except employees in classifications designated as Executive, Management, Confidential, Mid -Management, and Vernon Police Management Association employees, who participate in said program effective July 1, 2014, will receive Thirty -Five Dollars ($35.00) per month per employee from the City. Such payment shall not be payable whenever the employee is on vacation, leave of absence, or otherwise absent the entire calendar month, unless otherwise specified by the City Council. SECTION 4: The provisions of Resolution No. 2013-57, as amended by Resolution Nos. 2013-66, 2013-90, 2014-07, 2014-12, 2014-14, 2014-25, 2014-27, and 2014-33 not consistent with or in conflict with this resolution are hereby repealed; in all other respects, Resolution Nos. 2013-57, 2013-66, 2013-90, 2014-07, 2014-12, 2014-14, 2014-25, 2014-27, and 2014-33 shall remain in full force and effect. - 2 - SECTION 5: The City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the City Clerk's, or Deputy City Clerk's; certification to be entered in the File of Resolutions of the Council of this City APPROVED AND ADOPTED this 1st day of July, 2014. Whitworth, City Administrator RE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 2013-57 REGARDING THE COMPENSATION, COSTS AND BENEFITS OF ITS EMPLOYEES ("CITYWIDE PERSONNEL AND SALARY RESOLUTION" — AMENDMENT NO.9) Recommendation It is recommended that the City Council: 1) Find that approval of the proposed resolution in this staff report is exempt.under the California Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment. 2) Adopt the attached resolution amending Section 5 (Auto Insurance Program) of Resolution No. 2013-57, to discontinue the $35.00 per month Auto Insurance Program for employees in classifications designated as Executive, Management, Confidential, Mid -Management, and Vernon Police Management Association employees, effective July 1, 2014. Backaround Section 5 (Auto Insurance Program), of Resolution No. 2013-57 provides that employees who participate in the Auto Insurance Program shall receive $35.00 per month. The Auto Insurance Program was established effective July 1, 1986. The program was offered to City of Vernon employees as a method to encourage safe driving habits and incentivize employees to obtain auto insurance during an era in which auto insurance coverage was not mandated by law. Analysis The City of Vernon recently completed a total compensation survey as a result of the Citywide classification and compensation study conducted by Public Sector Personnel Consultants. As part of the total compensation survey, an Auto Insurance Program offered to employees as a benefit or incentive was not found in any other cities in the comparable labor market. In addition, California Vehicle Code Section 16028 requires every driver to furnish proof of insurance for his or her motor vehicle. If a driver does not or cannot provide evidence of auto insurance, a driver is guilty of an infraction of Vehicle Code Section 16028. The City of Vernon Auto Insurance Program is an outdated benefit program and is no longer considered a justifiable benefit incentive due to changes in federal and state laws mandating employees to possess auto insurance. City employees are required to adhere to City policies, procedures, and state and local laws. It is therefore recommended that the $35.00 per month Auto Insurance Program be discontinued for the Executive, Confidential, Management, Mid -Management and Police Management employees as a result of the above findings. In accordance with the Meyers-Milias Brown Act, City staff met and conferred with Vernon Police Management representatives regarding the elimination of this benefit. Employees in classifications designated as Executive, Confidential, Management and Mid -Management are not designated for purposes of recognition and representation in collective bargaining, and are therefore not subject to the provisions of the Meyers-Milias Brown Act. The City Administrator and Director of Human Resources previously held a meeting with Confidential, Management and Mid -Management employees to inform them of the proposed elimination of the Auto Insurance Program. Staff intends to introduce future revisions to discontinue the Auto Insurance Program for other employee groups upon final negotiations of memoranda of understanding with the various bargaining units. Fiscal Impact An annual cost savings of approximately $19,320 would result from the discontinuation of the $35.00 per month Auto Insurance Program for the Executive, Management, Confidential, Mid - Management and Vernon Police Management Association employees. In lieu of the Auto Insurance Program, alternative benefit enhancements for employees are being considered and these savings would be used to offset those costs.
