Resolution No. 2017-064
RESOLUTION NO. 2017-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND ACCEPTING THE GRANT DEED DEDICATING IN FEE A PORTION OF THE PROPERTY LOCATED AT 4601 DOWNEY ROAD WHEREAS, 4441 Downey Road, LLC (the "Grantor") has offered to dedicate in fee a portion of the real property in the City commonly known as 4601 Downey Road in the City of Vernon, approximately 1,179 square feet in size, located on the Southwest corner of Packers Avenue and Downey Road, assessor's parcel number 6303-017-015 (the "Property"); and WHEREAS, Grantor has delivered to the City a grant deed dated October 3, 2017, dedicating in fee the Property to the City, a copy of which is attached hereto as Exhibit A ("Grant Deed"); and WHEREAS, the dedication will meet the City of Vernon's Master Plan of Streets and will be used for street purposes by increasing the width of the right-of-way and radius of curb return; and WHEREAS, by memo dated November 21, 2017, the Director of Public Works has recommended that the City accept the Grant Deed and approve the execution of the Certificate of Acceptance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the above recitals are true and correct. SECTION 2: The City Council of the City of Vernon finds that this action is exempt under the California Environmental Quality Act (CEQA), in accordance with CEQA Guidelines section 15301(c) because if any construction occurs as a result of accepting and executing the Grant Deed, the work would merely involve negligible expansion of an existing street. SECTION 3: The City Council of the City of Vernon hereby accepts the interests in real property conveyed to the City of Vernon by the Grant Deed, approves the Grant Deed and consents to the recordation of the Grant Deed. SECTION 4: The City Council of the City of Vernon hereby authorizes the Mayor or Mayor Pro-Tem to execute the Certificate of Acceptance accepting the Grant Deed for, and on behalf of, the City of Vernon and the City Clerk, or Deputy City Clerk, is hereby authorized to attest thereto. SECTION 5: The City Council of the City of Vernon hereby directs the City Administrator, or his designee, to take whatever actions are deemed necessary or desirable for the purpose of implementing and carrying out the purposes of this Resolution and the actions herein approved or authorized. SECTION 6: The City Council of the City of Vernon hereby authorizes the Department of Public Works to submit the Grant Deed to the County Recorder. - 2 - SECTION 7: The City Clerk, or Deputy City Clerk, of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk, or Deputy City Clerk, of the City of Vernon shall cause this resolution and the City Clerk's, or Deputy City Clerk's, certification to be entered in the File of Resolutions of the Council of this City.
