Resolution No. 2016-047RESOLUTION NO. 2016-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND ACCEPTING THE GRANT DEED DEDICATING IN FEE A PORTION OF THE PROPERTY LOCATED AT 5001 SOTO STREET WHEREAS, on December 15, 2015, the City Council of the City of Vernon approved, by minute order, a Construction Management and Reimbursement Agreement with Bel Air Soto, LLC (the "Grantor"), which includes construction of a new 129,000 square foot building and construction of a cul-de-sac; and WHEREAS, as part of this development, Grantor has offered to dedicate in fee a portion of the real property in the City commonly known as 5001 Soto Street in the City of Vernon, approximately 3,144 square feet in size, located on the corner of Seville Avenue and the previously vacated 50th Street, assessor's parcel number 6308-002-022 (the "Property"); and WHEREAS, Grantor has delivered to the City a grant deed dated February 26, 2016, dedicating in fee the Property to the City, a copy of which is attached hereto as Exhibit A ("Grant Deed"); and WHEREAS, by memorandum dated August 2, 2016, the Department of Public Works, Water & Development Services has recommended that the City accept the Grant Deed and approve execution of the Certificate of Acceptance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with CEQA Guidelines section 15301(c) because if any construction occurs as a result of accepting and executing the Grant Deed, the work would merely involve negligible expansion of an existing street. SECTION 3: The City Council of the City of Vernon hereby accepts the interests in real property conveyed to the City of Vernon by the Grant Deed, approves the Grant Deed and consents to the recordation of the Grant Deed. SECTION 4: The City Council of the City of Vernon hereby authorizes the Mayor or Mayor Pro-Tem to execute the Certificate of Acceptance accepting the Grant Deed for, and on behalf of, the City of Vernon and the City Clerk, or Deputy City Clerk, is hereby authorized to attest thereto. SECTION 5: The City Council of the City of Vernon hereby directs the City Administrator, or his designee, to take whatever actions are deemed necessary or desirable for the purpose of implementing and carrying out the purposes of this Resolution and the actions herein approved or authorized. SECTION 6: The City Council of the City of Vernon hereby authorizes the Department of Public Works, Water & Development Services, to submit the Grant Deed to the County Recorder. - 2 - SECTION 7: The City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City.
