A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
RATIFYING EMERGENCY PROCLAMATION 2020-02, A
PROCLAMATION OF LOCAL EMERGENCY DUE TO THE SERIOUS AND
IMMINENT THREAT OF ARSON, LOOTING, ASSAULTS, VANDALISM
AND RIOTING IN THE COUNTY OF LOS ANGELES AND VARIOUS
NEIGHBORING CITIES IN CLOSE PROXIMITY TO THE CITY OF
VERNON
SECTION 1 . Recitals.
A. Under the California Emergency Services Act (California Government Code
sections 8630. 8550 et seq.). California Government Code section 8558(c) defines a
"Local Emergency" as the existence of conditions of disaster or extreme peril to the safety
of persons and property within the territorial limits of a city. caused by conditions such as
a riot, which are or are likely to be beyond the control of the services, personnel,
equipment, and facilities of a city. and require the combined forces of other political
subdivisions to combat.
B. Government Code Section 8630 and Vernon Municipal Code Chapter 8 authorize
the Vernon Disaster Council Chief Executive Officer to proclaim the existence or
threatened existence of a local emergency when the City Council is not in session so long
as the proclamation is ratified by the City Council within seven days.
C. Vernon Municipal Code Section 8.1 defines an ''emergency" as the actual or
threatened existence of conditions of disaster or of extreme peril to the safety of persons
and property within this city caused by such conditions as air pollution, fire. flood. storm.
epidemic, riot or earthquake, or other conditions. including conditions resulting from war
or imminent threat of war, but other than conditions resulting from a labor controversy.
which conditions are or are likely to be beyond the control of the services, personnel.
equipment, and facilities of this city, requiring the combined forces of other political
subdivisions to combat.
D. There currently exists within the County of Los Angeles and various neighboring
cities in close proximity to the City of Vernon widespread arson. looting. assaults.
vandalism and rioting. Since May 28, 2020, there also has been similar activities of arson,
looting. assaults. vandalism and rioting stemming from public demonstrations in
numerous other cities throughout California and across the Country.
E. On May 31. 2020, at approximately 5:00 p.m.. Mayor Leticia Lopez. acting in her
capacity as Chief Executive Officer of the Disaster Council, issued Emergency
Proclamation 2020-02. a Proclamation declaring the existence of a local state of
emergency, including declaration of curfew regulations, which now exists in the City of
Vernon.

NOW. THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERNON AS FOLLOWS:
SECTION 2. The City Council of the City of Vernon hereby finds and determines
that the above recitals are true and correct.
SECTION 3. The City Council has reviewed the Proclamation and hereby ratifies
Emergency Proclamation No. 2020-02. attached hereto as Exhibit A.
SECTION 4. In accordance with Vernon Municipal Code Chapter 8 and applicable
law, the City Council declares that due to an imminent threat to health and safety as a
result of civil unrest that a local emergency exists within the City of Vernon's territorial
limits.
SECTION 5. The City Administrator. as the Director of Emergency Services. is
empowered to carry out all emergency powers conferred upon him as the Director of
Emergency Services by local and state laws, and by all other lawful authority. as may be
necessary to protect life and property.
SECTION 6. During the existence of this local emergency. the powers, functions.
and duties of the Director of Emergency Services and the emergency organization of this
City will be those prescribed by state law. by ordinance. resolutions and the City Multi-
Hazard Functional Plan.
SECTION 7. The City Clerk is directed to forward a copy of this Resolution to the
County of Los Angeles and the California Director of the Office of Emergency Services
with a request to find it acceptable in accordance with provisions of the California Disaster
Assistance Act: and that the City's Director of Emergency Services or his assistant is
hereby declared as the City's authorized representative for the purpose of receiving,
processing and coordinating all inquiries and requirements needed to obtain valuable
state and, if needed, federal assistance.
SECTION 8. The City Administrator or his designee is designated as the Local
Hazard Mitigation Coordinator of the City of Vernon for the purpose of assessing the
threat to the people in the City as a result of civil unrest and consulting with Federal, State,
County and other authorities as necessary to access the threat and to take appropriate
actions to address the threat including taking actions authorized by law including, but not
limited to Municipal Code Section 8.8 which authorizes the Director to make and issue
rules and regulations on matters reasonably related to the protection of life and property
as affected by such emergency: provided. however such rules and regulations must be
confirmed at the earliest practicable time by the Chief Executive Officer and the City
Council.

SECTION 9. This local emergency will continue to exist until otherwise determined
by City Council resolution.
SECTION 10. The City Clerk shall certify the passage and adoption of this
resolution and enter it into the book of original resolutions.

DECLARATION OF LOCAL EMERGENCY
2020-02 - CIVIL UNREST
By virtue of the authority vested in me as Mayor for the City of Vernon, serving in
the capacity of Chairperson and Chief Executive Officer of the Vernon Disaster
Council and pursuant to Vernon Municipal Code, Chapter 8, Sections 8.4 and 8.6, I
hereby find the following conditions exist:
1. There currently exists within the County of Los Angeles and various
neighboring cities in close proximately to the City of Vernon widespread
arson, looting, assaults, vandalism and rioting. Since May 28, 2020,there also
has been similar activities of arson, looting, assaults, vandalism and rioting
stemming from public demonstrations in numerous other cities throughout
California and across the Country. Such dangerous, reckless and illegal
activities have been ongoing in the Los Angeles County region since May 30,
2020. Peaceful demonstrations are essential to our democratic system.
However, some individuals have engaged in dangerous, reckless and unlawful
activity, threatening the safety of lawful demonstrators, surrounding
communities and neighborhoods, police and fire personnel and other first
responder workforces.
2. While there are currently no direct activities within the City of Vernon, the
above regional and County-wide situation and conditions constitute the
existence of circumstances of extreme peril to the safety of persons and
property within the City of Vernon. These conditions, if conducted within the
City, are likely to be beyond the control of the services, personnel, equipment
and facilities of the City of Vernon and require the combined forces of other
political subdivisions to combat any dangerous, reckless and/or unlawful
activity.
NOW, THEREFORE, I HEREBY DECLARE the existence of a local emergency
within the City of Vernon, which shall take effect immediately, along with
Declaration of Curfew Regulations, and that widespread publicity and notice shall
be given of such Declarations through the most feasible and adequate means of
disseminating notice throughout the City.

I FURTHER DECLARE AND ORDER that during the existence of said local
emergency the powers, functions and duties of the emergency organizations of the
City of Vernon shall be those proscribed by state law and the ordinances,resolutions,
laws and procedures of the City of Vernon.
I FURTHER REQUEST that the Governor of the State of California declare the City
of Vernon to be in a State of Emergency.

DECLARATION OF CURFEW REGULATIONS
(Pursuant to Declaration of Local Emergency of May 31, 2020)
It shall be unlawful for any person to travel or be on a public street, sidewalk or
public place within the City of Vernon during the dates and hours designated
below, unless exempt for the reasons set forth below.
For purposes of this Declaration of Curfew, "travel" includes without limitation,
travel on foot, bicycle, skateboard, scooter, motorcycle, automobile or other public
or private modes of transportation.
PERIOD OF CURFEW: May 31, 2020 until rescinded by the undersigned.
HOURS OF CURFEW: Daily from 6:00 p.m. to 6:00 a.m.
EXEMPTIONS: All law enforcement, fire and medical personnel are exempt
from this Declaration of Curfew Regulations. All members of the news media
engaged in authorized reporting or activities on behalf of their media outlet(s) are
exempt from this Declaration of Curfew Regulations. Individuals traveling
directly to and from work, seeking emergency or necessary medical care, fleeing
dangerous circumstances or experiencing homelessness are exempt from this
Declaration of Curfew Regulations.

At the June 2, 2020 Regular City Council and meeting, the Vernon City Council took the actions
listed below by unanimous vote unless otherwise noted:
1. Received presentation on I-710 South Corridor Update from the Gateway Cities Council of
Governments.
2. A) Adopted Resolution No. 2020-13 approving the Citywide budget for Fiscal Year 2020-
' 2021;and B)Adopted Resolution No.2020-14 establishing the City's Appropriation Limit for
the Fiscal Year 2020-2021.
3. Approved the May 19,2020 Regular City Council meeting minutes.
4. Approved Operating Account Warrant Register No.46, for the period of May 3 through May
16, 2020, which totals $2,224,976.13 and consists of ratification of electronic payments
totaling$1,863,522.53 and ratification of the issuance of early checks totaling$361,453.60.
5. Received and filed the Public Works Department April 2020 Building Report.
6. Adopted Resolution No. 2020-15 approving the City's Records Retention Schedule.
authorizing destruction of certain City records and repealing Resolution No.2017-53.
7. A) Found the proposed action exempt under the California Environmental Quality Act
(CEQA); and B) Approved and authorized the City Administrator to execute Change Order
No. 1 to the Construction Contract with General Pump Company, Inc., in substantially the
same form as submitted, authorizing renewal of the contract term for a one-year period from
July 1,2020 through June 30,2021, at a cost not-to-exceed$600,000 for the renewal term for
on-call well and booster pump repairs.

8. A.) Found the proposed action exempt under CEQA; and B.) Approved the supplemental
expense for an amount up to $8,000 for the implementation of the John Anson Ford Park
Infiltration Cistern, Phase I (Project) approved by City Council under the Sub-Recipient
Agreement between the City of Vernon the cities of Bell, Bell Gardens, Commerce, Cudahy,
Huntington Park, Maywood (Sub-Recipients), and the Los Angeles Gateway Region
Integrated Regional Water Management Joint Powers Authority(GWMA)for the purposes of
the Proposition 1 Storm Water Agreement.
9. Approved and authorized the City Administrator to execute a Services Agreement with Alliant
Insurance Services, Inc. (Alliant), in substantially the same form as submitted, for a one-year
term in an amount not-to-exceed $74,000 for the provision of Health Benefits Brokerage and
Consulting Services,with an effective date of July 1, 2020.
9A. Adopted Resolution No.2020-20 ratifying Emergency Proclamation 2020-02,a proclamation
of local emergency due to the serious and imminent threat of arson,looting,assaults,vandalism
and rioting in the County of Los Angeles and various neighboring cities in close proximity to
the City of Vernon.
10. Adopted Resolution No.2020-16 approving Amendment No. 1 to the Side Letter of Agreement
by and between the City of Vernon and the Vernon Professional Firefighters Association,
Local 2312.
11. Adopted Resolution No.2020-17 approving Amendment No. 1 to the Side Letter of Agreement
by and between the City of Vernon and the Vernon Fire Management Association.
12.A) Adopted Resolution No. 2020-18 adopting Citywide Fringe Benefits Policy and repealing
Resolution No. 2020-07; and B) Adopted Resolution No. 2020-19 adopting Citywide
Classification and Compensation Plan in accordance with Government Code Section
20636(b)(1).
12B. Determined to not send a letter of support for Project Roomkey.
