A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON VACATING A PORTION OF SEVILLE AVENUE BETWEEN
LEONIS BOULEVARD AND FIVE FEET SOUTH OF THE
SOUTHERLY LINE OF FORMER 50TH STREET AND ADOPTING A
NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, that certain portion of Seville Avenue,
approximately 26,147 square -feet of land located within the City of
Vernon is deemed no longer necessary for present or prospective street
purposes; and
WHEREAS, said portion of Seville Avenue was dedicated to the
City of Vernon for street purposes as part of the acceptance of
Resolution No. 350 and Grant Deed in 1925; and
WHEREAS, said portion of Seville Avenue has been closed to
through traffic since 2007 in order to provide appropriate security at
the Malburg Generating Station during heightened terrorism concerns;
and
WHEREAS, said portion of said street does not constitute
major traffic arteries or collector streets, are not useful as non -
motorized transportation facilities, and are unnecessary for present
or prospective public use except that public utility, public agency,
fire fighting and railroad easements need to be reserved and accepted
therein; and
WHEREAS, the City Council has examined the location,
purpose, and extent of said portion of said street and has reviewed
the conformity of said proposed vacation with the General Plan and the
Zoning Ordinance of the City of Vernon; and
WHEREAS, the Public Works, Water and Development Services
Department issued an Initial Study dated October 28, 2015, to
determine whether the proposed project will have adverse impacts on
the environment and has determined that the proposed project will not
have a significant adverse effect on the environment, and the Director
of Public Works, Water and Development Services has recommended that a
Negative Declaration be adopted in compliance with the California
Environmental Quality Act ("CEQA"); and
WHEREAS, the City of Vernon has provided notice of its
intent to adopt a Negative Declaration for the proposed project and
has provided a public review period of not less than 20 days, as
required by the California Environmental Quality Act and the State
CEQA Guidelines; and
WHEREAS, the City Clerk published a notice of the public
hearing in accordance with Government Code Section 6066 in the Vernon
Sun, which was determined to be a newspaper of general circulation; and
WHEREAS, on December 15, 2015, the City Council of the City
of Vernon held a public hearing on the consideration of the vacation of
a portion of Seville Avenue; and
WHEREAS, vacation procedures have been completed in
accordance with Division 9 of the Streets and Highways Code, otherwise
known as the Public Streets, Highway and Service Easements Vacation
Law; and
WHEREAS, the City Council has heard and considered all
evidence, both written and oral, presented in consideration of the
proposed vacation of a portion of Seville Avenue, 26,147 square -feet
of land, between Leonis Boulevard and five feet south of the southerly
line of former 50th Street in the City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that the portion of Seville Avenue, 26,147 square -feet of land,
between Leonis Boulevard and five feet south of the southerly line of
former 50th Street in the City of Vernon, is no longer necessary for
public road purposes.
SECTION 3: The City Council of the City of Vernon finds
that the vacation of said portion of said street as described is in
the public interest.
SECTION 4: That the City of Vernon reserves and accepts
easements for public utilities and agencies, installation, and
maintenance purposes (a) to operate, maintain, renew and/or relocate
all existing wires, pipes and other utility facilities of like
character upon, over or under the surface of said real property; (b)
from time to time to construct, operate, maintain, renew and/or
relocate upon, over or under the surface of said real property,
additional facilities of the character described in clause (a) without
in any instance required to obtain consent.
SECTION 5: That the City of Vernon reserves and accepts
access easements for fire -fighting equipment and for fire inspection
purposes in Seville Avenue.
SECTION 6: That the City of Vernon reserves and accepts an
easement to Los Angeles Junction Railway (LAJ) and its successors to
maintain and operate a railroad crossing at its current location
within the vacated section of Seville Avenue but without the right to
erect or maintain any barriers blocking access to the adjacent fee.

SECTION 7: The City Council of the City of Vernon further
finds that all persons have had the opportunity to be heard or to file
written comments to the proposed Seville Avenue vacation and after due
consideration of all the evidence submitted at the public hearing
determines that there are compelling reasons to justify vacating a
portion of Seville Avenue, 26,147 square -feet of land, between Leonis
Boulevard and five feet south of the southerly line of former 50th
Street in the City of Vernon.
SECTION 8: The City Council of the City of Vernon further
finds on the basis of the whole record before it (including the
initial study) that there is no substantial evidence that the street
vacation will have a significant effect on the environment
individually or cumulatively, and that the Negative Declaration
reflects the City's independent judgment and analysis, and on the
basis of said findings the City Council hereby approves and adopts the
Negative Declaration for the street vacation in accordance with the
California Environmental Quality Act.
SECTION 9: The City Council of the City of Vernon hereby
approves the Initial Study dated October 28, 2015, a copy of which
documents have been submitted to the City Council concurrently
herewith, and the City Clerk, or Deputy City Clerk, is directed to
receive and file them. Such documents and other materials which
constitute the record of proceedings in this matter shall be
maintained in the office of the City Clerk who is and shall be the
custodian thereof.
SECTION 10: The City Council of the City of Vernon hereby
directs the City Clerk, or Deputy City Clerk, to file a Notice of
Determination in regard to the environmental impact of said street

vacation.
SECTION 11: The City Council of the City of Vernon does
hereby order the vacation of that portion of Seville Avenue, 26,147
square -feet of land, between Leonis Boulevard and five feet south of
the southerly line of former 50th Street, as described and shown on the
attached Exhibits A and B. The vacation of said portion of Seville
Avenue, 26,147 square -feet of land, is pursuant to the provisions of
Division 9 of the Streets and Highways Code of the State of California
(commencing with Section 8300) otherwise known as the Public Streets,
Highways and Service Easements Vacation Law.
SECTION 12: The City Clerk, or Deputy City Clerk, of the
City of Vernon is hereby instructed to cause a certified copy of this
Resolution of vacation, attested by the City Clerk, or Deputy City
Clerk, under the seal of the City of Vernon, to be recorded without
acknowledgement, certificate of acknowledgment, or further proof in
the office of the County Recorder of the County of Los Angeles, and
said recordation shall be exempt from recording fees.
SECTION 13: From and after the date on which this Resolution
is recorded with the County Recorder of the County of Los Angeles, the
vacation of a portion of Seville Avenue, 26,147 square -feet of land,
between Leonis Boulevard and five feet south of the southerly line of
former 50th Street, shall be complete and no
longer constituted as a street in the City of Vernon.

SECTION 14
The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions
of the Council of this City.

LEGAL DESCRIPTION OF VACATION
That portion of Lot 27 (Known as Seville Avenue) of Tract No. 6452, in the City of Vernon, County
of Los Angeles, State of California, as per map recorded in Book 94, Pages 77 and 78, in the Office of
the County Recorder of said County, more particularly described as follows:
Beginning at the Northwest corner of Lot 27; Thence east along the North line of said Lot 27 to the
Northeast corner of Lot 27, said North line also being the South line of Lot 22 (Known as Leonis
Boulevard) of said Tract No. 6452; Thence South along the East line of Lot 27 to a point in a line
which is parallel and distant Southerly 5 feet from the Northerly line of Lot 6 of said Tract; Thence

RECORDING FEE BULLETIN
The base fee for recording and indexing most documents, such as a deed, trust deed, reconveyance, declaration of homestead, etc., is:
$15 for the first page and $3 for each additional page or portion of a page. (Government Code Sections 27361, et seq.) A page is
one side of a sheet 8'/2" X 14" or smaller. Effective July 1, 1994 a page is one side of a sheet 8'/2° X 11 ". If any page does not
conform to these dimensions, there is a $3 extra charge for each page of the document containing the non -conforming page.
COMBINED DOCUMENTS (Government Code Sections 27361.1 & 27361.4)
When two or more documents are serially incorporated in one form or sheet, they will be recorded as two or more separate
documents. The base recording fee of $15 will be charged for the first page and $3 for each additional page for the entire
document. A $15 will also be assessed for each additional document required to be indexed.
INVOLUNTARY LIENS (Government Code Section 27297.5)
The amount of $9 will be charged in addition to the base fee for the first notice required to be sent to the individual against whom
the lien is recorded. Each additional notice required to be sent which pertains to the same lien will involve another charge of $2.
Involuntary liens are those liens not signed by the debtor against whom they are recorded, such as an abstract of judgment,
mechanic's lien, notice of assessment, notice of lien, court order, etc.
RELEASE OF GOVERNMENT LIEN (Government Code Section 27361.3 & 27361.4)
The total fee for recording every release of lien, encumbrance or notice executed by the State or any county, city, district or other
political subdivision is $16 if the original lien, encumbrance or notice was recorded without fee as provided for by Section 27383 of
the Government Code.
INDEXING FEE (County Code 2.32.350)
The charge for a document containing more than 10 names to be indexed will be the base fee plus $4 for each additional group of
10 names or portion thereof.
REFERENCING FEE (Government Code Section 27361.2)
The charge for a document containing references to previously recorded documents requiring additional indexing will be the base
fee plus $1 for each additional recording reference other than the first reference, which is included in the base fee.
PENALTY PRINT (Government Code Section 27361)
In addition to the base fee, $1 will be added for each page on which penalty print appears. Penalty print consist of wording added
to the printed form which is spaced either more than nine lines per vertical inch, has more than 22 characters and spaces per inch
measured horizontally, for not less than three inches in one sentence. This charge is not applicable to explanatory statements
providing instructions for completion of the blank spaces of a printed form.
20 DAY PRELIMINARY NOTICE (Civil Code 3097)
The filing fee for a 20 Day Preliminary Notice is $64.
DISTRICT ATTORNEY FRAUD (Government Code Section 27388)
$3 additional charge to the base recording fee for every Real Estate Instrument, paper, or notice except any "DEED" subject to a
Documentary Transfer Tax.
UNIFORM COMMERCIAL CODE (Government Code 12194)
The uniform fee for recording Financing Statement, Amendment, Continuation Statement, Termination Statement, Statement of
Release and Assignment shall be ten dollars ($10) if the statements consist of one (1) or two (2) pages and twenty dollars ($20)
for three (3) or more pages. May 19, 2006, charge $1 redaction fee for every instrument4itle, pursuant to Assembly Bill 1168.
Effective December 15, 2006, charge $1 eRecording fee for every instrument pursuant to Government Code § 27397 (C)
Subsection 1.
Effective January 1. 2013, charge $3 Real Estate Fraud Prosecution Fee for every document specified in SS 1342, pursuant to
Government Code Section 27368.

fire fighting and railroad easements need to be reserved and accepted
therein; and
WHEREAS, the City Council has examined the location,
purpose, and extent of said portion of said street and has reviewed
the conformity of said proposed vacation with the General Plan and the
Zoning Ordinance of the City of Vernon; and
WHEREAS, the Public Works, Water and Development Services
Department issued an Initial Study dated October 28, 2015, to
determine whether the proposed project will have adverse impacts on
the environment and has determined that the proposed project will not
have a significant adverse effect on the environment, and the Director
of Public Works, Water and Development Services has recommended that a
Negative Declaration be adopted in compliance with the California
Environmental Quality Act ("CEQA"); and
WHEREAS, the City of Vernon has provided notice of its
intent to adopt a Negative Declaration for the proposed project and
has provided a public review period of not less than 20 days, as
required by the California Environmental Quality Act and the State
CEQA Guidelines; and
WHEREAS, the City Clerk published a notice of the public
hearing in accordance with Government Code Section 6066 in the Vernon
Sun, which was determined to be a newspaper of general circulation; and
WHEREAS, on December 15, 2015, the City Council of the City
of Vernon held a public hearing on the consideration of the vacation of
a portion of Seville Avenue; and
WHEREAS, vacation procedures have been completed in
accordance with Division 9 of the Streets and Highways Code, otherwise
known as the Public Streets, Highway and Service Easements Vacation
Law; and
WHEREAS, the City Council has heard and considered all
evidence, both written and oral, presented in consideration of the
proposed vacation of a portion of Seville Avenue, 26,147 square -feet
of land, between Leonis Boulevard and five feet south of the southerly
line of former 50th Street in the City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that the portion of Seville Avenue, 26,147 square -feet of land,
between Leonis Boulevard and five feet south of the southerly line of
former 50th Street in the City of Vernon, is no longer necessary for
public road purposes.
SECTION 3: The City Council of the City of Vernon finds
that the vacation of said portion of said street as described is in
the public interest.
SECTION 4: That the City of Vernon reserves and accepts
easements for public utilities and agencies, installation, and
maintenance purposes (a) to operate, maintain, renew and/or relocate
all existing wires, pipes and other utility facilities of like
character upon, over or under the surface of said real property; (b)
from time to time to construct, operate, maintain, renew and/or
relocate upon, over or under the surface of said real property,
additional facilities of the character described in clause (a) without
in any instance required to obtain consent.
SECTION 5: That the City of Vernon reserves and accepts
access easements for fire -fighting equipment and for fire inspection
purposes in Seville Avenue.
SECTION 6: That the City of Vernon reserves and accepts an
easement to Los Angeles Junction Railway (LAJ) and its successors to
maintain and operate a railroad crossing at its current location
within the vacated section of Seville Avenue but without the right to
erect or maintain any barriers blocking access to the adjacent fee.

SECTION 7: The City Council of the City of Vernon further
finds that all persons have had the opportunity to be heard or to file
written comments to the proposed Seville Avenue vacation and after due
consideration of all the evidence submitted at the public hearing
determines that there are compelling reasons to justify vacating a
portion of Seville Avenue, 26,147 square -feet of land, between Leonis
Boulevard and five feet south of the southerly line of former 50th
Street in the City of Vernon.
SECTION 8: The City Council of the City of Vernon further
finds on the basis of the whole record before it (including the
initial study) that there is no substantial evidence that the street
vacation will have a significant effect on the environment
individually or cumulatively, and that the Negative Declaration
reflects the City's independent judgment and analysis, and on the
basis of said findings the City Council hereby approves and adopts the
Negative Declaration for the street vacation in accordance with the
California Environmental Quality Act.
SECTION 9: The City Council of the City of Vernon hereby
approves the Initial Study dated October 28, 2015, a copy of which
documents have been submitted to the City Council concurrently
herewith, and the City Clerk, or Deputy City Clerk, is directed to
receive and file them. Such documents and other materials which
constitute the record of proceedings in this matter shall be
maintained in the office of the City Clerk who is and shall be the
custodian thereof.
SECTION 10: The City Council of the City of Vernon hereby
directs the City Clerk, or Deputy City Clerk, to file a Notice of
Determination in regard to the environmental impact of said street

vacation.
SECTION 11: The City Council of the City of Vernon does
hereby order the vacation of that portion of Seville Avenue, 26,147
square -feet of land, between Leonis Boulevard and five feet south of
the southerly line of former 50th Street, as described and shown on the
attached Exhibits A and B. The vacation of said portion of Seville
Avenue, 26,147 square -feet of land, is pursuant to the provisions of
Division 9 of the Streets and Highways Code of the State of California
(commencing with Section 8300) otherwise known as the Public Streets,
Highways and Service Easements Vacation Law.
SECTION 12: The City Clerk, or Deputy City Clerk, of the
City of Vernon is hereby instructed to cause a certified copy of this
Resolution of vacation, attested by the City Clerk, or Deputy City
Clerk, under the seal of the City of Vernon, to be recorded without
acknowledgement, certificate of acknowledgment, or further proof in
the office of the County Recorder of the County of Los Angeles, and
said recordation shall be exempt from recording fees.
SECTION 13: From and after the date on which this Resolution
is recorded with the County Recorder of the County of Los Angeles, the
vacation of a portion of Seville Avenue, 26,147 square -feet of land,
between Leonis Boulevard and five feet south of the southerly line of
former 50th Street, shall be complete and no
longer constituted as a street in the City of Vernon.

SECTION 14:
The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions
of the Council of this City.

Recommendation
A. Adopt the attached resolution vacating a portion of Seville Avenue between Leonis Boulevard
and 50`h Street; and
B. Adopt a Negative Declaration finding that the project will not have a significant impact on the
environment, or to the extent potentially significant effects exist, and there is no substantial
evidence, in light of the whole record before the City, that the project may have a significant
effect on the environment within the meaning of the California Environmental Quality Act
(CEQA); and
C. Authorize the City Clerk to record the adopted resolution and to file a Notice of Determination
with the County Clerk.
Background
The City of Vernon intends to vacate a portion of Seville Avenue from Leonis Avenue to the previously
vacated 50t' Street as described and shown in Exhibits "A" and `B". In accordance with Division 9 of
the Streets and Highways Code (commencing with Section 8300) otherwise known as the Public Streets,
Highways and Service Easements Vacation Law, the City of Vernon has the authority to vacate the
street.
Seville Avenue was created in 1924 as part of the approval of Tract No. 6452 recorded in map book 94-
77-78, a copy of which is attached as Exhibit "C". J. B. Leonis, Inc., a California Corporation, granted
this street to the City of Vernon in 1924 as a 40 foot right of way per the deed attached as Exhibit "D".
The portion of Seville Avenue dedicated by Tract Map No. 6452 runs north -south and starts at a "T"
intersection with Fruitland Avenue on the south and continues north to a "T" intersection with 46"' Street.
The street was later extended north as part of other Tract Maps. The City of Vernon acquired Lot 7 of
Tract No. 6452 in August 1931 for the purposes of constructing a municipal electric generating power
plant and this lot occupies most of the frontage along the east right-of-way line along Seville Avenue
from 5e Street to just South of Leonis Boulevard. The City of Vernon acquired Lot 10 in June 2009
and this lot occupies the rest of the east right-of-way line along Seville Avenue just south of Leonis
Boulevard. LA Junction Railway Company occupies the frontage along the west right-of-way line along
Seville Avenue between Leonis Boulevard and 5e Street. In 2003, the City of Vernon began
construction of the Malburg Generating Station and the portion of 50'' Street between Seville Avenue
and Soto Street was closed to through traffic. 50''' Street from Seville Avenue to Soto Street was vacated
in April 2005. Furthermore, in order to provide appropriate security at the Malburg Generating Station
during heightened terrorism concerns, the portion of Seville Avenue between Leonis Boulevard and 50`''
Street was closed to through traffic on October 15, 2007 under Resolution No. 9447 and continues to be
closed to this day.
Utilities
Seville Avenue, between Leonis Boulevard and 50`'' Street, currently contains the following utilities
within the 40 foot right of way:
• City of Vernon's Light and Power — Underground electrical conduits & overhead electrical
lines.
• City of Vernon — Underground 6" & 10" gas main lines.
• City of Vernon — Underground 12" Sewer main.
• City of Vernon — Underground 8" Water main.
• County of Los Angeles — Underground variable size Storm Drain.
• EDISON — Overhead utility lines
• AT&T — Overhead Telephone lines.
The vacation of this portion of Seville Avenue will cause the reversion of the street to the City of Vernon
as the owner of the lot. The City of Vernon facilities will continue to be maintained by the City of
Vernon departments since the utility lines are part of the distribution system serving the Malburg
Generating Station and neighborhood properties.
The City plans to reserve easements for the public utilities that have existing lines and the railroad in the
vacated portion of Seville Avenue. In addition an Access Easement for fire -fighting equipment and for
fire inspection purposes will also be reserved.
Traffic
Seville Avenue is shown on the City's Master Plan as a local street that carries north/south traffic with a
south termination at a "T" intersection at Fruitland Avenue with a four approach intersection with 37''
Street on the north. The portion of Seville in question has been closed to through traffic since 2007 but
before that, the traffic counts show that a total of 1,774 vehicles utilized this portion of Seville Avenue
daily with 652 vehicles northbound and 1,122 vehicles southbound. The parallel street to the east is Soto
Street and to the west is Pacific Boulevard. Both are major arterials in the City with signalized
intersections where both streets intersect Leonis Boulevard. Since the portion of Seville Avenue in
question has been closed to through traffic, there has been sufficient capacity on both Soto Street and
Pacific Boulevard to carry the traffic that was diverted to these streets. The level of service at the
surrounding intersections is acceptable with minimal congestion.
Parking
Prior to the closure of Seville Avenue, on -street parking was limited to only a small portion of the east
side of the street. Since the closure of this portion of Seville Avenue to through traffic, the street now
provides access only for the Marburg Generating Station and the plant staff.
Rationale for Vacation
Section 8324 of the California Streets and Highways Code (SHC) provides that a general vacation may
be ordered by the City Council if it finds that the public right-of-way proposed to be vacated is
unnecessary for present of prospective public use.
Required Transportation Finding
State law requires that prior to vacating any right-of-way the legislative body must determine that the
area to be vacated would not be useful as a non -motorized transportation facility. Presently, the area to
be vacated does not contain and would not be needed to accommodate such facilities in the future.
Public Hearing Notification
Vacation procedures have being completed in accordance with Division 9 of the Streets and Highways
Code, otherwise known as the Public Streets, Highway and Service Easements Vacation Law. This
included posting a notice on the portion of the street to be vacated for at least two weeks prior to the
hearing and placing a notice in the local newspaper on December 3, 2015 and December 10, 2015.
Notification of Utility Companies
All utility agencies providing service in the project area have been notified about this proposed vacation.
No comments have been received to date. Any comments received from the utilities will be forwarded to
City Council.
Disposition of Vacated Right -of -Way
If this portion of Seville Avenue is vacated, the City of Vernon will own the property since the lot was
dedicated to the City of Vernon by a separate deed. The portion of Seville Avenue to be vacated has not
been widen from its original 40 foot right-of-way, the City of Vernon is the only original successor of the
lot. The ownership of the vacated street by the City of Vernon also maintains the public interest in this
property. The portion of right-of-way being vacated contains approximately 25,947 square -feet of land.
Easements will be reserved as part of the vacation for the existing utility owners within the right-of-way.
(a) to operate, maintain, renew and/or relocate all existing wires, pipes and other utility facilities of like
character upon, over or under the surface of said real property; (b) from time to time to construct,
operate, maintain, renew and/or relocate upon, over or under the surface of said real property, additional
facilities of the character described in clause (a) without in any instance being required to obtain consent.
CEQA Analysis
The portion of Seville Avenue that is to be vacated is surrounded by properties with industrial, railroad
and distribution uses that are compatible with the proposed vacation. No adverse impacts from traffic,
parking, noise, odor, dust, or explosion are expected to occur. An initial study has been conducted for
the project in compliance with the California Environmental Quality Act (CEQA). As shown by the
initial study, no potentially significant impacts are expected to result from the project, and there is no
substantial evidence, in light of the whole record before the City, that the project may have a
significant effect on the environment. The Director of Public Works, Water & Development Services
has recommended that a Notice of Intent be provided and issued pursuant to CEQA Guidelines
section 15072 and a Negative Declaration be adopted in compliance with CEQA Guidelines section
15070 et seq.
Fiscal Impact
The City will have to pay any fees required by the Los Angeles County Clerk's Office, approximately
$3,185 for document posting and publishing. No additional fiscal impacts are associated with the
project. As part of the vacation of the roadway, a cul-de-sac will be required to be constructed. The
property owner of 5001 Soto Street, which is just south of the former 5Uh Street has agreed to donate and
dedicate to the City of Vernon the required property for the cul-de-sac as part of the redevelopment of
the site. The City will be responsible for the cost of the construction of the cul-de-sac and relocation of
power poles, fire hydrants, catch basins and gas facilities interfering with the cul-de-sac construction.
Since the Vernon Gas and Electric Department is requesting that the street be vacated, it will be
responsible for the cost of the cul-de-sac construction estimated at less than $100,000. Sufficient funds
are available in Gas and Electric's account number 055.8200.900000.

The Department of Public Works, Water and Development Services "Water Section" received your

Mr. Wilson,
I received your November 9, 2015 letter addressed to Steve Dunn of the Los Angeles County Flood Control District
(LACFCD) regarding the subject street vacation.
The LACFCD, which is administered by the County of Los Angeles Department of Public Works, has a portion of a storm
drain system (Los Angeles County Flood Control District Storm Drain Bond Issue Project 8202) the full length of the
intended vacation.
Ms. Melendez has informed me the City will be preserving an easement the full width of the street right of way for utilities.
Please include the LACFCD's facilities in your easement for their continued occupation of the right of way and their
maintenance.
If you need a more formal request, please let me know.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON VACATING A PORTION OF SEVILLE AVENUE BETWEEN
LEONIS BOULEVARD AND FIVE FEET SOUTH OF THE
SOUTHERLY LINE OF FORMER 50TH STREET AND ADOPTING A
NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, that certain portion of Seville Avenue,
approximately 26,147 square -feet of land located within the City of
Vernon is deemed no longer necessary for present or prospective street
purposes; and
WHEREAS, said portion of Seville Avenue was dedicated to the
City of Vernon for street purposes as part of the acceptance of
Resolution No. 350 and Grant Deed in 1925; and
WHEREAS, said portion of Seville Avenue has been closed to
through traffic since 2007 in order to provide appropriate security at
the Malburg Generating Station during heightened terrorism concerns;
and
WHEREAS, said portion of said street does not constitute
major traffic arteries or collector streets, are not useful as non -
motorized transportation facilities, and are unnecessary for present
or prospective public use except that public utility, public agency,
fire fighting and railroad easements need to be reserved and accepted
therein; and
WHEREAS, the City Council has examined the location,
purpose, and extent of said portion of said street and has reviewed
the conformity of said proposed vacation with the General Plan and the
zoning Ordinance of the City of Vernon; and
WHEREAS, the Public Works, Water and Development Services
Department issued an Initial Study dated October 28, 2015, to
determine whether the proposed project will have adverse impacts on
the environment and has determined that the proposed project will not
have a significant adverse effect on the environment, and the Director
of Public Works, Water and Development Services has recommended that a
Negative Declaration be adopted in compliance with the California
Environmental Quality Act ("CEQA"); and
WHEREAS, the City of Vernon has provided notice of its
intent to adopt a Negative Declaration for the proposed project and
has provided a public review period of not less than 20 days, as
required by the California Environmental Quality Act and the State
CEQA Guidelines; and
WHEREAS, the City Clerk published a notice of the public
hearing in accordance with Government Code Section 6066 in the Vernon
Sun, which was determined to be a newspaper of general circulation; and
WHEREAS, on December 15, 2015, the City Council of the City
of Vernon held a public hearing on the consideration of the vacation of
a portion of Seville Avenue; and
WHEREAS, vacation procedures have been completed in
accordance with Division 9 of the Streets and Highways Code, otherwise
known as the Public Streets, Highway and Service Easements Vacation
Law; and
WHEREAS, the City Council has heard and considered all
evidence, both written and oral, presented in consideration of the
proposed vacation of a portion of Seville Avenue, 26,147 square -feet
of land, between Leonis Boulevard and five feet south of the southerly
line of former 50th Street in the City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that the portion of Seville Avenue, 26,147 square -feet of land,
between Leonis Boulevard and five feet south of the southerly line of
former 50th Street in the City of Vernon, is no longer necessary for
public road purposes.
SECTION 3: The City Council of the City of Vernon finds
that the vacation of said portion of said street as described is in
the public interest.
SECTION 4: That the City of Vernon reserves and accepts
easements for public utilities and agencies, installation, and
maintenance purposes (a) to operate, maintain, renew and/or relocate
all existing wires, pipes and other utility facilities of like
character upon, over or under the surface of said real property; (b)
from time to time to construct, operate, maintain, renew and/or
relocate upon, over or under the surface of said real property,
additional facilities of the character described in clause (a) without
in any instance required to obtain consent.
SECTION 5: That the City of Vernon reserves and accepts
access easements for fire -fighting equipment and for fire inspection
purposes in Seville Avenue.
SECTION 6: That the City of Vernon reserves and accepts an
easement to Los Angeles Junction Railway (LAJ) and its successors to
maintain and operate a railroad crossing at its current location
within the vacated section of Seville Avenue but without the right to
erect or maintain any barriers blocking access to the adjacent fee.

SECTION 7: The City Council of the City of Vernon further
finds that all persons have had the opportunity to be heard or to file
written comments to the proposed Seville Avenue vacation and after due
consideration of all the evidence submitted at the public hearing
determines that there are compelling reasons to justify vacating a
portion of Seville Avenue, 26,147 square -feet of land, between Leonis
Boulevard and five feet south of the southerly line of former 50th
Street in the City of Vernon.
SECTION 8: The City Council of the City of Vernon further
finds on the basis of the whole record before it (including the
initial study) that there is no substantial evidence that the street
vacation will have a significant effect on the environment
individually or cumulatively, and that the Negative Declaration
reflects the City's independent judgment and analysis, and on the
basis of said findings the City Council hereby approves and adopts the
Negative Declaration for the street vacation in accordance with the
California Environmental Quality Act.
SECTION 9: The City Council of the City of Vernon hereby
approves the Initial Study dated October 28, 2015, a copy of which
documents have been submitted to the City Council concurrently
herewith, and the City Clerk, or Deputy City Clerk, is directed to
receive and file them. Such documents and other materials which
constitute the record of proceedings in this matter shall be
maintained in the office of the City Clerk who is and shall be the
custodian thereof.
SECTION 10: The City Council of the City of Vernon hereby
directs the City Clerk, or Deputy City Clerk, to file a Notice of
Determination in regard to the environmental impact of said street

vacation.
SECTION 11: The City Council of the City of Vernon does
hereby order the vacation of that portion of Seville Avenue, 26,147
square -feet of land, between Leonis Boulevard and five feet south of
the southerly line of former 50th Street, as described and shown on the
attached Exhibits A and B. The vacation of said portion of Seville
Avenue, 26,147 square -feet of land, is pursuant to the provisions of
Division 9 of the Streets and Highways Code of the State of California
(commencing with Section 8300) otherwise known as the Public Streets,
Highways and Service Easements Vacation Law.
SECTION 12: The City Clerk, or Deputy City Clerk, of the
City of Vernon is hereby instructed to cause a certified copy of this
Resolution of vacation, attested by the City Clerk, or Deputy City
Clerk, under the seal of the City of Vernon, to be recorded without
acknowledgement, certificate of acknowledgment, or further proof in
the office of the County Recorder of the County of Los Angeles, and
said recordation shall be exempt from recording fees.
SECTION 13: From and after the date on which this Resolution
is recorded with the County Recorder of the County of Los Angeles, the
vacation of a portion of Seville Avenue, 26,147 square -feet of land,
between Leonis Boulevard and five feet south of the southerly line of
former 50th Street, shall be complete and no
longer constituted as a street in the City of Vernon.

SECTION 14: The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions
of the Council of this City.
