A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON SUPPORTING THE ANNEXATION OF THE CITY OF
VERNON INTO THE GREATER LOS ANGELES COUNTY VECTOR
CONTROL DISTRICT
WHEREAS, the governing body of the City of Vernon (the
"City") desires to protect the residents from mosquito -borne disease;
and
WHEREAS, the City does not have the internal capacity or
funding streams necessary to establish a prevention -based vector
control services program; and
WHEREAS, the Greater Los Angeles Vector Control District (the
"District") is the established vector control services agency in Los
Angeles County and utilizes state-of-the-art methods, equipment, and
applications to best protect the residents of Vernon from mosquito -
borne disease; and
WHEREAS, the City has budgeted resources to pay the fees
associated with the City's annexation into the District; and
WHEREAS, the City is supportive of the District annexing the
City of Vernon into its boundaries.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that this action is exempt under the California Environmental Quality
Act (CEQA), pursuant to Section 15319, Annexations of Existing
Facilities and Lots for Exempt Projects, and Section 15320, Changes in
Organization of Local Agencies.
SECTION 3: The City Council of the City of Vernon hereby
supports the annexation of the City of Vernon into the Greater Los
Angeles County Vector Control District.
SECTION 4: The City Council of the City of Vernon hereby
authorizes City staff to assist the District in its actions to complete
the annexation of Vernon into the District boundaries.
SECTION 5: The City Clerk, or Deputy City Clerk, of the
City of Vernon shall certify to the passage, approval and adoption of
this resolution, and the City Clerk, or Deputy City Clerk, of the City
of Vernon shall cause this resolution and the City Clerk's, or Deputy
City Clerk's, certification to be entered in the File of Resolutions
of the Council of this City.

Greater Los Angeles County Vector Control District (GLACVCD).
The City of Vernon was founded in 1905 and has approximately 200 residents, over 1,800
businesses, and an overall workforce population of nearly 55,000. Vernon serves as a major
economic hub for the United States. The City is concerned about protecting the public health of
the Vernon residential and working population from the risk of being exposed to mosquito -borne
illnesses, such as West Nile Virus, Dengue, and Zika Virus.
The aedes mosquito has been identified by GLACVCD in the Vernon bordering communities of
Boyle Heights, East Los Angeles, Commerce, Maywood, and Huntington Park. Additionally,
culex mosquitoes testing positive for West Nile Virus have been found this year in these same
surrounding communities.
The City is formally requesting the GLACVCD Board of Trustees to approve the annexation of
the City of Vernon by GLACVCD to address the emerging public health issues associated with
mosquito -borne illnesses.

Recommendation
A. Find that the proposed action is exempt from the California Environmental Quality Act
("CEQA") pursuant to Section 15319, Annexations of Existing Facilities and Lots for
Exempt Projects, and Section 15320, Changes in Organization of Local Agencies; and
B. Adopt the attached resolution supporting the City's annexation into the Greater Los
Angeles County Vector Control District; and
C. Approve and authorize the mayor to sign the attached letter and submit an official request
for the City of Vernon's annexation to the Greater Los Angeles County Vector Control
District (GLACVCD) Board of Trustees for their consideration.
Background
Vector Control is a public health program designed to eliminate disease "vectors" such as
mosquitoes which transmit diseases such as West Nile Virus, St. Louis Encephalitis, Dengue
Fever, and, more recently, Zika Virus. Although Zika is not yet identified to be locally
transmitted in California, the mosquito which can carry this virus (aedes variety), has been
identified in California, including the Southeastern Downtown Los Angeles region.
The City of Vernon Health and Environmental Control Department (HECD) has found mosquito
breeding activity in various areas of the City. The HECD currently does not have the funding for
the needed personnel, equipment, or supplies to do larvaciding (application to kill mosquito
larvae), adulticiding (application to kill adult/flying mosquitoes), nor does it conduct any
trapping or disease surveillance to determine where mosquito breeding may be occurring,
necessary functions to guide prevention -based applications. Also, the HECD does not have
funding for comprehensive community education programming.

Vernon is immediately adjacent to cities served by the Greater Los Angeles Vector Control
District (GLACVCD). The HECD has approached the GLACVCD with a request to annex
Vernon into its agency. Annexation into the GLACVCD would provide for:
1. Mosquito breed surveillance to determine locations of active breeding and to facilitate
targeted abatement efforts
2. Collection and testing of dead birds (birds act as reservoirs for viruses) and analysis of
sentinel bird flocks to track the active spread of virus locally
3. Local laboratory testing capacity, for rapid test results
4. Regular and proactive larviciding of standing water to prevent mosquito breeding,
utilizing right -hand -drive vehicles for rapid and efficient application
5. Capacity to expand services in the event of a mosquito/disease outbreak, to include
adulticiding and focused applications to stem an event rapidly
6. Education and outreach resources (including door to door campaigns) to educate the
public on mosquito control efforts and how to prevent disease transmission
7. Access to disease surveillance reports on Vernon and the region to assist the HECD in its
disease prevention efforts, and
8. City of Vernon trustee seat on the GLACVCD board
GLACVCD will not provide contract vector control services for a jurisdiction not already
included in its service area. The only exception would be provision of services, under contract,
for a jurisdiction that is already actively engaged in the annexation process AND in the
circumstance of extraordinary public health risk. The complete process for annexation requires
GLACVCD to submit applications to the Local Agency Formation Commission for the County
of Los Angeles ("LAFCO"). GLACVCD will complete the process working with LAFCO and
with Los Angeles County to assign the district to the county tax rolls. Funding for the
GLACVCD services is provided for on an annual property tax assessment of $8.97 per parcel.
The fee will apply to all City -owned parcels. No election is required (legally exempt from
Proposition 218 requirements). The surrounding cities of Huntington Park, Maywood, Bell,
Commerce, and Los Angeles are already included in the GLACVCD. La Canada Flintridge, La
Crecenta, and Montrose have recently completed the annexation process or are actively engaged
in annexation efforts with GLACVCD currently. The City of Vernon is the only municipality
geographically located within GLACVCD's 1,340 square mile area of service that is not annexed
by GLACVCD.
The aedes mosquito has been identified by GLACVCD in the Vernon bordering communities of
Boyle Heights, East Los Angeles, Commerce, Maywood, and Huntington Park. Additionally,
culex mosquitoes testing positive for West Nile Virus have been found this year in these same
surrounding communities. Each year, Los Angeles County identifies human cases of vector -
borne disease, with West Nile Virus being the most serious (as of December 1, 2016, there have
been 149 cases in 2016, which include 128 hospitalizations, and 5 deaths), with several of these
cases being serious forms of WNV infection, such as neuro-invasive disease. WNV is a life -
threatening virus. Should Zika transmission be identified in local mosquito populations, and, if
locally transmitted cases of Zika are identified, significant efforts of adulticiding and larviciding
would be required, including community education and outreach. Zika is not generally fatal;
however, it has been shown to cause devastating birth outcomes.

LAFCO has indicated there will be fees for the City to process this application of up to $15,000.
As with all property tax assessments, Los Angeles County will collect the assessment proceeds
and distribute to GLACVCD directly. The property tax will apply to City -owned parcels
resulting in approximately $500 in annual costs to the City. There are no anticipated impacts to
other operational programs or capital projects as a result of this action.

AGREEMENT TO PROVIDE TEMPORARY VECTOR
(MOSQUITO) CONTROL SERVICES
This Agreement is entered into this Z day of July, 2017 by and between the Greater Los
Angeles County Vector Control District ("Districo and the City of Vernon, a municipal corporation
("CITY").
RECITALS
A. CITY has determined that it requires vector control services from DISTRICT.
B. DISTRICT is willing to provide such vector control services to CITY to allow for
better assessment of CITY's scope of service needs as pan of evaluation into possible annexation of
CITY into DISTRICT.
C. This Agreement is effective on the date of execution through June 30, 2019. Should
annexation proceedings be initiated during this time, this contract may be renewed on a month -to -
month basis until such time as the annexation of the CITY is approved and finalized. The Agreement
may be amended by mutual written consent of both parties.
E. DISTRICT represents that it is fully qualified to perform such professional services
on a temporary basis by virtue of its experience and the training, education and expertise of its
employees. DISTRICT further represents that it is willing to accept responsibility for performing
such services on a temporary basis in accordance with the terms and conditions of this Agreement.
NOW THEREFORE, in consideration of mutual covenants and conditions herein contained,
CITY and DISTRICT agree as follows:
1. DEFINITIONS
A. "Scope of Services": Such services as are set forth in District's Proposal, a copy of
which is attached hereto as Exhibit A and incorporated herein by this reference.
B. "Commencement Date": July / 2017
C. "Expiration Date": June 30, 2019, or such earlier date upon which the annexation of
the CITY to the DISTRICT becomes effective or upon the date of termination of this Agreement by
either party pursuant to the provisions of Section 14 below.
2. DISTRICT'S SERVICES
A. Scope of Services. Subject to the terms and conditions act forth in this Agreement,
DISTRICT shall perform the services identified in the Scope of Services. CITY shall have the right
to request, in writing, changes in the Scope of Services. Any changes mutually agreed upon by the
parties, and any increase or decrease in compensation, shall be incorporated by written amendments
to this Agreement. In the event of any conflict between District's Proposal (Exhibit A) and the body
of this Agreement, the body of this Agreement shall control.
B. Time for Performance. DISTRICT shall commence the services on the
Commencement Daze and shall perform all services in accordance with the Scope of Services.
C. Standard of Performance. DISTRICT shall perform all work to the highest
professional standards and in a manner reasonably satisfactory to CITY. DISTRICT shall comply
with all applicable federal, state and local laws, ordinances, codes and regulations.
3. REPRESENTATIVES
A. CITY Representative. For the purposes of this Agreement, the contract administrator
and CITY's representative shall be the Director of Health and Environmental Control (hereinafter the
"City Representative"). DISTRICT shall refer any decisions which must be made by CITY to the
City Representative. Unless otherwise specified herein, any approval of CITY required hereunder
shall mean the approval of the City Representative.
B. DISTRICT Representative. For the purposes of this Agreement, the General Manager
is hereby designated as the principal and representative of DISTRICT authorized to act on its behalf
with respect to the services specified herein and make all decisions in connection therewith (the
`Responsible Principal"). The Responsible Principal may not be changed by DISTRICT without the
prior written approval of CITY.
4. DISTRICT'S PERSONNEL
A. DISTRICT represents that it has, or will secure at its own expense, all personnel
required to perform the services required under this Agreement. All such services will be performed
by DISTRICT or under its supervision, and all personnel engaged in the work shall possess the
qualifications, permits and licenses required by applicable law to perform such services.
B. DISTRICT shall be solely responsible for the satisfactory work performance of all
personnel engaged in performing services required by this Agreement, and compliance with all
reasonable performance standards established by CITY.
C. DISTRICT shall be responsible for payment of all employees' wages and benefits and
shall comply with all requirements pertaining to employer's liability, workers' compensation, and
unemployment insurance.
D. Permits and Licenses. DISTRICT shall obtain and maintain during the Agreement
term all necessary licenses, permits and certificates required by law for the provision of services under
this Agreement.
5. FACILITIES AND EQUIPMENT
Except as otherwise authorized by CITY in writing, DISTRICT shall, at its sole cost and
expense, furnish all facilities and equipment which may be required for furnishing services pursuant
to this Agreement.
6. TERM OF AGREEMENT
This Agreement is effective as of the Commencement Date and shall terminate on the
Expiration Date as specified within this Agreement.
7. COMPENSATION FOR VECTOR CONTROL SERVICES
CITY agrees to compensate DISTRICT for the vector control services provided under this
Agreement on a time and materials basis, in accordance with and at the rates described in District's
Proposal (Exhibit A) and the attachments thereto. These rates may be adjusted each fiscal year to
reflect budgetary increases in staff hourly rates and product costs. Annual billing for such services
shall not exceed S45,000 per fiscal year. CITY shall not withhold applicable federal or state payroll
or any other required taxes or other authorized deductions from each payment made to DISTRICT.
8. METHOD OF PAYMENT
DISTRICT shall submit to CITY an invoice, on a quarterly basis, for the vector control
services performed pursuant to this Agreement. Each invoice shall itemize the services rendered
during the billing period and the amount due. Such itemizations shall include the days worked,
number of hours worked, and authorized reimbursable expenses incurred with appropriate back-up
documentation and receipts evidencing the authorized expenses, if any, for each day in the period and
shall separately describe any additional services authorized by CITY. Any invoice claiming
compensation for additional services shall include appropriate documentation of CITY's prior
authorization. Within ten (10) business days of receipt of each invoice, CITY shall notify DISTRICT
in writing ofany disputed amounts included on the invoice. Within thirty(30) calendar days of receipt
of each invoice, CITY shall pay all undisputed amounts included on the invoice.
9. INDEPENDENT CONTRACTOR
DISTRICT will act hereunder as an independent contractor. This Agreement shall not and is
not intended to constitute DISTRICT as an agent, servant, or employee of CITY and shall not and is
not intended to create the relationship of partnership, joint venture or association between CITY and
DISTRICT.
10. INDEMNIFICATION
DISTRICT shall indemnify, hold harmless and defend CITY, its elected officials, officers,
agents, employees, attorneys, servants, volunteers, successors and assigns from and against any and
all claims, demands, causes of action, liability, losses, costs or expenses for any damage due to death
or injury to any person and injury to any property resulting from any intentional, reckless, negligent
or otherwise wrongful acts, errors or omissions of DISTRICT or any of its officers, employees,
servants, agents, subcontractors, volunteers or any other person or entity involved by, for, with or on
behalf of DISTRICT in the performance of this Agreement. Such costs and expenses shall include
reasonable attorneys' fees.

11. INSURANCE
A. DISTRICT shall at all times during the term of this Agreement carry, maintain, and
keep in full force and effect, insurance as follows:
1. Commercial General Liability Insurance with minimum limits of One Million
Dollars ($1,000,000) for each occurrence and in the aggregate for any personal injury, death, loss or
damage.
2. Automobile Liability Insurance for any owned, non -owned or hired vehicle
used in connection with the performance of this Agreement with minimum limits of One Million
Dollars ($1,000,000) per accident for bodily injury and property damage.
3. Worker's Compensation insurance as required by the State of California.
B. Prior to commencement of work under this Agreement, DISTRICT shall file with
CITY's Risk Manager a certificate or certificates of insurance showing that the insurance policies are
in effect and satisfy the required amounts and specifications required pursuant to this Agreement.
C. DISTRICT shall provide proof that policies of insurance expiring during the tens of
this Agreement have been renewed or replaced with other policies providing at least the same
coverage.
D. The general liability and automobile policies of insurance shall contain an
endorsement naming CITY, its elected officials, officers, agents, employees, attorneys, servants,
volunteers, successors and assigns as additional insureds.
12. MUTUAL COOPERATION
CITY shall provide DISTRICT with all pertinent data, documents and other requested
information as is reasonably available for the proper performance of DISTRICT's services.
13. TERMINATION OFAGREEMENT
A. Either party may terminate this Agreement for any reason or for no reason on thirty
(30) calendar days' written notice to the other party. DISTRICT agrees to cease all work under this
Agreement on or before the effective date of such notice. DISTRICT shall be paid for the percentage
of work satisfactorily performed at the time of termination.
14. FORCE MAJEURE
DISTRICT shall not be liable for any failure to perform if DISTRICT presents acceptable
evidence, in CITY's solejudgment that such failure was due to causes beyond the control, and without
the fault or negligence of DISTRICT.
15. NOTICES
Any notices, bills, invoices, or reports required by this Agreement shall be deemed received

Agreement. In the event of any material discrepancy between the express provisions of this
Agreement and provisions of any document incorporated by reference, the provisions of this
Agreement shall prevail. This instrument contains the entire Agreement between CITY and
DISTRICT with respect to the subject matter herein. No other prior oral or written agreements are
binding on the parties. Any modification of this Agreement will be effective only if it is in writing
and executed by CITY and DISTRICT.
19. GOVERNING LAW; JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the State
of California. In the event of litigation between the parties, venue in State trial courts shall lie
exclusively in Los Angeles County. In the event of litigation in a United States District Court,
exclusive venue shall lie in the Central District of California.
20. SEVERABILITY
Wherever possible, each provision of this Agreement shall be interpreted in such a manner as
to be valid under applicable law. If any provision of this Agreement is determined by a court of
competent jurisdiction to be invalid, void or unenforceable, the remaining provisions shall
nevertheless continue in full force and effect.
21. CAPTIONS
The captions used in this Agreement are solely for reference and the convenience of the
parties. The captions are not a part of the Agreement, in no way bind, limit, or describe the scope or
intent of any provision, and shall have no effect upon the construction or interpretation of any
provision herein.
22. EXECUTION
This Agreement may be executed in any number of counterparts, each of which shall be
deemed an original, but all of which when taken together shall constitute one and the same instrument.

EXHIBIT A
SCOPE OF SERVICES
The full services of the District will be available to the City just as they are to the member
cities that comprise the District. More specifically, the District will provide the following
contract services: arbovirus disease surveillance, to monitor for mosquito populations and
disease transmission occurrence (ie., SLE, West Nile virus (WNv), etc.), and mosquito
control. The District is able to provide community outreach services, including school
visitations (Education Program Coordinators), presentations at community events and both
private and public functions (Public Information Officer), and supply information materials
for distribution, all as requested supplemental services at no cost to the City. The need for
setup cha es or to purchase equipment would not be required as elements of this Proposal.
Arbovirus disease surveillance will involve District Vector Ecologists (VE) placing a sufficient
number and arrangement of ovipositional and CDC encephalitis virus surveillance (EV S) traps to
capture live female mosquitoes within the City for purposes of detecting the presence of
arboviruses (SLE, WEE, WNV) and assessing the occurrence and abundance of mosquitoes within
the City. Detection of arbovirus in mosquitoes indicates extremely limited local disease
transmission and signals the need to focus control efforts proximate to these site collections. It
also permits an evaluation of the minimum infection rate among the mosquito population, a
determinant that is used to assess the risk of infection transmission from mosquitoes to humans.
In addition, the VE will collect reported dead birds and prepare them for processing by the state to
determine the presence of WNV, another indicator of WNV transmission activity.
Mosquito control will involve one or more Vector Control Specialists (VCS) necessarily 1)
responding to resident mosquito complaints, 2) inspecting known accessible sources for mosquito
breeding; 3) surveying areas attempting to locate mosquito sources, 4) larviciding (i.e., applying
chemical or biological (mosquitofish) control agents to mosquito sources, 5) adulticiding (i.e.,
applying aerosol chemical agents to control adult mosquitoes), and 6) eliminating sources (i.e.,
source reduction by physical manipulation or modification of the source). The District has
previously identified mosquito producing sources within the City that include streams and
channels, debris basins, swimming pools, fish ponds, gutters, catch basins, and underground storm
drains. Larviciding prevents adult emergence of mosquitoes from their aquatic habitats, is the
most effective and efficient means of mosquito control, and would constitute approximately 90%
of the VCS's field activities. When feasible, mosquito sites are physically modified to eliminate
present and future recurence of mosquito breeding. Adulticiding would only be considered as a
last resort effort to halt a focal occurrence of WNV or other vector -borne human infections or
implemented as a special need if requested by the City (e.g., as a preemptive measure to preclude
mosquito activity prior to conducting a large outdoor public event or function).
District staff will be available to the public Monday through Friday from 8:00 a.m. to 5:00 p.m.
All telephone calls and inquiries are personally answered and handled by District staff. The
District's automated answering system is engaged before and after business hours, which permits
callers to leave mosquito complaint information or other messages for follow up. GLACVCD also
has an extensive comprehensive informational website (www.elacvcd.ore).

This document is to examine the requirements under the California Environmental Quality

statewide integrated vector management (IVM) guidelines, with applicator certification
under a cooperative agreement with the California Department of Public Health (CDPH)
and monitoring by the Los Angeles County Agricultural Commissioner. In light of
growing invasive mosquito and exotic arboviral disease concerns the City is seeking
outside vector control services by contracting with the District, which already serves all
surrounding communities. The District has offered to provide the City with a temporary
service agreement, while evaluating the feasibility to amend its sphere of influence to
eventually include the City permanently within its service area. Through the service
agreement the City will receive comprehensive integrated vector control services to help
with better protecting residents' health and quality of life.
As in other parts of its service area, the District will provide enhanced vector control

In accordance with District policies regarding implementation of the California
Environmental Quality Act (CEQA) and the CEQA Guidelines, the District conducted a
Preliminary Review of its vector management activities in Los Angeles County in
September 2010 and concluded that all administrative, support, educational, and
emergency activities were exempt from further CEQA review. Because some elements of
the Integrated Vector Management Program are not expressly exempt from further CEQA
review, the District conducted an Initial Study to detemtirn whether the District's
Integrated Vector Management Program may have a significant effect on the environment.
On the basis of that study the District found that although the on -going project could have
a significant adverse effect on the environment, there is no significant adverse effect in this
case because mitigation measures reduce impacts to insignificant levels or eliminate them
a Mitigated Negative Declaration is the appropriate CEQA document and the District has
filed a Mitigated Negative Declaration for its Integrated Vector Management Program in
February 2011.
Because of the addition of the City of Vernon to the District service area through the service
contract as well as time passed since the programmatic CEQA review, the District will
perform a revision of the existing environmental document and file an updated version in
the new future.
Since the City has been conducting vector control activities within city boundaries under
the same certifications and I V M principles as the District will in the future under the service
contract, the 'Project' is strictly an organizational change transferring vector control
responsibilities from the City health department to the District: therefore, it is consistent
with categorical exemptions in the following cases: Section 15320, Class 20 (Changes in
Organization of Local Agencies).
DETERMINATION.
On the basis of this initial evaluation:
I find that the proposed project is consistent with Categorical Exemptions from
CEQA in the following cases: Section 13320, Class 20 (Changes in Organization of
Local Agencies).

Introduction:
The Department of Health and Environmental Control (HECD), is seeking authorization to use
the Greater Los Angeles County Vector Control District (GLACVCD) to provide mosquito
abatement services Citywide.
Backeround•
Vector Control is a public health program designed to eliminate disease "vectors" such as
mosquitoes which transmit diseases such as West Nile Virus, St. Louis Encephalitis, Dengue
Fever, and, more recently, Zika Vino. Although Zika is not yet identified to be locally
transmitted in California, the mosquito which can carry this virus (aedes variety), has been
identified in California, including the Southeastern Downtown Los Angeles region.
The City of Vernon HECD has found mosquito breeding activity in various areas of the City.
The HECD currently does not have the funding for the needed personnel, equipment, or supplies
to do larvaciding (application to kill mosquito larvae), adulticiding (application to kill
adult/flying mosquitoes), nor does it conduct any trapping or disease surveillance to determine
where mosquito breeding may be occurring, necessary functions to guide prevention -based
applications. Also, the HECD does not have funding or staffing for comprehensive community
education programming.
Vernon is immediately adjacent to cities served by the GLACVCD, when mosquitoes carrying
West Nile Virus in addition to the aedes mosquitoes known to carry Zika have been found. The
HECD has previously approached the GLACVCD in 2016 with a request to annex Vernon into
its agency.
On January 12, 2017, the GLACVCD Board of Trustees voted against the annexation of the City
of Vernon due to GLACVCD's uncertainty of the level of work required to perform effective

mosquito abatement services in the City. However, the GLACVCD Board did approve the
GLACVCD to enter into a short term services contract (2-year) with the City to allow for better
assessment of the City's scope of service needs as part of evaluation into possible annexation of
the City into the GLACVCD. The GLACVCD Board will reconsider the annexation of the City
after completion of the proposed 2-year service contract, which expires June 30, 2019.
The proposed Services Agreement is exempt from competitive bidding/selection because it is
with another governmental entity (VMC 2.17.12(Ax5)(a), (B)(1)). Additionally, the proposed
Services Agreement has been reviewed and approved as -to -form by the City Attorney's office on
May 30, 2017. Upon your approval, staff will route the agreement for signature via the City's
routing form.
Recommendation
Given the circumstances, the Department recommends entering into a contract agreement with
GLACVCD over the next 2-year period to provide mosquito abatement services throughout the
City. In total, the contract would be for an amount not to exceed $90,000 (maximum $45,000 per
fiscal year). The expenditure for these services has been specifically identified in the Health
Department's FY 2017-2018 budget and will be budgeted in the FY 2018-2019 budget.
It is recommended that this request be approved in order to provide mosquito abatement services
Citywide.

CONTROL SERVICES
This Amendment ("Amendment No. 1 ") to that certain Agreement for temporary vector
(mosquito) control services dated July 1, 2017, (the "Agreement"), is made as of Ji Ii, 2019,
by and between the City of Vernon, a California charter city and municipal corporation (the
"City"), and the Greater Los Angeles County Vector Control District (the "District").
WHEREAS, the City and District are parties to a written Agreement, dated July 1, 2017,
under which District provides temporary vector (mosquito) control services ("the Agreement");
and
WHEREAS, the City and District desire to amend the Agreement to extend the
Agreement for an additional one (1) month period effective June 30, 2019, through July 31,
2019, at no additional cost.
NOW, THEREFORE, the parties to this Amendment No. 1 agree as follows:
1. The Agreement has been renewed for an additional one (1) month period, and the
Expiration Date listed in Section 1(C) (Definitions) of the Agreement is amended to July 31,
2019.
2. Except as expressly modified by this Amendment No. 1, all provisions of the
Agreement shall remain in full force and effect.
3. The provisions of this Amendment No. 1 shall constitute the entire agreement of
the parties with respect to the subject matter included in this Amendment No. 1 and shall
supersede any other agreement, understanding, or arrangement, whether written or oral, between
the parties with respect to the subject matter of this Amendment No. 1.
4. The person or persons executing this Amendment No. 1 on behalf of each of the

Recommendation:
A. Approve Amendment No. 1 to the Agreement to Provide Temporary Vector
(Mosquito) Control Services with GLACVCD to extend the contract period of
performance from June 30, 2019 to July 31, 2019 in order to maintain mosquito
abatement services while the City of Vernon completes the Local Agency Formation
Commission (LAFCO) application process for annexation.
Background:
The GLACVCD provides mosquito control, surveillance, and education to residents
within 35 cities and areas of unincorporated Los Angeles County. Since 2017, the
GLACVCD has provided contract services to the City of Vernon under an out -of -agency
service agreement approved by the LAFCO in order to assess the feasibility and scope
of annexation. On June 13, 2019, the GLACVCD Board of Trustees authorized the
GLACVCD to proceed with annexation. The Department of Health and Environmental
Control will file the application for annexation with the LAFCO by August 1, 2019.
While LAFCO's original approval of the out -of -agency service agreement authorizes
GLACVCD to provide vector control services for the City of Vernon through August 1,
2019, the City of Vernon Agreement to Provide Temporary Vector (Mosquito) Control
Services with GLACVCD will expire on June 30, 2019. Therefore, Department of Health
and Environmental Control is requesting the approval of Amendment No. 1 to the
Agreement to Provide Temporary Vector (Mosquito) Control Services with GLACVCD to

extend the contract term from June 30, 2019 to July 31, 2019. Amendment No. 1 will
ensure that there is no lapse in coverage during the application submittal process.
There is no cost associated with the approval of Amendment No. 1 as sufficient budget
is currently available in the July 1, 2017 temporary agreement.
In addition, the GLACVCD has submitted a request to LAFCO to extend the original out -
of -agency service agreement approval from August 1, 2019 to February 1, 2021. The
18-month extension will authorize GLACVCD to continue vector control services in the
City of Vernon during the annexation process. Upon LAFCO's approval of the
extension, the Department of Health and Environmental Control will submit a request to
City Council to approve a new professional service agreement for GLACVCD to provide
mosquito abatement services during the annexation process.
The proposed Amendment No. 1 to the Agreement to Provide Temporary Vector
(Mosquito) Control Services with GLACVCD has been reviewed and approved as -to -
form by the Office of the City Attorney. Upon your approval, staff will route the
agreement for signature via the City's routing form.
Fiscal Impact:
There is no cost associated with the approval of Amendment No. 1 as sufficient budget
is currently available in the July 1, 2017 temporary agreement.

WHEREAS, the governing body of the City of Vernon (the
"City") desires to protect the residents from mosquito -borne disease;

WHEREAS, the City does not have the internal capacity or
funding streams necessary to establish a prevention -based vector
control services program; and
WHEREAS, the Greater Los Angeles Vector Control District (the
"District") is the established vector control services agency in Los
Angeles County and utilizes state-of-the-art methods, equipment, and
applications to best protect the residents of Vernon from mosquito -
borne disease; and
WHEREAS, the City has budgeted resources to pay the fees
associated with the City's annexation into the District; and
WHEREAS, the City is supportive of the District annexing the
City of Vernon into its boundaries.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION l: The City Council of the City of Vernon hereby
finds and determines that the above recitals are true and correct.
SECTION 2: The City Council of the City of Vernon finds
that this action is exempt under the California Environmental Quality
Act (CEQA), pursuant to Section 15319, Annexations of Existing
Facilities and Lots for Exempt Projects, and Section 15320, Changes in
Organization of Local Agencies.
SECTION 3: The City Council of the City of Vernon hereby
supports the annexation of the City of Vernon into the Greater Los
Angeles County Vector Control District.
SECTION 4: The City Council of the City of Vernon hereby

INDEMNIFICATION / LEGAL DEFENSE
As a condition to the Local Agency Formation Commission for the County of Los Angeles' (LAFCO's) evaluation
of the Applicant's proposal, the Applicant and, if different, the Real Party In Interest
(i.e., the landowner) City of Vernon hereby warrant, represent, and agree
to defend, indemnify, hold harmless LAFCO and its agents, officers, commissioners, and employees from any
claim, action, or proceeding against LAFCO or its agents, officers, commissioners, and employees, relating to
or arising out of LAFCO's evaluation or processing of the proposal, including, but not limited to, any action to
attack, set aside, void, annul, enjoin, or compel LAFCO's approval, disapproval, evaluation, or processing of the
proposal, which indemnification obligation includes, but is not limited to, Applicant/Real Party In Interest being
required to pay for any costs and reasonable attorneys' fees incurred or anticipated to be incurred by LAFCO
in connection with any such action. This indemnification obligation shall not include intentional or willful
misconduct on the part of LAFCO, but shall include passive and/or concurrent active negligence by LAFCO.
Applicant/Real Party In Interest agree that LAFCO has the right to appoint its own counsel for its defense and
conduct its own defense in the manner it deems in its best interest, and that such actions will not relieve or
limit Applicant's/Real Party In Interest's obligations to indemnify and reimburse defense costs. At the
discretion of the Executive Officer, a deposit or deposits of funds by the Applicant may be required in an
amount or amounts sufficient to cover any anticipated or incurred litigation costs.

Recommendation:
A. Execute the LAFCO application to annex the City of Vernon into the Greater Los
Angeles County Vector Control District (GLACVCD)
Background:
The GLACVCD provides mosquito control, surveillance, and education to residents
within 35 cities and areas of unincorporated Los Angeles County. On December 20,
2016, Resolution No. 2016-68 was approved by City Council supporting the annexation
of the City of Vernon into the GLACVCD. Since 2017, the GLACVCD has provided
contract services to the City of Vernon under an out -of -agency service agreement
approved by the LAFCO in order to assess the feasibility and scope of annexation. On
June 13, 2019, the GLACVCD Board of Trustees authorized the GLACVCD to proceed
with the annexation of the City of Vernon. The Department of Health and Environmental
Control is required to file an application for annexation with the LAFCO by August 1,
2019.
Fiscal Impact:
The approximate LAFCO application filing fee is $15,000.00. Adequate funds are
available in the Department of Health and Environmental Control budget to cover the
cost.

AMENDMENT NO.2 TO THE AGREEMENT BETWEEN
THE CITY OF VERNON AND THE GREATER LOS ANGELES COUNTY VECTOR
CONTROL DISTRICT FOR TEMPORARY VECTOR (MOSQUITO)
CONTROL SERVICES
This Amendment ("Amendment No. 2") to that certain Agreement for temporary vector
(mosquito) control services dated July 1, 2017, (the "Agreement"), is made as of
2019, by and between the City of Vernon, a California charter city and municipal co moon
(the "City"), and the Greater Los Angeles County Vector Control District (the "District').
WHEREAS, the City and District are parties to a written Agreement, dated July 1, 2017,
under which the District provides temporary vector (mosquito) control services to the City ("the
Agreement"); and
WHEREAS, the City and District desire to amend the Agreement to extend the
Agreement for an additional eighteen (18) month period effective August 1, 2019, through
January 31, 2021, at no additional cost.
NOW, THEREFORE, the parties to this Amendment No. 2 agree as follows:
1. The Agreement has been renewed for an additional eighteen (18) month period,
and the Expiration Date listed in Section 1(C) (Definitions) of the Agreement is amended to
January 31, 2021.
2. This Amendment No. 2 shall have a retroactive effective date of August 1, 2019,
due to the fact that the District did not approve the proposed extension until after the fast
amended expiration date of the Agreement. A copy of District Resolution No. 2019-18RMD is
attached hereto as Exhibit 1.
3. Except as expressly modified by this Amendment No. 2, all provisions of the
Agreement shall remain in full force and effect.
4. The provisions of this Amendment No. 2 shall constitute the entire agreement of
the parties with respect to the subject matter included in this Amendment No. 2 and shall
supersede any other agreement, understanding, or arrangement, whether written or oral, between
the parties with respect to the subject matter of this Amendment No. 2.
5. The person or persons executing this Amendment No. 2 on behalf of each of the
parties warrants and represents that he or she has the authority to execute this Amendment No. 2
on behalf of that party and has the authority to bind that party to the performance of its
obligations hereunder.
IN WITNESS WHEREOF, the parties have signed this Amendment No. 2 as of the date
stated in the introductory clause.

RESOLUTION OF THE LOCAL AGENCY FORMATION
COMMISSION FOR THE COUNTY OF LOS ANGELES
MAKING DETERMINATIONS APPROVING
EXTENSION OF THE "OUT -OF -AGENCY SERVICE AGREEMENT NO.2017-08 FOR THE
GREATER LOS ANGELES COUNTY VECFOR CONTROL DISTRICT (ENTIRE CITY OF VERNON)-
WHEREAS, proceedings for this out -of -agency service agreement extension were
initiated by the Greater Los Angeles County Vector Control District (District), which was
submitted to the Local Agency Formation Commission for the County of Los Angeles
(Commission), pursuant to, Division 3, Title 5, of the California Government Code (commencing
with section 56000, the Cortese -Knox -Hertzberg Local Government Reorganization Act of
2000); and
WHEREAS, the proposed out -of -agency service agreement consists of approximately
3,302±acres of inhabited territory, all within the City of Vernon and is assigned the following
distinctive short -form designation: Extension of the "Out -of -Agency Service Agreement No.
2017-08 for the Greater Los Angeles County Vector District (Entire City of Vernon)"; and
WHEREAS, a map of the proposal is set forth in Exhibits "A", attached hereto and by this
reference incorporated herein; and
WHEREAS, the principal reason for the proposed extension of the out -of -agency
agreement is for the Greater Los Angeles County Vector District to continue to provide vector
control service outside its jurisdictional boundary to the entire City of Vernon; and
WHEREAS, the Executive Officer has reviewed the proposal and submitted to the
Commission a written report, including his recommendations therein; and

WHEREAS, the Executive Officer has given notice of the public hearing pursuant to
Government Code Sections 56150-56160, 57025, and 57026, wherein the public hearing notice
was published in a newspaper of general circulation in the County of Los Angeles on July 15,
2019, which is at least 21 days prior to the public hearing, and said hearing notice
was also mailed to all required recipients by first-class mail on or before the date of newspaper
publication;
WHEREAS, on August 14, 2019, after being duly and properly noticed, this proposal
came on for hearing, at which time this Commission heard and received all oral and written
testimony, objections, and evidence which were made, presented or filed, and all persons
present were given an opportunity to hear and be heard with respect to this proposal and the
report of the Executive Officer; and
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The Commission finds that this Extension of the Outof-Agency Service Agreement No.
2017-08 for the Greater Los Angeles County Vector District (Entire City of Vernon) is
categorically exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to State CEQA Guidelines Section 15320 because it consists of a change
in the organization or reorganization of local governmental agencies where the changes
do not change the geographical area in which previously existing powers are exercised.
In addition, there are no cumulative impacts, unusual circumstances, nor other limiting
factors that would make the exemption inapplicable based on the proposal records.
2. A map of the proposal, as approved by this Commission, is set forth in Exhibits "A",
attached hereto and by this reference incorporated herein.

3. The affected territory consists of 3,302± acres, is inhabited, and is assigned the following
short form designation:
Extension of the "Out -of -Agency Service Agreement No. 2017-08 for the Greater Los

4. The Commission finds that the proposal is consistent with adopted Commission policy,
that there is a documented threat to the health and safety of the public or the affected
residents, and that the Commission has notified all alternate service providers and
received no comments, all as set forth in Government Code section 56133(c).
5. Extension of the Out -of -Agency Service Agreement No. 2017-08 for the Greater Los
Angeles County Vector District (Entire City of Vernon) is hereby approved, subject to the
following terms and conditions:
a. The Greater Los Angeles County Vector Control District agrees to defend, hold
harmless and indemnity LAFCO and/or Its agents, officers and employees from
any claim, action or proceeding against LAFCO and/or its agents, officers and
employees to attack, set aside, void or annul the approval of LAFCO concerning
this proposal or any action relating to or arising out of such approval.
b. Unless a request for reconsideration pursuant to Government Code Section
56133(d) is received, the effective date for this outof-agency service agreement
request shall be September 16, 2019.
c. The Los Angeles County Vector Control District may provide vector control
services outside Its jurisdictional boundary and sphere of influence until
Annexation No. 2019-07 to the Greater Los Angeles County Vector Control
Resolution No. 2019-18RMD

District is complete.
d. Service extension of the affected territory is described in Exhibit "A".
e. The District shall notify LAFCO of any material changes (including termination) to
its contract with the City of Vernon.
f. Except to the extent in conflict with "a" through "e", above, the general terms
and conditions contained in Chapter 2 of Part 5, Division 3, Title 5 of the
California Government Code (commencing with Government Code Section
57325) shall apply to this out -of -agency service agreement.
6. The Executive Officer is hereby authorized and directed to mail copies of this resolution
as provided In Government Code Section 56882.

Recommendation:
Approve the attached Amendment No. 2 to the Temporary Vector (Mosquito) Control
Services Agreement with the GLACVCD, in substantially the same form as submitted
herewith, to extend the contract period of performance by eighteen months to January
31, 2021.
Background:
The GLACVCD provides mosquito control, surveillance, and education to residents
within 35 cities and areas of unincorporated Los Angeles County. Since 2017, the
GLACVCD has provided contract services to the City of Vernon under an out -of -agency
service agreement approved by the Local Agency Formation Commission (LAFCO) in
order to assess the feasibility and scope of annexation. On June 13, 2019, the
GLACVCD Board of Trustees authorized the GLACVCD to proceed with annexation.
The City of Vernon has filed an application for annexation with the LAFCO. On August
14, 2019, the LAFCO voted to authorize an extension of the GLACVCD's out of service
agreement with the City of Vernon to continue vector control services during the
annexation process. The City of Vernon agreement with GLACVCD expired on July 31,
2019.
The Department of Health and Environmental Control is requesting approval of
Amendment No. 2, to extend the contract period of performance by 18 months to
January 31, 2021. This amendment will ensure the continuation of vector control
services during the annexation process.
Amendment No. 2 has been reviewed and approved as -to -form by the Office of the City
Attorney. Upon your approval, staff will route the agreement for signature via the City's
routing form.
Fiscal Impact
Funding is available in the GLACVCD Service Agreement to cover the cost associated
with the new performance period in Amendment No. 2.

1. The negotiated exchange of property tax revenue between the County of
Los Angeles, Consolidated Fire Protection District, Flood Control District, Belvedere Garbage
Disposal District, the Greater Los Angeles County Vector Control District, the Los Angeles
County Sanitation District No. 1, the Los Angeles County Sanitation District No. 2, the Los
Angeles County Sanitation District No. 23, the Water Replenishment District of Southern
California, and the City Council of Vernon, as a result of the Greater Los Angeles County Vector
Control District Annexation No. 2019-07 ("Annexation No. 2019-07") which proposes the
annexation of said territory to the Greater Los Angeles County Vector Control District, is
approved and accepted.
2. In the fiscal year commencing in the year after the filing of the statement of
boundary change for Annexation No. 2019-07 with the Board of Equalization pursuant to
Government Code sections 54902 and 57204, and every fiscal year thereafter, the following
ratios of the annual property tax growth in Tax Rate Areas shall be transferred to the Greater
Los Angeles County Vector Control District as a result of Annexation No. 2019-07 to the District.
The other affected taxing entities' shares of property tax growth in Tax Rate Areas shall be
adjusted as calculated by the Auditor-Controller of Los Angeles County.

3. There shall be no additional transfer of property taxes as a result of Annexation No.

4. If at any time after the effective date of this resolution. the calculations used herein
to determine initial property tax transfers or the data used to perform those calculations are
found to be incorrect thus producing an improper or inaccurate property tax transfer. the
property tax transfer shall be recalculated and the corrected transfer shall be implemented for
the next fiscal year.

Recommendation:
Adopt a Joint Resolution of the Board of Supervisors, as the Governing Body of the County of Los
Angeles, the Consolidated Fire Protection District of Los Angeles County, the Los Angeles County Flood
Control District, and the Belvedere Garbage Disposal District, and the Board of Directors of the Greater
Los Angeles County Vector Control District, the Los Angeles County Sanitation District No. 1, the Los
Angeles County Sanitation District No. 2, the Los Angeles County Sanitation District No. 23, and the
Water Replenishment District of Southern California, and the City Council of Vernon, approving and
accepting the negotiated exchange of property tax revenue resulting from Annexation No. 2019-07 to the
Greater Los Angeles County Vector Control District.
Background:
The Greater Los Angeles County Vector Control District (GLACVCD) provides mosquito control,
surveillance, and education to residents within 35 cities and areas of unincorporated Los Angeles
County. On December 20, 2016, Resolution No. 2016-68 was approved by City Council supporting the
annexation of the City of Vernon into the GLACVCD. Since 2017, the GLACVCD has provided contract
services to the City of Vernon under an out-of-agency service agreement approved by the LAFCO in
order to assess the feasibility and scope of annexation. On June 13, 2019, the GLACVCD Board of
Trustees authorized the GLACVCD to proceed with the annexation of the City of Vernon. The
Department of Health and Environmental Control was required to file an application for annexation with
the LAFCO by August 1, 2019. Accordingly, on July 16, 2019, the City of Vernon executed the Local
Agency Formation Commission (LAFCO) application to annex the City of Vernon into the Greater Los
Angeles County Vector Control District (GLACVCD). In order to complete the annexation process, the
City of Vernon must adopt the Joint Tax Transfer Resolution with the County of Los Angeles. The joint
resolution has been reviewed and approved as-to-form by the City Attorneys Office. The Citys existing
contract with the GLACVCD will be terminated upon completion of the annexation.
Fiscal Impact:
Currently, there are approximately 1,260 assessable parcels in the City of Vernon. Based on the current
rate of$12.79 per parcel, the GLACVCD will receive approximately$16,115 in tax revenue. The City of
Vernon owns 55 parcels and will have a $703.45 tax obligation annually. The City of Vernon will realize a
significant savings by completing the annexation process as the current 3-year agreement with
GLACVCD is for a not-to-exceed amount of$90,000.
